    This isn't about taking the 14th amendment before the supreme court, so there is nothing to interpet. This is about congress passing a new law. If it doesn't pass, nothing changes and we are still right where we are now.

    Who says that those that have hit the ground and running are constitutionally qualified as citizens?

    If a law is passed in Congress (what are the current chances?) then retroactively those that have been dropped on our soil in the past will be granted citizenship.

    If the states draw up laws and the Supreme Court has to decide, then would those that are here be citizens because we assumed they were? Or would we then have to decide what to do with them?

    My statements have been made on the assumption according to the Constitution that they are not citizens now or ever have been.

    I guess I might be a bit punchy, as I don't trust Congress for much. I should have waited for details.
