IL - Joliet Illegal Immigrant Guilty Of I&M Canal Rapes (update)

Miguel Luna, 37, of Joliet will be sentenced on July 16 by Will County Judge David Carlson.

By John Ferak, Patch Staff | May 16, 2018 5:58 pm ET | Updated May 17, 2018 12:45 pm ET

JOLIET, IL - A dangerous man who was living in Joliet illegally was escorted into Will County Courtroom 405 on Wednesday afternoon under the careful eye of Will County Sheriff's deputies assigned to courtroom security. Utilizing the services of a courtroom interpreter, Miguel Luna, now 37, pleaded guilty to aggravated criminal sexual assault for raping women on the I&M Canal path near Joliet. Judge David Carlson set sentencing for July 16. Luna lived in the 1400 block of Winifred Street in Joliet at the time of his crimes, according to the Will County State's Attorney's Office.

Luna has remained in the Will County jail since May 22, 2016. He is being held without any bail.

Will County State's Attorney spokesman Chuck Pelkie said Luna was accused of assaulting three women on the I&M trail, but charges in one of those case were dropped in exchange for his guilty plea. "The third victim, ... recently died, and the charges related to her case were dropped in exchange for his guilty plea in the other two cases," Pelkie said in a statement Thursday. "It is important to note that the investigation into the third victim's case is what led police to identify Luna as the attacker in all three sexual assaults."

According to prosecutors, Luna attacked his first victim on Sept. 6, 2015 between Brandon Road and Larkin Avenue. He jumped off a bike, tackled the woman from behind, dragged her into the woods, and tied her up. He raped his victim during the more than 90 minutes he held her captive, prosecutors said.

Then Luna struck again around 8 a.m. May 21, 2016. That victim was running along the Frontage Road near Interstate 55. That morning, Luna wore sunglasses, a ski mask, surgical gloves as he grabbed the woman from behind and put her into a choke hold, prosecutors say. Luna raped her under the I-55 viaduct.

Ultimately, Luna was captured as a result of a rape investigation involving a third woman. "The defendant, who also knew this woman's friend, tied up his victim and sexually assaulted her in a secluded area near Brandon Road. The victim's friend later identified Luna for police," prosecutors revealed Wednesday.

Luna's DNA also tied him to the first two rapes by the I&M path, according to prosecutors.

"Miguel Luna is in this country illegally. This ruthlessly violent sexual predator should never have had the opportunity to brutally prey upon these innocent young women," Will County State's Attorney James Glasgow said in Wednesday's statement announcing the guilty plea.

"He terrorized our community by repeatedly committing the most vicious sexual assaults against unsuspecting women in an historic area that people from throughout the region safely enjoy for recreation."

Glasgow praised Assistant State's Attorney Mary Fillipitch for obtaining the Joliet man's guilty plea.

Luna faces between 32 and 80 years in prison when he is sentenced two months from now.

Man gets 80 years in prison for beating, raping two women along trail near Joliet

A Will County judge sentenced a man who admitted beating and raping two women along the I&M Canal State Trail near Joliet to 80 years in prison Monday.

Judge David Carlson handed down the maximum sentence for Miguel C. Luna, 37, of Joliet. Luna is in the country illegally and was ordered deported by immigration authorities in 2012, Carlson said.

“You should not have been in this country,” Carlson told Luna. “The system let the victims down in this case.”

One of the women Luna admitted raping applauded when Carlson handed down the sentence.

Luna pleaded guilty in May to beating and sexually assaulting two women who were running on the trail near Rockdale and Channahon in 2015 and 2016. Luna confessed to raping a third woman who has since died. Prosecutors played in court a videotaped interview the third woman gave to investigators when Luna was arrested in May, 2016.

Prosecutors presented evidence that the early-morning attacks on women were premeditated. In a videotaped confession played in court, Luna admitted wearing surgical gloves, concealing his face and using a shirt to wipe blood off a victim’s arm to remove fingerprints.

“He did not want to be caught,” Assistant State’s Attorney Mary Fillipitch told Carlson when asking for the maximum sentence. “If anything, he’d become a more clever and crafty sexual predator if given the opportunity to do so.”

