    FBI asked to join Beauprez ad investigation

    DENVER - A criminal investigation of Bob Beauprez’s gubernatorial campaign snowballed Wednesday when state investigators asked the FBI to join a probe of how confidential information was obtained from a federal database.

    The Colorado Bureau of Investigation determined Wednesday that Beauprez’s campaign had used information in a campaign ad that had to have come from the National Crime Information Center. Under federal law, the only people who can legally access NCIC data are the criminals whose records are there, or members of Congress.

    Beauprez, whose campaign has refused to disclose the identity of a person it has referred to


    as an “informant,” is a Republican congressman from Colorado’s 7th District.

    CBI opened a file against Beauprez late last week, looking into allegations that his campaign illegally used a federal criminal database that is only supposed to be used for law enforcement purposes. It’s conceivable the investigation could result in a felony charge.

    Information from the database was the foundation for an ad attacking the record of Beauprez’s Democratic rival, Bill Ritter, a former Denver district attorney.

    “Because this is a federally controlled and regulated system, CBI has requested the assistance of the FBI to further pursue the investigation,” CBI Director Karl Wilmes said. “The FBI and CBI will be working jointly to complete the investigation.”

    Beauprez has denied any wrongdoing, and campaign spokesman John Marshall reiterated that Wednesday.

    “We are going to cooperate in every way with law enforcement on this, because we’ve done nothing wrong,” Marshall said.

    At a debate last week, Beauprez said the information was obtained from an informant. He said the campaign would demonstrate that the information was obtained legally.

    Marshall, however, would not reveal the name of the informant, saying he is protecting a confidential source.

    Ritter’s campaign asked for the investigation, which has derailed Beauprez’s damaging political attacks less than three weeks before the Nov. 7 election.

    “The congressman is now on day six of refusing to disclose his source, and, with each passing day, he digs himself a deeper and deeper hole,” said Evan Dreyer, Ritter’s spokesman. “He has asked voters to hold them accountable. Well, he can rest assured the FBI will hold him accountable.”

    The Beauprez ads highlighted 152 cases in which Ritter’s office offered plea agreements to immigrants — both legal and illegal — to help them avoid deportation.

    Last week, the campaign ran a potentially damaging television ad featuring Carlos Estrada Medina, who was arrested in Denver on drug charges but only received probation under a plea agreement. The ad claims Medina was later arrested in California for a sexual abuse of a child.

    Several media outlets investigated the ad and could not find any information about a California case involving Medina. Checks under his aliases also turned up nothing.

    But over the weekend, Marshall told 9NEWS, a Denver television station, that “in federal criminal databases, the guy’s information matches up.”

    The NCIC contains confidential law enforcement records about criminal histories, fugitives, stolen property, missing persons and other details. The records in the NCIC are only available for law enforcement purposes; it is a crime to access those records for almost any other reason.

    The law does, however, allow a member of Congress to access the database if a constituent requests his or her own record.

    Marshall insists that no one on the campaign accessed the NCIC and that all the information was obtained through the public domain.

    “If anyone had done that on our campaign they would have been fired,” he said. “We received information we believed to be credible and lawful and verified it through means we believed to be lawful.”

    But, according to the CBI, the NCIC was the source of the information.

    “The CBI thoroughly reviewed and researched the law enforcement databases and determined that the information regarding ... Medina ... was obtained by accessing the federal crime information system known as NCIC,” Wilmes said.

    Wilmes would not say who accessed the system, something he said is part of the investigation, which he said will take time to complete.

    That’s bad news for Beauprez’s campaign.

    Colorado College political science professor Bob Loevy says he thinks that even if Beauprez is exonerated and found to have done nothing wrong, the damage may already be done.

    “It may get cleared up before the election gets here, but even then ... all that many voters hear is FBI investigation and Bob Beauprez,” Loevy said. “It is just a losing event for the Beauprez campaign. It also mutes what looks like their strongest issue against Ritter.”

    ICE agent identified in FBI investigation

    DENVER - The FBI has identified a man suspected of providing confidential information to the Bob Beauprez Republican campaign for Governor or Colorado.

    Our partners at The Denver Post confirm that Cory Voorhis, an Immigration and Customs Enforcement agent is under investigation.

    Voorhis is suspected of giving Beauprez's campaign information it used in an attack ad against Democratic challenger Bill Ritter.

    When questioned about the investigation Beauprez responded, "He came to us with information, and we confirmed that information through other sources all of which we believe to be completely legal. Now at the end of the day it's proven otherwise, so be it. But we certainly didn't ask. He came to us."

    The Denver Post also reports Beauprez would not confirm whether Voorhis provided the information. Beauprez did say the person was in law enforcement but he has never met nor spoken with the individual.

    The investigation by the CBI and FBI is centered on how the Beauprez campaign obtained the information used in the ad.

    The ad under question claims Bill Ritter plea bargained a case involving an illegal immigrant who later committed a crime under a different name.

    The information within the ad is confidential and is contained in the National Crime Information Center Database.

    It is illegal to obtain and use information from the database for any reason other than law enforcement.

    Denver Post political reporter Karen Crummy said if the Beauprez campaign continues to have to answers questions about the ad and the investigation, instead of focusing on the campaign, it could mean trouble on November 7.

    Crummy told 9NEWS, "With voters the only thing they're going to see is the controversy surrounding this investigation instead of hearing what Bob Beauprez has to say on the issues. Right now this investigation is only focusing on this agent. If it extends to the Beauprez campaign it could have bigger consequences."

    Voorhis is a registered Republican, but has no public association with the Beauprez campaign. He has not donated to either campaign.

    In regards to the attack ad, Bill Ritter has said he had to plea bargain the case in question because of problems with the evidence.

    Beauprez told 9NEWS he and his campaign are cooperating fully in this investigation.

    Ummm, shouldn't the focus be on how many Americans have been needlessly raped, robbed, and murdered due to government failures and not who told the truth to the public?

    It sounds as if Beauprez is being crucified for revealing the truth about Ritter. The truth hurts, doesn't Mr. "illegal immigrant friendly" Ritter! Hopefully the voting public will see Mr. Ritter for what he is and will vote accordingly.
