City issues cease-and-desist order for private border wall

    May 28, 2019 7:11 PM in
    News - AP Texas Headlines

SUNLAND PARK, N.M. (AP) - A border suburb of El Paso, Texas, has issued a cease-and-desist order against construction of a privately funded border barrier.

A spokesman for Sunland Park, New Mexico, said Tuesday that the barrier being erected by We Build The Wall Inc. on private property doesn't comply with city ordinances.

City spokesman Peter Ibarbo says the company had applied for a construction permit but the application was incomplete.

The company didn't immediately respond to a message from The Associated Press.

In a statement to KVIA-TV in El Paso , the company says it had "done everything they need to do to be in compliance with all regulations."

The company calls the stop order "a last ditch effort to intimidate us from completing this project."

You knew 100% something like this was going to happen. I knew these guys had to have a permit for something like this? These city A-holes gave them some type of GO-AHEAD WITH IT and now they are going back on whatever they signed with this group under pressure from the FEDS or from the traitors in the Texas State Government who are doing NOTHING to secure that border during this engineered crisis.

HOW MUCH you want to bet they order them to TEAR IT ALL DOWN?????

Privately funded "We Build the Wall" is in violation, says mayor

SUNLAND PARK, N.M. (KFOX14) — The privately funded border wall is in violation of city ordinance, according to Javier Perea, the mayor of City of Sunland Park.

According to Perea, the owner of the land submitted an application for a wall with the City of Sunland Park on Friday, but officials found that the paperwork was incomplete.

The “We Build the Wall” structure was erected on private land over Memorial Day weekend.

A cease-and-desist order given to the owner of the property, Perea said.

”On Thursday, we were denied entry to the location and then, on Friday, the owner of the property did come to the city of Sunland Park and submitted an application for a permit,” said Perea.

No site plan for the project was provided to Sunland Park, he added. A wall can only be six feet tall under the city’s ordinance.

But the company behind the wall claims the city had permitted them to build the wall.

"One official gave us the all-clear on Thursday. Another gave us the all-clear on Friday. And that's actually when they came down and examined the site and told us we could proceed,” said Chris Kobach, a representative for We Build the Wall.

The mayor said those claims are not true and that he wasn't aware of any city official giving the company permission to build.

Dustin Stockton, co-founder of the nonprofit WeBuildtheWall Inc., told KFOX14 during a tour at the wall that it is "mostly up" and should be completed by the end of the week.

”In less than 60 days, we conceptualized and implemented a project of this scale, and everyone's taking a lot of pride in that,” said Dustin Stockton, co-founder of We Build the Wall.

The site of the wall is currently in a work stoppage, but both sides say they are prepared to take this dispute to court unless it is resolved.

TOTAL 100% BS!!!!! It should be all on paper that they had the permission to start the project. This contractor would never have started something like this if it wasn't all approved by the city. You just don't get a verbal OK from the city and run out and do something like these guys just did.

Wow. What a shame. Throughout the United States, city zoning ordinances prevail. You can apply for a variance to them, but city officials can't issue a variance, for example, to build an 18 foot high wall versus a 6 foot high wall, you have to go to go through variance process, which takes months, because of public hearings on the subject, and usually involves city staff first for a recommendation to the Planning Board, a hearing and ruling there, and if they approve it, then you have to take it to the City Council, at a regular city council meeting, open to the public, with hearing time for pros and cons, before the City Council votes to approve the variance.

You would have to study the city's zoning ordinances to know what was required here, and apparently that wasn't done. Maybe there is an exception or loophole of some kind when the other side of the wall isn't next to an American neighbor. I doubt it, but that's possible.

I hope they can work it out and get it resolved, but under normal procedures for a variance, that will take months.

It’s pretty bad when our legal team has to educate Sunland Park mayor on his own city ordinances. They don’t even understand their own laws. We’re about to embarrass them in from of the nation who is watching!
