A Bridgeport man, later found to be an illegal alien, has been charged with illegally capturing videos of people using a rest room at a Subway restaurant in Darien.
Marco Dias, age 21 of 170 Kaechele St. was arrested Aug. 2, charged with three counts of voyeurism, a Class D felony, by Darien Police.

On Aug. 1, Darien Police received a complaint that a “spy camera” had been installed in the unisex bathroom of the Subway restaurant at 22 Heights Road.

Police said examination of the footage revealed three separate individuals who had been unknowingly captured on video. In addition to the three victims, the suspect who installed the camera was also captured on the video and was subsequently identified as a Subway employee.

Due to the nature of the crime and the potential for further victims, the investigation was expedited, according to Darien Police. On Aug. 2 an arrest warrant was applied for and granted by the state Superior Court in Stamford. At about 1:15 p.m. Aug. 2 the Darien Police Detective Division executed the arrest warrant and took the suspect into custody while he was at work at Subway.

Subway’s public relations manager, Kevin Kane, issued the a statement following the arrest: “All Subway restaurants are individually owned and operated by independent franchisees.

“While the hiring and staffing of the restaurant is the sole responsibility of the franchisee, the brand requires franchisees to follow all applicable laws and regulations.

“We are aware of the allegations made regarding a Darien Subway restaurant and will be actively looking into them. We do not condone the alleged behavior and can assure our customers that this is not the business practice used by Subway franchisees.

“As this is an ongoing investigation we can provide no further comment.”

Dias was held in lieu of a $25,000.00 bond, but during processing it was discovered that he is in the country illegally. At that point the Darien Police contacted the United States Immigration Service, which subsequently placed a “detainer” on Dias, meaning that he is now being held indefinitely.

Dias had no prior criminal history, according to Darien police.

Darien detectives executed a search warrant at Dias’s residence at about 5 p.m. Aug. 2. Police found an additional “spy” type camera and associated computer equipment. These items will be forensically examined in the near future.
