    Hispanic Lawmkers Prepare Wish List on Deportations

    BY SUZANNE GAMBOAThe Congressional Hispanic Caucus wants the Department of Homeland Security to use “all legal means available” to slow deportation by deferring potential deportations of immigrants who would get legal status under an immigration bill approved by the Senate, among other things.

    The caucus approved a list of recommendations Thursday on what actions DHS Secretary Jeh Johnson could consider to carry out President Barack Obama’s directive to make sure immigration enforcement policies are being applied humanely.


    Caucus members are to meet with Johnson next Thursday with the memo that is more a list of proposals than demands. The meeting comes as pressure is mounting on Obama from within his base of supporters to use executive authority to halt deportations while waiting on the House to move on immigration reform.

    According to a draft of the memo, obtained by NBCNews.com, the recommendations of the caucus, all Democrats, include:

    _ Expand deportation deferrals to workers and families who would benefit from legalization measures in the Senate’s comprehensive immigration bill and are not security or public risks.
    _ Extend parole in place to more people. The administration extended this to family members of military personnel.
    _ Allow family who have been forced out of the country to return to the U.S. under humanitarian parole, which would allow them to pursue legal residence.
    _ Allow young immigrants with deportation deferrals, temporary protected status, asylum or refugee status to enlist in the military.

    The caucus also suggests DHS clarify the definition of extreme hardship that allows waivers of deportation; refine priority levels used to rank people for deportation; limit deportations without hearings and end programs known as 287(g) and Secure Commuinities that involve local officials in immigration enforcement.

    WASHINGTON -- The Congressional Hispanic Caucus sent a list of recommendations on how to suspend some deportations to Homeland Security Secretary Jeh Johnson on Thursday, part of a growing effort from the group of Democrats to pressure the administration not just to reform immigration law, but to stop the impact of current enforcement policies.

    Rep. Luis Gutierrez (D-Ill.) told reporters Friday that the memo of recommendations is a broad document that caucus members will discuss at a meeting with Johnson next Wednesday. Johnson is currently reviewing deportation policies at the request of President Barack Obama.

    "Our goal in the [CHC] is to save as many people as we can from the devastating effects of deportation and to put millions upon millions upon millions of people in a safe place," Gutierrez said on a call hosted by pro-reform group America's Voice.

    The memo goes on to list 11 suggestions to expand deferred action on deportations and change the enforcement programs that lead to a number of removals. The first is to expand the Deferred Action for Childhood Arrivals program -- which allows young undocumented immigrants who came to the U.S. as children to apply to stay and work legally for two years or more -- to people who would quality for legal status under the Senate bill. White House officials told The New York Times in March that DACA would not be expanded, but the Hispanic Caucus argues that extending the program to others would "keep families together."

    The Hispanic Caucus memo also recommends allowing help for undocumented immigrants who are married to U.S. citizens, parents of citizen children and immediate family members of DACA recipients. It also suggests allowing DACA, asylum and refugee status recipients to join the military if they otherwise quality.

    On enforcement, the memo recommends reforms such as reviewing priorities for removal and ending programs that lead to many deportations such as Secure Communities and the 287(g) policy.

    Gutierrez said the meeting next week will allow the Hispanic Caucus to share its recommendations with Johnson and, he hoped, begin to build consensus.

    "The important thing is that the conversation is happening," he said.

    Gutierrez: Obama Ready to Halt Deportations With Executive Orders

    The Congressional Hispanic Caucus has given the White House six pages of recommendations on how the Obama administration might proceed with executive orders to curb deportations of illegal immigrants.

    Rep. Luis V. Gutiérrez, D-Ill., a leading advocate for rewriting the nation’s immigration laws on Capitol Hill, told reporters during a conference call Friday that the CHC had “adopted a very strong memo” of suggestions the day before in advance of a scheduled meeting next Wednesday with Homeland Security Secretary Jeh Johnson.

    “It includes many, many of the prosecutorial discretion initiatives that we have presented to the president in the past,” Gutiérrez said. “Some of it isn’t new. Some parts of it are new. It’s very broad.”

    The Washington Post and a handful of other news outlets have already obtained and published draft versions of the suggestions, which show that the CHC wants the administration to use as a basis for further action its 2012 executive order deferring deportations of so-called DREAMers — young immigrants brought to the U.S. as children. The nickname is based on the stalled DREAM Act.

    Gutierrez also reiterated a message he delivered to House Republicans on the chamber floor earlier this week: If GOP leaders do not move on immigration overhaul legislation before the July 4 recess, expect Barack Obama to bypass Congress to curb the vast number of deportations that have occurred during his tenure as president.

    “If we don’t see a bill moving forward and concrete steps being taken … they can watch the president … pick up his pen,” Gutierrez said on the call. “It’s one or the other. I see it coming.”

    Republicans have already chafed considerably under Obama’s now-infamous “pen and phone” strategy, moving two bills next week aimed at stopping his “imperial presidency.”

    The CHC meeting with Johnson next week comes after the caucus was prepared a few weeks ago to adopt a strongly-worded resolution condemning the president for the deportations that have occurred under his watch. To avert the CHC taking that vote, Obama summoned Gutierrez, CHC Chairman Rubén Hinojosa, D-Texas, and Democratic Caucus Chairman Xavier Becerra of California to the White House and pledged to work with members to revisit his deportation policies.

    At the time, Becerra said he was confident in the president’s commitment to moving forward.

    “The president has made it clear: He is ready to take a look at how we continue to make this work better,” he told reporters. “He himself said, ‘You can tell folks that you talk to’ — meaning a lot of these families — ‘the heartbreak is felt here in the Oval Office.’”
