AP NewsBreak: HAZELTON Pa. Immigrant Law Voided

AP NewsBreak: Pa. Immigrant Law Voided

ALLENTOWN, Pa. (AP) - A federal judge on Thursday struck down the city of Hazleton's tough immigration law, which has been emulated by cities around the country.

The Illegal Immigration Relief Act sought to impose fines on landlords who rent to illegal immigrants and deny business permits to companies that give them jobs. Another measure would have required tenants to register with City Hall and pay for a rental permit.

It was pushed by Hazleton's Republican mayor last summer after two illegal immigrants were charged in a fatal shooting.

Hispanic groups and illegal immigrants sued in federal court to overturn the measures, saying they usurp the federal government's exclusive power to regulate immigration, deprive residents of their constitutional rights to equal protection and due process, and violate state and federal housing law.

On what possible grounds could they rule this way???

A good try - that is a set back.

Can this be used to make decisions in other cases - any lawyers here?

Judge strikes down Hazleton immigration ordinance

Judge strikes down Hazleton immigration ordinance
    The Morning Call

    1:28 PM EDT, July 26, 2007

A federal judge has struck down the city of Hazleton's tough crackdown on illegal immigrants.

A press conference regarding the decision is scheduled for this afternoon in Hazleton.

The American Civil Liberties Union and several other advocacy groups sued Hazleton, charging that the ordinance infringed on the rights of Latinos and also disregarded the federal government's sole authority to regulate immigration.

A nine-day trial held in March at the William J. Nealon Federal Building in Scranton drew national attention. The decision could set a precedent for attempts by local governments to pass laws affecting illegal immigration.

I cannot believe we live in a country where they are basically saying it is unconstitutional to enforce the law? Once again, we have been shown that judges, politicians , etc. give more rights to lawbreakers than they do to law-abiding American citizens. This makes me so mad.

Yes, what is next? Will Hazelton appeal this? What if anything can we do?

Yes, as I recall, Mayor Barletta thought it may have to go that far.

This could set a bad precedent for similar suites that are pending. Sure hope a judge in a higher court has a pair!
