Amnesty Groups Rally As Appeals Court Hears Executive Amnesty Arguments

    by Caroline May
    10 Jul 2015

Amnesty groups took to the streets in New Orleans Friday in support of President Obama’s executive amnesty as the Fifth Circuit Court Court of Appeals heard arguments for and against its constitutionality.

While activists shouted outside, inside the courtroom judges were hearing the arguments of the 26 states challenging President Obama’s executive amnesty and Justice Department lawyers defending it.

In February a district court judge blocked implementation of the executive amnesty programs — Deferred Action for Childhood Arrivals (DACA) and Deferred Action for Parents of Americans and Lawful Permanent Residents (DAPA) — that were slated to provide to shield up to 5 million illegal immigrants from deportation and make them eligible for work permits.

The Obama administration’s lawyers are expected to face an uphill battle in arguing to allow the programs to move forward. The same panel of justices who heard an earlier emergency appeal to lift the lower court’s injunction are hearing Friday’s arguments on the totality of the lower court’s ruling.

Both sides have, however, struck an optimistic tone about their prospects.

“This will be an argument before the Fifth Circuit on Friday that’s based on the merits of the case,” White House Press Secretary Josh Earnest said earlier this week. “And the administration continues to have a lot of confidence in the power of those legal arguments.”

Thursday Texas Attorney General Ken Paxton — the state leading the fight against the actions — reiterated the states’ concerns with executive amnesty.

“The Obama Administration unilaterally rewrote the law, creating an amnesty program that will reward people who are here illegally with free government benefits. Any sweeping change in immigration policy must come from our elected leaders in Congress – not from one individual via executive action. The district court rightly stopped this program in its tracks, and we will continue fighting President Obama’s disregard for the rule of law.”

Regardless of the happenings on the inside of the courtroom, amnesty activists demonstrated and blocked traffic outside.

Texas AG: Obama Amnesty Would Prompt Massive Changes to Immigration Law Without Congressional Approval

With the Fifth Circuit Court of Appeals considering arguments Friday, Texas Attorney General Ken Paxton reiterated the coalition of 26 states’ arguments against executive amnesty.

“President Obama’s executive amnesty program would prompt some of the most massive changes to national immigration law in history, all without any input from Congress or the American people. Federal lawyers today even acknowledged several times that this action constitutes a ‘significant policy enactment,’” Paxton, whose state of Texas is leading the coalition, said in a statement Friday.

The Fifth Circuit is slated to decide whether to uphold U.S. District Court Judge Andrew Hanen’s February injunction on Obama’s executive amnesty programs — Deferred Action for Childhood Arrivals (DACA) and Deferred Action for Parents of Americans and Lawful Permanent Residents (DAPA) — that were slated to shield up to five million illegal immigrants from deportation and make them eligible for work permits.

“Our system of checks and balances is intended to prevent the very action that this president has taken,” Paxton added Friday. “This lawsuit isn’t about immigration policy – it’s about the rule of law, and we need to leave lawmaking to Congress, which was entrusted, empowered and elected by the people to do just that.”

The administration’s prospects might not be as good it would hope, however. In May, the same panel of justices considering the merits of the larger appeal declined the government’s request for an emergency stay of Hanen’s ruling to allow the programs to move forward.

Earlier in the week, White House Press Secretary Josh Earnest nevertheless expressed confidence.

“This will be an argument before the Fifth Circuit on Friday that’s based on the merits of the case,” White House Press Secretary Josh Earnest said earlier this week. “And the administration continues to have a lot of confidence in the power of those legal arguments,” he said.

The 25 states joining Texas in the lawsuit include Alabama, Arizona, Arkansas, Florida, Georgia, Idaho, Indiana, Kansas, Louisiana, Maine, Michigan, Mississippi, Montana, Nebraska, Nevada, North Carolina, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Utah, West Virginia, and Wisconsin.

Personally I do not find it fitting that aliens and supporters rally outside the courthouse while cases concerning them are in session. Causing mayhem seems that they disrespect the laws that they claim they want to abide by. Seems to be an oxymoron there somewhere.

Since they obviously disrespect law, should they win, what will laws become when they are legal. I feel strongly that you and I will not be legal. They already call us racist so that they will have cause to ban/bar us and our grandchildren. What have WE, the people of America gained by procrastination over this problem for 40 years? We have known that it existed at least that long! Someone must know what we gained instead of acting then!

Are we ready to confront the problem we created head on?

The Obamaphones are a necessary tool for the illegals to use to organize - they all get them and the taxpayers pay for them. What a crock.
