Lawyers for Arizona Gov. Jan Brewer Thursday filed an appeal of a federal court judge’s decision to gut the state’s new tough immigration law and they have asked the Ninth Circuit Court of Appeals to act quickly on their challenge.
“I will not back down,” Brewer said in a news release announcing the filing of the appeal.

“Good cause exists to expedite this appeal,” the lawyers’ motion reads. They say quick action is needed because District Court Judge Susan Bolton’s decision to grant a partial temporary injunction stops “key provisions of SB 1070 that the Arizona Legislature determined were critical to address serious criminal, environmental and economic problems Arizona has been suffering as a consequence of illegal immigration and the lack of effective enforcement activity by the federal government.”
Brewer is asking the court to agree to a schedule that would start with opening briefs due to the court on Aug. 12 and culminate with oral arguments during the week of Sept. 13.
While lawyers were filing appeals in San Francisco, protesters took to the streets of Phoenix to demonstrate against the portions of SB1070 that took effect on Thursday and to voice their opposition to Maricopa County Sheriff Joe Arpaio’s continued sweeps to round up and detain illegal immigrants.
The Arizona Republic is reporting that there were dozens of arrests, including of member of the media who were covering the protests.
In a statement on the filing of the appeal, Brewer said she has asked the Ninth Circuit to expedite its hearing of this case “since Congress and the President have once again failed to act.
“America is not going to sit back and allow the ongoing federal failures to continue,” Brewer said. “We are a nation of laws and we believe they need to be enforced.”
