Federal grand jury indicts BP agent in fatal shooting

A federal grand jury indicted Border Patrol Agent Lonnie Swartz on a second-degree murder charge Wednesday afternoon.

The charge stems from an Oct. 10, 2012 incident in which Swartz fired through the border fence into Nogales, Sonora and fatally wounded 16-year-old Jose Antonio Elena Rodriguez.

Sean Chapman, who is representing Swartz in a civil lawsuit filed by the Elena Rodriguez family, said the U.S. Attorney’s Office informed him of the charge Wednesday afternoon.

Luis Parra, who represents the Elena Rodriguez family, said he also was informed by the U.S. Attorney’s Office of the charge.

Swartz will plead not guilty at the arraignment scheduled for Oct. 9, Chapman said.

"He will fight the charge," he said. "I expect this case will go to trial."

The U.S. Attorney’s Office did not immediately return a request for information.

If the current administartion would build the wall, this wouldn't have ever been an issue for the agent or Rodriquez. Mr. Rodriguez would still be roaming around in his home country and the agent would be having just another boaring day wondering why he's getting paid to stare at an impenatrable wall.

I say charge Obama with that young man's death. Remove and imprisson Obama and put Trump in office and build that wall to avoid future atrocities such as this.

The majority of Americans want a fence but what about the tunnels? .... And Obama? He's done more than enough to be arrested and put on trial, so why hasn't it happened yet?

Not discounting the fact that a lot of our Congressional seat warmers are either bought off or scared off, some political observers are starting to say that Congress fears a black backlash and and race riots. If that's the case then what that amounts to is knuckling under to a minority bully mentality. I say INDICT THAT FRAUDULENT MISCREANT on multiple counts of treason and violating his Oath Of Office and let come what may.

First, Americans don't want a fence. We want a wall. A "big beautiful wall". A wall with a deep footing. For argument's sake, let's say we build a wall and some tunnels are carved. This great wall will at least act as a filter to reduce the amount of illegal crossings. I've seen the pictures of 10's of 100's of people just scaling a loose fence. And pictures of them sliding through open cut holes. Tunnels are a little different. Somewhere on our side there has to be a vertical opening where crossing offenders can only emerge one or two at a time. Boarder agents need only to locate this hole, detain a few crossing and then back fill that hole and top it off with a little cement. How many labor intensive tunnels do you think they can really build? In addition, if laws are in place like e-verify and an inability to rent or mortgage a home without citizenship identification, how many would come here anyway? Ridding this country of invaders requires a multi-step policy. No benefits, no housing, no jobs, no driving and they won't come anyway. Add a sturdy wall and allow boarder agents to do their job and you at very least minimize the invasion. The WALL is worth the money, but ONLY if backed by the laws of the interior. I too would love to see Obama imprisoned immediately, but if it doesn't occur, I hope that his position is filled at the next election with someone who can stop and reverse this invasion.

Secondly, the race war is inevitable. South/Central Americans do not like white people. They do not like black people. They are intent to take this country as their own and rid themselves of all non-Spanish speaking, non-brown skinned people. Similarly, there is also an unknown percentage of blacks that want to rid this land of white and brown skinned people. "White America", which I believe encompasses any and all races of assimilation to "our" culture, will one day rise up with intolerance and defeat the true racists of this land. "We" will not be bullied for long. I would hope that the issue can be resolved peacefully and amicably to save millions of lives, but sometimes, as history has enlightened, a revolution is an evolutionary necessity. I truly appreciate that you are a patriot Tray!

I support a high fence with razerwire on top or a wall but,
Just so you'll know,
Most border tunnels start in a house or business building on one side and end in a house or business on the other side and are usually very well concealed. They are usually built where there are existing cities on both sides of the border right up to the fence. The cities were there long ago before anyone thought of a border fence or wall ever being needed.

Plus many miles of the Texas/Mexico border run right down the middle of the Rio Grande river making it very difficult to build a fence or wall on the border.

TUCSON, Ariz. — The trial of a U.S. Border Patrol agent accused in the fatal cross-border shooting of a Mexican teenager has been rescheduled for March 22.

Lonnie Swartz was indicted by a federal grand jury in September on one count of second-degree murder.

He's charged in the October 2012 death of 16-year-old Jose Antonio Elena Rodriguez.

Swartz is accused of firing through the border fence into Nogales, Sonora and striking Rodriguez about 10 times.

Swartz pleaded not guilty in October and his trial originally was scheduled to begin in November.

A new trial date was set Monday in U.S. District Court in Tucson.

Swartz is on administrative leave and allowed to remain free pending trial. But he was forced to surrender his Border Patrol pistol and can't travel outside Arizona and Nevada.
