A 40-year-old Mexican man who was arrested by Nogales Station Border Patrol agents in March was sentenced to four years and nine months in prison for attempting to illegally re-enter the United States, U.S. Customs and Border Protection said.
Marco Castro DÃ*az, of Obregon, Sonora, was apprehended by agents on March 5. During processing at the Nogales Station, a background check revealed Castro was convicted for attempted residential burglary in Maricopa County in 1997 and was sentenced to two years and six months in prison, the Border Patrol said in a press release.
Agents also found that Castro had been deported from the United States after serving that sentence.
The Tucson Sector’s Prosecution Unit submitted the March incident to the U.S. Attorney’s Office for re-entry of a felon, the Border Patrol said in the release.
After Castro has served his time in federal prison, he will be formally removed from the country. He also has been banned for life from all legalization processes without a waiver from the U.S. Attorney General under the Border Patrol’s Consequence Delivery System.
The CDS program is an attempt to disrupt the smuggling cycle and reduce recidivism rates by punishment to the full extent of the law, the Border Patrol said.
