    A three-member panel of circuit judges gave U.S. border officials permission on Friday to use a Trump-era emergency policy to swiftly expel unaccompanied migrant children from American soil without a court hearing or an asylum interview.

    Judges Gregory Katsas, Neomi Rao and Justin Walker of the U.S. Circuit Court in Washington, D.C. paused a lower court order that had blocked the government from expelling children apprehended along U.S. borders without their parents or legal guardians. All three judges were appointed by former President Trump.

    While U.S. border authorities can resume expelling unaccompanied children, it's unclear if the Biden administration will choose to do so. Representatives for the Department of Homeland Security and its sub-agency, Customs and Border Protection, did not immediately respond to requests to clarify their plans. The Department of Justice declined to comment on Friday's order.

    In March 2020, the Centers for Disease Control and Prevention (CDC) allowed U.S. immigration authorities to expel all unauthorized border-crossers, regardless of their age or intention to seek asylum, saying the sweeping policy was needed to avert COVID-19 outbreaks inside migrant holding facilities and border communities.

    Three former Trump administration officials told CBS News that former CDC director Robert Redfield signed the policy under pressure from the White House and over objections from experts in his agency who believed the broad restriction lacked a sufficient public health justification.

The Trump administration later conceded in court that it mistakenly expelled at least 70 unaccompanied minors in violation of Sullivan's order.

    In his November order, Sullivan said the policy of expelling unaccompanied minors violated several legal safeguards Congress established to protect them from violence, persecution and trafficking. Under U.S. law, these children are protected from expedited deportations and are supposed to be promptly transferred out of Border Patrol faculties and into shelters overseen by the U.S. Office of Refugee Resettlement.

    While he has vowed to undo many of Mr. Trump's restrictions for asylum-seekers along the U.S.-Mexico border, President Biden has not said whether his administration will limit or scrap the CDC order that authorizes the expulsions.

    Lee Gelernt, an American Civil Liberties Union attorney who filed the lawsuit on behalf of the unaccompanied children, called Friday's court order a "temporary setback."

    "We will continue to litigate this case on behalf of these vulnerable unaccompanied children, who are in need of protection and legally entitled to apply for asylum," Gelernt told CBS News. "But we hope the Biden administration will not make ongoing litigation necessary by rescinding this illegal policy created by the Trump administration."

    Wendy Young, the president of Kids in Need of Defense, a non-profit that offers legal assistance to migrant minors, also called on the Biden administration to "waste no time in officially abandoning this cruel and senseless practice."

    Empty out the detention centers and expel 100% of them.

    Let their Embassy or Consulate get involved to process them and send them back into the care and custody of family members back home.

    We are not the daycare center for the world.

    We are not their travel agent to send them back. Their Embassy can pay for it.

    Overbreeding in poverty, wanting a better life, is not "asylum". They have no right to asylum. They have a right to a "better life" right back on their own damn soil.

    Hear these cases via Skype in their country. They do not need to come here.

    Round up the illegal parents and relatives who are already here and expel them too.

    We do not dump our kids on Canada. Canada does not "keep" our kids or release them. That is kidnapping! They should be processed and expelled within 48 hours.

    Their president needs to protect their vulnerability and take care of them, not the USA or it's taxpayers.

    Shut this chain of human trafficking down.

    THIRTEEN THOUSAND were expelled.

    We cannot take in thousands of children from all over the world. This is outrages. Get these people on birth control, they are disgusting to do this to their own children.

    We have MILLIONS to expel.

    Slam that border shut.
