Flake Introduces Criminal Alien Notification Act

Washington, D.C. – U.S. Sen. Jeff Flake (R-Ariz.) introduced the Criminal Alien Notification Act, legislation to improve communication between federal, state, tribal and local law enforcement, facilitating the rapid deportation of criminal aliens arrested for serious crimes.

Specifically, the legislation would establish a nationwide, two-way notification system between federal, state, tribal and local law enforcement that would enable:

1) Immigrations and Customs Enforcement (ICE) to alert state, tribal and local law enforcement when and where an illegal alien with a criminal record is being released from federal custody; and

2) State, tribal and local law enforcement to alert ICE when they are releasing an illegal alien who has been convicted of a deportable offense; and

3) State courts to alert ICE when a protective order is issued against an illegal alien under ICE supervision

The Criminal Alien Notification Act was introduced in response to the shooting death of 21-year-old QuikTrip clerk Grant Ronnebeck of Mesa, Ariz.

Accused shooter Apolinar Altamirano is an illegal alien with a felony conviction. Altamirano had been detained and then released by ICE – despite his criminal record and without notice to state or local law enforcement – pending the outcome of his deportation proceedings. After Altamirano’s release, two protective orders were filed against him by local law enforcement – without notification to ICE – before Ronnebeck was murdered.

“Undocumented aliens who commit serious crimes ought to be behind bars and first in line for deportation,” said Flake. “I’m pleased to introduce this bill to give federal, state and local law enforcement the tools and information necessary to identify those individuals and keep them off the streets.”

Background: Flake joined U.S. Sen. David Vitter to introduce the Stop Sanctuary Cities Act, legislation to withhold federal funding from sanctuary cities that fail to comply with detainer requests issued by the Department of Homeland Security (DHS). Flake also recently joined U.S. Sen. John McCain (R-Ariz.) to introduce the Criminal Alien Deportation Act, a bill that would require DHS officials to detain illegal aliens arrested or convicted of serious crimes and deport them within 90 days. Flake and U.S. Sen. Chuck Grassley (R-Iowa) recently uncovered the scope of the administration’s catch-and-release policy as a result of a February 2015 letter pressing the DHS for answers in the aftermath of Ronnebeck’s murder.
