In Other News:
- The Board of Immigration Appeals held Oct. 30 that I-9s can be used as evidence in removal proceedings. The case involved an immigrant the government deemed inadmissible to the U.S. because he falsely claimed to be a U.S. citizen on two I-9 forms.
- A federal judge in the District of Columbia held Oct. 31 that the Department of Labor can proceed on its own timeline to publish regulations replacing current guidance on the wage and housing requirements for cattle, sheep and goat herders under the H-2A program. The expedited rulemaking timeline sought by the plaintiffs "would be short-sighted and end up extending, rather than expediting, the process," the court said.
- A federal judge in Missouri Oct. 24 upheld a decision from the Labor Department's Administrative Review Board awarding back pay to eight H-1B workers. The DOL was within its authority to investigate the entire company based on a complaint from a single H-1B worker, and could award remedies for violations against the eight workers even though all the claims in the original complaint were untimely, the court found.
