    Tennessee AG Says He Won't Sue Federal Government Over DACA

    DACA Recipients Await Trump Decision on Program

    While a letter from 10 states' attorneys general sent to United States Attorney General Jeff Sessions indicates the threat of a lawsuit against the federal government if President Donald Trump doesn't end the Deferred Action for Childhood Arrivals program, Tennessee Attorney General Herbert Slatery writes in a letter sent to U.S. Sens. Lamar Alexander and Bob Corker Friday that he doesn't want to sue over the program.


    Slatery writes that "there is a human element" to ending DACA that cannot be ignored.


    "As of the sending of this letter, the Administration has not agreed to rescind the June 15, 2012, DACA memorandum and order as requested by the coalition of States," Slatery writes. "At this time, our office has decided not to challenge DACA in the litigation, because we believe there is a better approach that we outline below."


    Slatery goes on to write that rather than sue the federal government, he'd prefer Congress come up with a solution that addresses the issue when it comes back into session Sept. 5.
    In the original letter, the attorneys general were threatening to sue, saying then-President Barack Obama didn't have the authority to enact DACA, and that Congress should have had final authority on whether to implement any program like it.

    Trump has said he plans to make a decision about DACA — an Obama policy that allowed temporary relief and work permits to children of undocumented immigrants — before Monday, and recipients of the program in Tennessee are feeling left in the lurch.


    Dulce Castro, an 18-year-old who's lived in Nashville since she was 6, says if Trump were to end the program, it could keep her from getting an education and contributing to society the way she's envisioned.

    Castro is a freshman at Cumberland University. She's on track to earn a nursing degree on a full-ride scholarship to Cumberland, in a state where there's a federally recognized lacked of health care professionals.
    Castro is one of the 8,300 Tennesseans who are recipients of DACA, which was founded in 2012.


    In addition to Tennessee, nine other states — Texas, Alabama, Arkansas, Idaho, Kansas, Louisiana, Nebraska, South Carolina and West Virginia — also pledged to sue the federal government over the program in the June letter.


    "I'm not going to lie, I'm really scared," Castro says from the offices of the Tennessee Immigrant and Refugee Rights Coalition. "When I applied for DACA, I felt like I was doing the right thing and like it gave me the opportunity to make things better for my family, myself and for others."


    Worst-case scenario, says Cesar Bautista, youth organizer for TIRRC and DACA recipient, Trump ends the program and launches into deportations for its recipients, 91 percent of whom are gainfully employed.

    "Either way, Dreamers will continue to fight, and continue to educate our fellow Dreamers on our rights," says Bautista, 28. "DACA is not the end goal — a legal path to citizenship is the end goal. DACA was never intended to be that path, and we've been working to create one."

    Why Tuesday to announce? Is the White House arm twisting State Attorney Generals to drop their suit against DACA? Tennessee AG now praises Senators Lindsey Graham and Dick Durbin and dream act legislation. TN Republican Senators Lamar Alexander and Bob Corker want amnesty. Republican Governor Bill Haslam wants amnesty.

    President Trump is an amnesty President, granting amnesty every day to illegal aliens. He has grown their numbers, broken the promise to end the illegal amnesty program and he has aligned himself with groups like LaRaza, the ACLU, Maldef, Mecha, democrats, RINOs, Mexico, others who demand amnesty for illegal aliens. The President put into place General John Kelly who vowed to protect the illegal aliens. He is surrounded in the White House swamp by amnesty shills. Ivanka, Jared, Mike Pence, and the many globalist elites he chose to appoint push for amnesty.


    DACA or any Dream Act is amnesty for millions. They have family that will piggyback onto them. It would be a pinhole in the wall that will crack open to flood our nation with foreign citizens meddling and continuing to create havoc on our country.

    Tennessee, one of 10 states whose attorneys general had sued to stop the Obama-era Deferred Action for Childhood Arrivals (DACA) program, pulled out of the lawsuit Friday — a victory for immigration advocates who have been pressuring states to stand down.


    In a letter to Tennessee’s two Republican senators, Attorney General Herbert H. Slatery III said that his state would leave the lawsuit out of consideration of “the human element,” referring to the hundreds of thousands of DACA recipients whose lives would be thrown into chaos. Some 800,000 young people who are in the United States illegally are protected from deportation under the program.



    “Many of the DACA recipients, some of whose records I reviewed, have outstanding accomplishments and laudable ambitions, which if achieved, will be of great benefit and service to our country,” Slatery wrote. “They have an appreciation for the opportunities afforded them by our country… our Office has decided not to challenge DACA in the litigation, because we believe there is a better approach.”

    That approach, wrote Slatery, was the Bridge Act, a bipartisan bill designed to make the deferred action program permanent for people who had arrived in the United States as children and had otherwise obeyed the law.




    “Whether this particular legislation is a viable solution is a matter for congressional debate,” wrote Slatery. “It is not a comprehensive answer to our immigration policy challenges, but it would be a very good start. As I have admired your careers over the years, I have perhaps been most impressed at how you take on difficult problems and lead us to a better place. I encourage your serious consideration of this proposed legislation.”

    Unlike most states, where voters elect the attorney general, Tennessee’s chief law enforcement officer is appointed by the state’s Supreme Court. The Tennessee Immigrant and Refugee Rights Coalition was quick to congratulate Slatery.

    The White House said on Friday that President Trump would announce whether he plans to keep his campaign pledge to end the program on Tuesday, which is the deadline set by the states to file a lawsuit against DACA unless the president rescinds it. House Speaker Paul Ryan (R-Wis.) and other Republican leaders in Congress on Friday urged Trump not to terminate it.

    There are many democrats hiding under the name of Republican in Tennessee. Lamar Alexander and Bob Corker, Governor Bill Haslam, Randy Boyd, Todd Gardenhire and others operate more like democrats when supporting illegal aliens. Any support for DACA is further evidence. They bow to the demands from the TIRRC, an immigrant and refugee rights group in Nashville, TN that is linked to Linda Sarsour, a Muslim with terrorist ties, George Soros, LaRaza.

    Tennessee wastes 500 million dollars a year on illegal immigration. In the upcoming governors race, LaRaza Randy Boyd (Tennessee Star) has garnered support from a large group of mayors. He is tied to LaRaza through another group and it is reported that he has contributed a large sum of money. News reports that he supports in state tuition for illegal aliens.

    There are at least 8,000 illegal aliens eligible for DACA in Tennessee. They bring crime, gangs, fraud, drugs, and take precious jobs and other benefits that should go to citizens and legal immigrants through family. They are allowed to break the law and still receive DACA according to government documents.

    Tennessee is also on a list of states that have a high likelihood of female genital mutilation. Republicans are losing their way.
