TUCSON, Ariz. (AP) — A Mexican man detained for illegally re-entering the United States has been sentenced to nearly three years in prison in Tucson.

U.S. Customs and Border Protection apprehended 53-year-old Marcial Avilar-Perez in September for attempting to enter the U.S. illegally and he was sentenced to 33 months of confinement earlier this month for that crime.

While he was being held in Tucson, officials say they found that Avilar-Perez had been convicted in 1990 for lewd acts against a child under 14 in Riverside County, Calif.

Based on that conviction, authorities say Avilar-Perez will not be allowed to enter the legalization process.

Officials say he will be removed from the country following his 33-month sentence.
