    The U.S. Social Security Totalization Agreement with Mexico

    The United States Social Security Administration has already signed a "Social Security Totalization Agreement" with the Government of Mexico. It must only to be signed by the President to become effective. Unlike "social security totalization agreements" with other nations, this agreement with Mexico contains a loophole which would make ILLEGAL ALIENS eligible for U.S. Social Security benefits for work they performed while in the United States!

    Much of the work in trying to alert the Congress and the public about this agreement has come voluntarily from The Senior Citizens League (TSCL), which has filed requests under the Freedom of Information Act and pursued a lawsuit at their own expense simply to get information about this agreement from our own government. The following information comes from their website at http://www.seniorsleague.org or from printed information received from them by mail:

    "Totalization Agreement - If the President signs the final Executive Totalization Social Security Agreement between the U.S. and Mexico, it could lead to Social Security benefits going to individuals who worked in the U.S. without legal authorization. Despite the efforts of TSCL and others, knowledge of the Totalization Agreement remains limited on Capitol Hill and the issue flies under radar for the most part. TSCL has expressed its support for resolutions opposed to the Totalization Agreement. TSCL has placed ads in The Washington Times in opposition to the proposed agreement and will continue to closely monitor the Totalization matter during the upcoming session of Congress. Current Totalization efforts"

    "Totalization Agreement
    Social Security Totalization Agreements are designed so that workers and their employers would not be subject to double taxation, owing payroll taxes to both the country in which they work, and their home nation. In addition, totalization agreements allow workers to earn generic work "credits" good for receiving retirement benefits in either country. These credits from the United States and other countries can be totaled together to receive benefits. The U.S. currently has 22 totalization agreements with other nations, most having economies similar to our own.

    The U.S. – Mexico Totalization Agreement—which was signed by the Social Security Administrations of both the U.S. and Mexico in 2004, and is due to undergo review by the current or future President(s)—continues to pose a threat to Social Security beneficiaries.     how would this work? The entire country of Mexico can claim they have worked in the US and who is going to know how to counter their claim - they were working illegally!!!!!!!

    Thanks for the heads up Texas2step. I called the seniorsleague and spoke to 2 attendants and told them they were welcome to visit ALIPAC as I thought there might be some mutual concerns for both parties.

    I called my Rep afterwards and expressed my concerns reguarding HR 160.

    Perhaps I should put my Reps number in the speed dial mode? Things are really ratcheting up.

    Thank you, roundabout. I never would have heard of this S.S. agreement either if I weren't now on "senior citizens' mailing lists".

    Congressman Ron Paul (R-TX) introduced the "Social Security for Americans Only" Act (H.R. 190) in the 2007-2008 Congress; I do not know if he reintroduced his bill this year.

    I received the following by mail last week from The Senior Citizens League, P.O. Box 97173, Washington, D.C. 200909, www.seniorsleague.org/ . With respect to the source, I have no way of knowing whether this information is accurate.

    Dear Friend,

    We retained a well regarded law firm to study the U.S./Mexico Social Security Totalization Agreement and tell us what, if anything, it would mean to current Social Security recipients when it is signed.

    Here is what they told us -- I think you will be as SHOCKED as I was:

    They believe that if the Agreement goes into effect, the millions of Mexican citizens who will become eligible for the Social Secuirty benefits will have a FAR STRONGER CLAIM TO BENEFITS and PROTECTION AGAINST CUTS than U.S. Citizens!

    This will happen because a well-known U.S. Supreme Court ruling known as "Fleming vs. Nestor" makes it clear that Congress can CUT OR CHANGE the Social Security benefits you and I receive at any time, and that Americans do not have a "right" to Social Security benefits -- no matter what Congress or the Social Security Administration may have said in the past, how much you may have paid int or how much you may be hurt by cuts.

    However, the promises made in the Agreement with Mexico will be protected because Mexican workers would obtain legally-enforceable rights to U.S. Social Security benefits under the Agreement.

    This means that millions of Mexican citizens and dependents who are covered under the Agreement will have almost bullet proof protection against Social Security cuts and changes such as those that are being discussed in Washington.

    This is a good petition TSCL has put together. They now have almost 44,000 signers. It would be good to see them get a few hundred thousand signed on so they could take a shot at making a decent presentation of it and hopefully contribute to putting some in Congress on the spot.

    I like the way they have those signing broken down by their state of residence.
