    King said he would sue to stop the new Obama amnesty plan, and that he successfully sued his own state’s governor — and won — over a similar separation-of-powers issue. Rep. Steve King (R-IA) announced in a radio interview that he is planning to file suit to block Obama from bypassing Congress to implement his amnesty plan for 1 million (and possibly far more) illegal aliens.

    We also salute Rep. King for calling out Marco Rubio for his “DREAM Nightmare” alternative plan which has exposed Rubio as a rather naive and useful tool for Obama in his pimping of this shameless amnesty.
    King, the vice-chairman of the House Judiciary Committee’s Subcommittee on Immigration Policy and Enforcement, and a good friend of SWA, has been a stalwart opponent of illegal immigration and amnesty. King last year introduced the “Birthright Citizenship Act” (H.R. 140) which would adjust Federal immigration and naturalization guidelines to prevent the “anchor babies” of illegal aliens from obtaining American citizenship.

    Today, on the Mike Huckabee Show, King said he would sue to stop the new Obama amnesty plan, and that he successfully sued his own state’s governor — and won — over a similar separation-of-powers issue.
    “I will tell you that — I’m not without experience on this — I’m prepared to bring a suit and seek a court order to stop implementation of this policy,” King said “I have done it once in the past successfully when then-Governor Tom Vilsack thought he could legislate by executive order — and the case of King vs. Vilsack is in the books.

    Huckabee followed up, asking King: “You plan to sue this administration for implementing something that you believe should have required legislative process and approval?” “That is correct,” King replied.

    Obama’s order grants virtual amnesty to all illegal aliens who were “under the age of 16″ when “brought here” illegally; who have resided here for 5 years; and who attended college or serve in the military. The media is parroting Administration talking point that this would affect “at most 800,000″ individuals, but House GOP data shows this deals with well over 1 million illegal aliens.

    And as we earlier noted, this figure is irrelevant if the criteria of the twice-defeated DREAM Act – which Obama has adapted – would permit new border crossers, those who came here from 17-35 years old, and those presenting phony documents, to apply for amnesty under this order, and would be granted an immediate stay of deportation. This stay could then be extended indefinitely by the DHS Secretary at her own discretion and NOT subject to Congressional approval.

    As a result of these ridiculous lax rules, we will likely see an immediate rush to cross the border in order to obtain fraudulent “documents” and get in on the new Obama amnesty.

    Indeed, one look at the DREAM Act Facebook page shows you they are already looking across the border…

      It speaks to the influence of ALIPAC that Mitt Romney responded so quickly to our release challenging him. In fact we simply exploited a glaring weakness in the script of this political theater. Those controlling this show knew the power of the question if anyone had asked it as we did.

      The disappointing thing is that it sounds like Mitt Romney is agreeing with Obama and Rubio and that his criticism of Obama is that his executive decree does not last long enough!

      'I don't need Congress to defend the Constitution'


      AMES, Iowa – Rep. Steve King, R-Iowa, told WND that he plans to file a motion in federal court to block the Obama administration from implementing a controversial executive order announced this week excluding many young illegal immigrants from deportation.


      The order is aimed at illegals who were brought to the U.S. before they turned 16 years old and are currently younger than 30. The president says it’s unfair to punish those young people for decisions their parents made and argues those young adults are already contributing to society.

      But King says Obama’s move defies the U.S. Constitution by attempting to create new laws via executive order after the DREAM Act, a bill that would have similarly granted benefits to young illegal aliens, failed to pass Congress.

      “I don’t need Congress to defend the Constitution,” King said, indicating he was open to others in Congress joining him, but that he planned to proceed, alone if he must.

      “Barack Obama’s executive order defies the will of the American people,” he explained. “Congress has considered and refused to pass the DREAM Act.”

      King told WND that he has a team of lawyers working through thorny legal problems, including venue – in which
      court he should choose to file the action – and standing, the argument that this is a case that allows King to bring legal action in the first place.

      “Obama has directly challenged the separation of powers, a principle fundamental to the Constitution,” King said. “If we stand by and allow Obama to succeed, we might as well get out a black pen and start marking out those parts of the Constitution Obama finds offensive to him.”

      King noted that Obama’s statute disregards existing federal law that demands illegal immigrants be apprehended and deported, regardless of the age at which they came to the United States or if they have graduated from high school.

      He also pointed out Obama’s speech in March last year, when Obama said he did not have the authority to do what he just did

      “I intend to file a legal action in the courts as soon as possible,” King stressed, “before Obama has a chance to do even more damage to the Constitution.”

      King’s fellow elected official, Sen. Chuck Grassley, R-Iowa, also questioned the president’s authority to ignore immigration law and grant a form of soft amnesty to what some news sources have estimated is roughly 800,000 illegal aliens.

      In a statement, Grassley said that Obama’s action is “an affront to the process of representative government by circumventing Congress and with a directive he may not have the authority to execute.”

      “The president once denied that he had the legal authority to do this, and Congress was assured more than once that the administration would consider individuals for this sort of deferred status on a case-by-case basis only, and that there was no plan to implement a broad-based program,” Grassley said. “It seems the president has put election-year politics above responsible policies.”
