CA: $12.5 Million Awarded to Victim of Sexual Assault in San
$12.5 Million Awarded To Victim of Sexual Assault in Santa Clarita
Friday, March 05 2010
After a five-week trial, a Los Angeles Superior Court jury awarded 94 year-old Sophie Schwartz $6 million in general damages and $6.5 million in punitive damages following a 2007 sexual assault at a senior living facility in Santa Clarita.
Schwartz, who suffers from dementia, was sexually assaulted in her room by an illegal immigrant named Jose Vasquez, who was employed by Oakdale Heights Management Corporation. Both Vasquez and Oakdale Heights were listed as defendants in the case.
"This was a very emotional trial on many different levels," stated Gregory Owen of Santa Clarita-based personal injury law firm Owen, Patterson & Owen who, along with wife and partner Susan Owen, represented Schwartz. "The jury sent a loud message to elder care providers who choose profit over people and ignore laws designed to protect our community's most vulnerable members. This type of conduct will not be tolerated."
The $12.5 million judgment is one of the largest ever awarded for emotional trauma.
The jury found that Oak Heights Management Corporation purposely falsified employment documents in order to hire Vasquez, who was given a master key to all rooms. Additionally, Oak Heights was found to have violated several California laws governing the care of dementia residents.
Vasquez was convicted in a criminal case in 2008 and is serving an eight-year sentence for attempted rape.
One of the corporate defendants is currently ranked the 28th largest operator of elder home facilities in the nation.

This case decision by the jury should be major headlines in every newspaper and every radio talk show and every TV new program in America.
Can you hear it? If you can't you aren't listening. America is Awake and won't accept any more lies about illegal immigration from governments, employers, service providers, businesses, or anyone else.

Sadly, if I were not a member of ALIPAC, I would have never even heard about this story.
Just the way the MSM wants it, as it does not bode well with their pro-invader, open border agenda they promote on daily basis.Join our efforts to Secure America's Borders and End Illegal Immigration by Joining ALIPAC's E-Mail Alerts network (CLICK HERE)

Now another point to consider is that this nursing home, this "business", will pay that judgment with insurance money from business liability insurance because the event happened on their property and the harm was caused by their employee. So each and every time one of these juries decides one of these cases, the insurance companies wince. If enough people file enough of these lawsuits then the insurance companies will start playing their role in enforcing US immigration law because they won't insure anyone who hires illegal aliens in violation of the US immigration law. They'll be sending their own teams into these businesses to review employment records and E-Verify just like a fire and casualty company sends their inspectors in to inspect a facility and sprinkler systems before they insure it and at least 1 a year during the course of that insurance period with that insurance vendor for annual inspections. When there are violations, they give you a brief time to correct it or they pull the insurance.
Who is the largest insurer of business liability insurance? AIG. So taxpayer money is being used to bail-out the entities that pay business liability judgments for business owners who broke US immigration law hiring illegal aliens that results in Americans being hurt, including the sexual assault of a 94 year old woman in a nursing home that is more than likely funded by taxpayer dollars through MediCare and/or MediCaid.
Getting the picture? Solution:
1. Not one dime of MediCare, MediCaid, HIPP or SCHIP should go to any nursing home, hospital or doctor's office, lab, pharmaceutical company, manufacturer of products or providers of other services that hires even 1 illegal alien in the US. Not 1.
2. Not one dime of business liability insurance should be used to pay any jury award involving any damages caused by an illegal alien "employee" of any organization in the US. Not 1.
3. Not one not-for-profit business that hires any illegal alien or provides services to illegal aliens in violation of US immigration law should continue to hold 501 C 3 status. Not 1.
Congresscritters, get some laws in motion to require the US Treasury to pull all funding from any insurance company paying jury awards to businesses who violated US immigration law and pull the 501 C 3 status of any organization hiring any illegal alien in any capacity and require the Social Security Administration to E-Verify every establishment it pays through MediCare and require every State to verify every establishment it pays through MediCaid and SCHIP.
Very simple laws. 1 or 2 paragraphs is all that's needed to shut this down once and for all.A Nation Without Borders Is Not A Nation - Ronald Reagan