Luna faced 16 to 40 years on each of the two felony criminal sexual assault counts. Carlson ordered that Luna serve the sentences consecutively, serve at least 85 percent of the sentences and register as a sex offender if he is ever released from prison.

A Will County probation department officer on Monday resolved Carlson’s questions about Luna’s identity by explaining how the department corroborated various aliases Luna said he used.

Prior to being sentenced, Luna read to Carlson a statement in which he said he was traumatized by repeated childhood sexual abuse by family members.

“I realize now I needed professional help,” Luna said, adding that his family was poor. “I never had the means and now it’s too late because I’m facing a life sentence.”

Luna said he was “very sorry for the terrible things I’ve done” to the women he attacked.

“I realize I have destroyed their beautiful lives with my horrible actions,” he said.

Carlson said the “horrific” abuse that Luna said he suffered as a child does not excuse his actions as an adult.

“Nothing gives you the right to impart that hurt, that pain, that damage to anybody else,” Carlson said.

Carlson said he was disgusted by the “chilling” details of the attacks that each lasted about 90 minutes.

“The terror went on and on for these women,” Fillipitch said.

Carlson said he did not understand why Luna wasn’t deported in 2012 when U.S. Immigration and Customs Enforcement issued a fugitive warrant for his arrest.

“You were free to do these acts … whether through misguided political correctness or people who do not believe in laws or borders,” Carlson told Luna. “One thing I can do with the sentence is show that the laws we believe in here, maybe this won’t happen again, maybe that’s a little bit of closure.”

Hmmm, I know of a business near Joliet, in New Lenox, which is also in Will County, like Joliet, that employs a lot of illegals, who by the way, all live in Joliet. I wonder if I should shoot Judge Carlson an email to inform him of this company. I'm sure he would have enough pull to get ICE here in Chicago to get off their asses and do something about this business.

Would anyone know how I would go about in finding out Judge Carlson's contact info? Primarily his email address? I would really like to speak with him and give him some leads.

Oh yeah, I can also name one in Frankfort, which is also in Will County, although it's only a couple illegals. But I'm betting that Judge Carlson is pissed enough to do some serious house cleaning in Will County. And hopefully that will send a strong message to all the illegals in Cook County, as well as Lake County, in Indiana, that their time is coming.

Can anyone find out where this guy worked? If they employed him, they're probably employing more illegals. It would be great if this company was shamed for employing this guy as well as getting busted for employing any other illegals they may have working there.

Judge: Joliet Rapist Had ICE Deportation Order

The confessed rapist should have been deported in 2012, Judge Dave Carlson declared Friday.

By John Ferak, Patch Staff | Aug 17, 2018 8:11 pm ET | Updated Aug 17, 2018 10:09 pm ET

JOLIET, IL - In a dramatic turn of events in Will County Courtroom 405, Judge Dave Carlson abruptly announced on Friday afternoon he was not ready to sentence a Joliet man who gave the police a detailed confession to committing multiple rapes along the I&M Canal trail near Route 6. The judge was just minutes away from issuing the sentence for Joliet resident Miguel Luna when he announced that he was not really sure who the confessed rapist was. Carlson, sounding perturbed, called for a five-minute courtroom recess. When he returned to the bench, the judge announced that the sentencing was being postponed until 1:30 p.m. on Monday, Aug. 20.

Raising his voice at times, Carlson told his fourth-floor courtroom that the pre-sentence investigation for Luna indicated that the defendant should have been deported from the United States on March 1, 2012. Carlson also read into the courtroom record the ICE fugitive number for the man believed to be Luna, who is now 37.
The rapes committed by the defendant occurred in 2015 and 2016.

In preparation for sentencing, the probation department uncovered at least three known aliases that the confessed rapist has commonly used over the years, the judge revealed.
File Image via John Ferak/Joliet Patch EditorLuna has also been going by the names of Francisco Deluna,Pedro Flores and Enrique Zanchez, Carlson announced. The judge made this revelation just moments after the attorneys for the prosecution and the defendant were debating in court whether the defendant's name of Miguel C. Luna was really perhaps Miguel Luna Castaneda.

