    What is happening in the lawsuit against the village of Carpentersville by the woman who says they would not transport her sick baby because he is Hispanic?

    Answer: The infant son of former village resident Gloria Lopez suffered brain damage, according to a $30 million federal lawsuit filed in September 2007.

    It claims that the then-4-month-old boy sustained permanent damage because two fire department paramedics refused to transport him to the emergency room when he fell ill in September 2006. The complaint further alleges that Carpentersville has anti-Hispanic policies that limit services to some residents and otherwise help foster an anti-immigrant sentiment.

    Many civil matters move incredibly slowly -- even more slowly than criminal cases. But lawyers in Lopez v. village of Carpentersville have been progressing.

    Plaintiff's attorney Ted Karavidas has received various discovery materials from the village. After reviewing them, he plans to begin scheduling depositions, possibly within the next month or so, he said. During depositions, witnesses answer lawyers' questions under oath but outside the courtroom. The sessions are recorded in a transcript and referred to at trial if necessary.

    "We have to work out a schedule with the village," Karavidas said.
    An initial status hearing is scheduled for mid-July in U.S. District Court in Chicago.
    Karavidas said Lopez's son now is 2 years old and cannot sit up, roll over, talk or eat. Because the boy's life should not be significantly shortened by the brain damage -- and because he is unable to take care of himself -- his lifetime medical bills could be $10 million, Karavidas said.

    Defense attorney James DeAno, who represents the village and the two paramedics, said he could not comment beyond noting that written discovery is ongoing.

    CARPENTERSVILLE (STNG) - A mother alleging Carpentersville paramedics didn't take her son to a hospital last year because of his Hispanic ancestry is expected to file a lawsuit today against the village and two of its firefighters seeking $30 million.

    Gloria Lopez alleges that Carpentersville fire department emergency medical technicians Diane Graham and Martin Gruber didn't take her son Osbiel to a hospital after the two came to her home in the 900 block of Berkley Street on Sept. 18, 2006, in response to a 911 call complaining the then 4-month-old boy was suffering a seizure. The suit is to be filed in the U.S. District Court in Chicago.

    A second group of paramedics took the boy to Sherman Hospital after his baby sitter called 911 again three hours later, according to court documents. In her suit, Lopez alleges Graham and Gruber saw the child was in distress but "denied Osbiel Lopez EMS transportation services on the basis of his Hispanic origin."

    Ted Karavidas, Lopez's attorney, said Osbiel Lopez suffered a brain injury due to lack of oxygen shortly after Graham and Gruber left the home. He declined to elaborate on what type of evidence the charges were based on.

    Village fire Chief John Schuldt said he had not seen the official complaints and could not comment on the case.

    "We know (Gloria Lopez) had some concerns and we supplied documents," he said. "That's the last we heard about it."
    Graham and Gruber still work for the department, he said.
    Lopez's suit also alleges the village government created a general atmosphere that led to the events resulting in her son's injuries. Carpentersville had "promoted ... the cessation, reduction or limitation of emergency services to persons of Hispanic descent" during the time the incident took place, the suit states.

    Last September, village trustees were discussing adopting the Illegal Alien Immigration Relief Act sponsored by Trustees Paul Humpfer and Judith Sigwalt. The proposal, now tabled, would penalize landlords and businesses that aid or abet illegal immigrants. It also would have designated English the official village language, a measure the board passed as a non-binding resolution in June.

    The proposal kicked off a racially charged debate over immigration in the village that hasn't abated since, with an estimated 3,000 people protesting outside village hall in October.

    The plaintiffs will hold a press conference on the suit at 1 p.m. today at the federal court building in Chicago.

    She allegedly has PROOF that's the reason they didn't transport him to the hospital? That means this ambulance has NEVER transported a hispanic person to the hospital? I doubt that.

    If she was so concerned about the baby why did she leave him with a babysitter instead of driving him to the hospital, taking the bus, a taxi, or calling a friend, or asking a neighbor for a ride. The babysitter waited 3 hours before calling 911, so who says he wouldn't have been fine if his mother took him there herself. Too bad the article didn't mention where she went, why she left the baby without bringing him to a hospital, clinic, or doctors office, and why, if he was so sick, she left him with a babysitter.

    I have a hard time believing that the ambulance drivers told this woman that they wouldn't take her baby because it is hispanic. race card = $$$$$
