    GOVERNORS CAN’T STOP OBAMA ON REFUGEES, BUT CONGRESS CAN

    More than half of America’s fifty governors—including a Democrat—refuse to accept President Obama’s Syrian refugees. Unfortunately for them, federal law allows the president to resettle as many refugees as he wants. But Congress can stop him.

    Barack Obama has said that he will continue his plan to bring in Syrian refugees. But 31 governors—including Gov. Maggie Wood Hassan, the Democrat who leads New Hampshire—have publicly declared that they will not allow Obama to settle refugees in their states.

    The governors are wrong, at least in part. Federal law, found at 8 U.S.C. § 1157(a)(1), authorizes any president to admit whatever number of refugees he believes “is justified by humanitarian concerns or is otherwise in the national interest.” The sections and subsection of the United States Code following that provision continue to lay out broad presidential powers, granting him all the authority he needs to bring in Syrian refugees.

    But governors command state offices that are an integral part of this refugee-resettlement process. Governors can order their state personnel not to lift a finger to help the Obama administration, or to spend a single dollar of state money on the project. Obama would have to assign federal agents to bring these refugees to America, fly them to their new state, drive them to their new house (which the federal government would have to obtain for them), and take care of the all the logistical and physical needs that normally state and local staffs would handle or assist.

    Obama can’t make the governors cooperate. In the 1997 case United States v. Printz, the Supreme Court declared that the Tenth Amendment’s limits on federal power include that no branch of the federal government—Congress, the Supreme Court, or the president—can require state or local officers to implement or assist any federal law or program. This anti-commandeering principle is a cornerstone of the constitutional system. The states are co-sovereigns with the federal government, equal in power and authority with Washington, D.C. The federal government has whatever powers the Constitution grants to it, with all other powers reserved to the states.

    But Congress can stop Obama. Congress has plenary power over immigration, including admitting refugees. Congress can change federal law at any time. Congress can also refuse to renew funding for Obama to resettle refugees and insert explicit language into annual appropriations laws forbidding the various agencies of the federal government from spending a single dollar of federal money or assigning a single federal agent to carry out Obama’s resettlement efforts.

    Obama wouldn’t even be able to drive the moving truck himself, because he wouldn’t be authorized to put fuel in the gas tank.

    So Obama has a number of things he can to at the moment to carry out his plan, but it is a plan that would take years to carry out. Governors can make him go it alone from Day One, and Congress can make sure that his program’s days are numbered.

    It's time every politician and every lawyer in the United States read the US Constitution. The federal government, all three branches, have no authority with regards to immigration except to prevent it. Article 1, Section 9. They also need to learn the meaning of the words immigration and naturalization, which are not the same, but two very different issues and functions. Naturalization is how non-citizens admitted by states, not prevented by the federal government, may become US citizens. Immigration is the admitting of immigrants or imported labor into the United States, which is not a power or authority of the federal government, not Congress, not the Executive Branch nor the federal court system. Immigration is a States Right, buffered by the federal constitutional power and authority after the year 1808 to PREVENT IT.

    If there was ever a time in our history for STATES to rise up and defend this nation from the perils of unauthorized unconstitutional immigration admissions by the federal government, it is now, and I am so thrilled to see 31 states do just that, and can only wonder where are the other 19. Our STATES must be unified on this issue. And to Governors, you think you want to be President? The most powerful position in the United States today is not the Presidency of the United States, it is to be one of 50 Governors representing the United States of America, because no one in the federal government has been doing that now for decades. And to members of the US Senate who mistakenly believe they're taking a step up in their careers to be President of the United States, you are part of the 100 second most powerful and important group in the United States, second only to the 50 Governors.

    It's time for all sitting Governors to leave the race for President, go home and do your jobs. It's time for all sitting Senators to leave the race for President and go to DC and do your jobs. It's time for former Doctors to leave the race for President and join some medical charity organization and do a job you were actually trained to do. It's time for a former CEO of HP who thought it was okay to sell printers to Iran through a third party to bypass US sanctions against Iran, to realize America will never knowingly elect such a scheming traitor to the American White House. It's time for everyone else to give Donald Trump the nod, get out of the race and let him wrap up this Republican nomination so he can get to work beating the Democrats in the General Election.

    This is a time in our nation when it's not about you, it's about US, the citizens of the United States, in immediate peril of both bankruptcy and war, the worst case scenario. It's time for all you wannabe mores to wanna fix our country with the positions and power you currently hold, in public offices to which you've already been elected and with which you've already been entrusted by the voters of your STATES.

    And yes, Governors can most certainly stop Obama. It's why States have National Guard units, and freely elected Sheriffs Departments, State Troopers, Municipal Police Departments, and of course Citizens exercising their Second Amendment Rights. Don't think for a minute that our States can defend themselves against wrongful unconstitutional acts by the federal government. Our founders were not so stupid as to believe that these moments of strife would not present themselves against a rogue federal government.

    And to the 19 States who aren't sure yet which butt to kiss, let me simplify it for you, either you're with US or you're against US. If you think hanging your hat on rack of this Presidency run wild or with federal unconstitutional acts, then that is of course your free choice, but that is a decision not in the best interest of your State or the citizens who reside in your State, so there will of course be dire consequences with such an horrendously poor choice.

    you can stop your boss but you will step on any toe is that it

    Chairman Goodlatte is correct in calling for a Moratorium, the others like McCaul are wrong.

    So why would they want to do this to us? All Congress has to do is pass a Moratorium and the problem is solved.
