DACA's not legal is it? That's one of those lawless Obama Executive Orders. Right? The Dream Act has never passed Congress to my knowledge, so Immigration law remains unchanged. Right?

Whether we think DACA is legal or not the fact is illegal immigrants have found a loophole to adjust their status in the U.S. They get an Advance Parole to visit a sick relative, for work and even for education studies. They can be out of the country for just a day and when they come back in they are considered to be here legally. If they are married to a U.S. citizen, they are no longer afraid to apply for a green card for fear of being sent back to their home country for 10 years. They are using this loophole and marriage to American citizens to jump in front of the line.

Oh I see, yes, but once there's a deportation order against them, all their privileges are null and void and they're subject again to US immigration law. I think those DACA permits were for 2 years, so expiring now or soon, and Judge Hanen stopped the 1 year extension Obama tried to pull. All that's illegal and not binding once a new President is in office and refuses to honor it, if there are any unexpired ones left by that time, which I don't believe there will be. I think they all will have expired by this year or next. Hopefully we'll have a Court Ruling revoking all of it before then anyway.

Judy DACA is still open. People are still applying and getting DACA. You are right that if there is a deportation order they cannot get an Advance Parole to travel outside of the U.S. They also understand that they could lose their DACA depending on the next president. That is exactly why they are all rushing to use the Advance Parole to adjust their status in the U.S.

If that's the case and if the US government is issuing some kind of DACA permit, then this needs to be reported because Judge Hanen in his federal ruling halted all DAPA AND DACA in February:
Federal Court Halts DAPA and Expanded DACA Programs
    By Center for Migration Studies
    – February 17, 2015Posted in: CMS News

On Monday, February 16, 2015, Judge Andrew S. Hanen of the US District Court for the Southern District of Texas, Brownsville Division issued a preliminary injunction to temporarily prevent the federal government from implementing the Deferred Action for Parental Accountability (DAPA) and the expanded Deferred Action for Childhood Arrivals (DACA) programs.

The order was issued as Judge Hanen continues to consider the lawsuit brought in December 2014 by twenty-six states seeking declaratory and injunctive relief against the United States and certain federal officials. The plaintiffs aver that the DAPA and expanded DACA programs violate the Take Care Clause of the US Constitution and the Administrative Procedure Act (APA). In ordering the injunction, Judge Hanen found that the federal government failed to fulfill the APA’s “notice and comment requirement.” Judge Hanen has not yet issued a final decision on the merits of the case, including whether or not the executive measures violate the US Constitution.

US Citizenship and Immigration Services (USCIS) had planned to begin accepting applications for the expanded DACA program on Wednesday, February 18, 2015. The DAPA program was expected to open sometime in May 2015. Department of Homeland Security (DHS) Secretary Jeh Johnson has announced that, pending an appeal, DHS “will not begin accepting requests for the expansion of DACA…as originally planned.” Johnson also said, “Until further notice, we will also suspend the plan to accept requests for DAPA.”

The DAPA and expanded DACA programs would have provided temporary relief from deportation and work authorization for up to 5.2 million unauthorized immigrants in the US (Warren 2014). The order will not affect unauthorized immigrants eligible for the DACA program implemented in 2012 because the lawsuit does not challenge the original DACA program (Lind 2015).

In a statement released on February 17th, the White House stated, “The Department of Justice, legal scholars, immigration experts, and the district court in Washington, D.C. have determined that the President’s actions are well within his legal authority.” The federal government is expected to appeal the injunction to the Fifth U.S. Circuit Court of Appeals in New Orleans (Koppel and Meckler 2015; Lind 2015). Should the federal government win its appeal, it is possible that enrollment may open for the DAPA and expanded DACA programs.

Regardless of the success of the appeal or Judge Hanen’s final decision, officials, experts, and advocates anticipate an extremely long legal battle that may reach the Supreme Court. Meanwhile, service organizations remain optimistic and are continuing to prepare immigrants for the two programs (Koplowitz 2015; Hennessy-Fiske 2015; Solís 2015).

The Complaint for Declaratory and Injunctive Relief is available at https://www.texasattorneygeneral.gov...derLawsuit.pdf.
Judge Hanen’s Memorandum Opinion and Order is available at https://www.scribd.com/doc/255994067...-United-States. His Order of Temporary Injunction is available at https://www.scribd.com/doc/255992850...-United-States.

I think the federal government has appealed this decision to the 5th Circuit and they tried to get permission to keep issuing until there was a decision, but they lost that round, it's all ground to a halt until a final decision is issued by the 5th Circuit, and probably all the way to the US Supreme Court. So, I'm not sure why people would still be applying and getting it unless the Obama Administration is violating the Court Order of Judge Hanen. It wouldn't surprise me one bit if that's what Obama is doing but if he is and there's some proof of it it needs to be reported so the Judge can stop it.

I think we have illegal aliens working in USCIS. I really do. Someone should investigate that agency.

Travel for DACA Applicants (Advance Parole)

    WARNINGS!

    1. DACA applicants may not travel outside the United States until after their DACA request has been approved.

    2. DACA applicants or recipients who travel outside the U.S. without being granted approval for travel will lose their DACA status.

    3. You will be inspected at the border when you return, and there is always a possibility that youcould be denied entry, even if the government granted you permission to travel.

How can I travel after I receive DACA?
o DACA recipients can apply for permission to travel called “Advance Parole”
o Advance Parole is an application to USCIS to allow an immigrant to travel outside the United States and return lawfully.

Benefits: Ability to travel abroad and return Opportunities to study or work abroad and visit elderly or sick relatives

Disadvantages: Risky! Some DACA recipients could get stuck outside the U.S.

 Approved reasons for travel are limited
 Time for travel is limited
     Costs $360 to apply

    Who can apply?
o USCIS will only approve travel (“advance parole”) for DACA recipients who demonstrate that their need for travel is for “humanitarian, education, or employment” purposes.*

Humanitarian: For example: travel to obtain medical treatment, attend funeral services for a family member,or visit a sick or elderly relative.

Educational: For example: semester abroad programs or academic research

Employment: For example: overseas assignments, interviews, conferences, training, or meetings for work

If you have received DACA and wish to travel for one of these purposes, contact an immigration lawyer for more advice!*Immigrants with other status may be eligible for advance parole outside these restricted purposes.

They would use the same forms and follow generally the same process, but would not have to prove that their travel is for humanitarian, educational, or employment purposes.

    You are right.

The judge made clear that his ruling does not apply to the original Deferred Action for Childhood Arrivals, or DACA, program . . .