SubscribeOn Friday, the prosecution and the defense lawyer were trying to sort out whether Castaneda was his real last name and whether Luna might be his middle name. No one in the courtroom seemed to know.
"We are going to find out who this person is who pled guilty to these offenses," Carlson told everyone. "I just want to find out who the gentleman is sitting to your right," he told defense attorney Marzell Richardson of the Mitchell Law Group. The defendant was seated in the courtroom Friday afternoon wearing a red Will County jail jumpsuit, flanked by his lawyer and a Spanish speaking interpreter.

Between 2 and 3 p.m., Will County prosecutors played several excerpts from a long videotape interview where Luna gave a detailed confession to one of his rapes on the I&M Canal trail. The crime occurred near Route 6 and Brandon Road, just outside Joliet.
When Luna attacked his first victim on Sept. 6, 2015, he jumped off a bike, tackled the woman from behind, dragged her into the woods and tied her up.

The videotape showed Luna talking in English with the Illinois State Police about how he was constantly being tempted by the forces of evil. He told the police that he knew from reading the Bible that his actions were sinful and displeasing to God.

He told the investigators how he rode his bicycle to the I&M trail, and that when he came upon a hill, he saw an attractive young woman in "sexy short shorts" out for a jog.

"I don't want to defend myself," Luna told the two veteran investigators, a man and a woman who were questioning him back in 2016. "I just want to make justice in this case. But, yeah, she was running down the hill. I was just pedaling my bike, and once I saw (sic) I stopped. I let things came into my mind.

"I saw her, and she was wearing those sexy shorts; you understand?" Luna asked the male detective.

Luna told the investigators that the demons and demonic forces were tempting him and tempting him.

He started racing on his bicycle, faster and faster, toward the young woman. She was a college student and a stranger.

"I jumped off (the) bike and tackled her," Luna told the detectives. "I told her to shut up ... I punched her. I told her to shut up, and she was trying to scream. I punch (sic) her one time in face, and she stopped."

Terrified, the woman being attacked kept asking Luna whether he intended to kill her. He was wearing dark sunglasses to conceal his identity.

"I told her, I'm not going to kill you, but I have a knife, and if you do something wrong ... I wanted to scare her."

He told the State Police that the sexual assault lasted about an hour, and took place in a wooded area near the trail.

"When I started doing the bad things to her, I started to feel the pain" in my arm, he told the police.

When the police asked him why the rape lasted an hour, Luna explained that "since I got to this country, they didn't let me do as much as I wanted," referring to the women he had met and pursued romantically.

As for the young woman he raped along the canal trail, "I was not trying to hurt her," he told the police.

"You just wanted to have sex with her?" one of the investigators asked.

    "Yeah," Luna agreed.

Luna told the police that he hid his still-tied-up victim's clothes over near a tree about 10 to 15 feet away from the attack. He wanted to give himself more time to make a safe getaway. After riding his bicycle back toward Route 6 and Brandon Road, he told the police he then saw another young woman out jogging alone.

"I saw another girl, she was heading to Route 6. She was hotter ... I say, 'I don't have to do this.' A lot of things went through my mind."

After he finished with his confession, the female investigator from the Illinois State Police calmly asked him, "Is there anything else you want to tell us, Miguel?"

He paused for at least 15 seconds.

Then he said, "I want to say that I deserve the time that you guys, that you're going to put me in jail ... I know I've done many wrong things ... I'm going to ask God for forgiveness. I hope he forgives me after what I did to this girl."
Luna faces between 32 and 80 years in prison, when he is sentenced on Monday afternoon.

Back in May, Will County State's Attorney James Glasgow issued a press release announcing that Luna had pleaded guilty to the violent rapes in the Joliet area.
"Miguel Luna is in this country illegally. This ruthlessly violent sexual predator should never have had the opportunity to brutally prey upon these innocent young women," Glasgow declared.
Prosecutors say that Luna committed a total of three rapes, but under his plea agreement in May, the charges in his third rape case were dropped. The victim of that crime had recently died, officials said.
