    A man is accused of driving drunk in a vehicle crash that seriously injured a pastor and his daughter.

    The Monroe County Sheriff's Office says 29-year-old Efrain G Lopez-Contreras is charged with driving while intoxicated and vehicular assault.

    Investigators tell News10NBC Lopez-Contreras crossed the center line and struck a SUV head-on Thursday night. The SUV caught fire in the crash and the victims were pulled out by good Samaritans. We're told Lopez-Contreras attempted to leave the scene of the crash.

    Deputies say Lopez-Contreras is an illegal alien who was previously deported. We're told U.S. Immigration and Customs Enforcement officials will be placing a detainer on him. He is being held in Monroe County Jail at this time.

    Investigators say the victims in the crash are Tony A. Bartolucci and his daughter Gianna. Family members tell News10NBC Bartolucci is a pastor at Clarkson Community Church.

    According to deputies, both Bartolucci and his daughter were unconscious as they were pulled from the vehicle. They were transported to Strong Memorial Hospital with serious injuries. Hospital officials say both are in guarded condition Friday evening.

    In an emailed statement, Cpl. John Helfer of the sheriff's department said, "Our prayers are with the Bartolucci family during this time."

    Friday, we heard from the pastor's family, who is still in shock.

    Father Al Bartolucci says, "You read in the paper all the time about this but until it hits you. All we did was cry last night."

    Their family is thankful to everyone who saved the Bartoluccis. Last night, when neighbors heard a loud crash and saw the SUV on fire, they immediately ran out to help.

    "First, we saw a man in there," Vitaliy Basisti said. "And we had to go to the driver side, pulled him out by his legs. And then there was a girl in the passenger side. And then we tried to pull her out; she was trapped. Her seatbelt was on so I asked for a knife, cut it open. We had to rip the door open and get her out of there as fast as we could."

    We went back to the scene Friday morning. Tracy Brugger tells News10NBC she's still thankful her and her neighbor's families were at home on Christmas Eve. The Basistis and Bruggers worked together to help save the victims.

    "It took about four people to get the pastor out of the car," says Brugger. "It was definitely a group effort. If we hadn't been there I'm not sure if the outcome would've been the same."

    Diana Basisti told News10NBC while everyone was busy getting the victims out of the car, Lopez-Contreras tried to walk away.

    Diana Basisti says, "My brother saw him. He was mumbling something and then he started fleeing the scene. He was caught later on."

    Nina Porciuncula: "Are you mad at him?"

    Al Bartolucci: "No. We love him because Jesus told us to love everyone."

    Local Politician on Illegal Aliens in Rochester Area

    The car crash that happened on Redman Road Thursday night has spurred quite the conversation about illegal aliens in the Rochester area. This is a result of news that the person believed to have been responsible for the accident, 29-year-old Efrain Lopez-Contreras, was an illegal alien.

    News10NBC’s Chris Horvatits spoke with Assemblyman Bill Nojay, who represents Livingston County as well as parts of Monroe County and Steuben County, about this issue Friday night to see how it is viewed by the local government.

    Chris: According to the sheriff's office, here we have a guy who is an illegal alien, who was once deported, and found his way back in. Does that surprise you?

    Assemblyman Bill Nojay: No.

    Nojay told Chris that he knows that his district is full of illegal aliens, just like Efrain Lopez-Contreras.

    Nojay: Increasingly, they're flowing out to our smaller cities like Rochester and Buffalo and Syracuse and to our rural areas. There's a great demand for our workforce on our farms…[...]...Illegal immigrants go where they think there are opportunities and where they think the enforcement is less rigorous.

    Chris: And these opportunities you're talking about exist in, for instance, your district. Livingston county, let's say?

    Nojay: Absolutely. Oh yeah.

    Chris: And why don't upstate representatives in rural districts like yours, why don't we see them, why don't we see you take stands on issues like this?

    Nojay: A lot of us have taken stands. Here's the problem. A lot of our rural areas employ a lot of illegal immigrants. They're working in agriculture. They're working in landscaping. They're working in different industries.

    Chris: Employers in your district need them to be upstate...

    Nojay: New York State agriculture needs these workers.

    It is important to note that immigration is, as a whole, a federal issue that has become a big topic surrounding the upcoming Presidential Election.

    We did try to reach out to the Office of Majority Leader Assemblyman Joe Morelle to get a response from a Democrat on Assemblyman Nojay’s comments, but because it was Christmas Day nobody was able to respond.

    Just days after Speaker Paul Ryan said he did not want to ‘clog jails’ with previously deported drunk driving illegal aliens, 14 year-old Gianna Bartolucci, died Saturday from brain injuries caused by a twice deported drunk driving illegal alien in a head-on crash last Christmas Eve in Clarkson, New York, according to a statement by her parents posted to their church website.

    …”Point three: what we have to figure out is how do we write Kate’s Law so that we’re not clogging up our jails so much for, say, DUI, but for the true violent criminals? … We need to get the details right so that we actually are going after the people that are doing this. … Trust me, you know we’re frustrated about this.”



    Bartolucci was riding with her father, Pastor Tony Bartolucci, to buy a Christmas tree around 6:00 p.m. when a car driven by Efrain Lopez-Contreras crossed over and collided head on with the Bartolucci’s vehicle.

    The father and daughter were seriously injured and were rescued by good Samaritans. Lopez-Contreras walked away from the crash but was found by deputies hiding in a ditch after the rescuers tried to prevent him from leaving.

    Gianna Bartolucci died from complications following surgery to replace part of her skull last week. Her father was released from the hospital on Feb 2 whilst Gianna was transferred to a brain injury rehabilitation unit that same month.

    Lopez-Contreras is being held on bond by local authorities. ICE has placed a detainer on him in case he makes bail according to the Rochester Democrat and Chronicle.

    "Lopez-Contreras, who is in this country illegally, was originally charged with first-degree vehicular assault and driving while intoxicated. He was remanded to Monroe County Jail in lieu of $100,000 cash bail or $200,000 bond. He is still being held there.

    He was indicted by a Monroe County grand jury in January of the following charges on more charges: including six counts of aggravated vehicular assault; two counts of second-degree assault; six counts of first-degree vehicular assault.

    The Sheriff’s Office said he previously had been deported, and he would be detained by U.S. Immigration and Customs Enforcement. It’s unclear if he will face any new charges after Giana Bartolucci’s death.”

    The Batavia Daily News reported Lopez-Contreras had a previous arrest for drunk driving at high speeds and had been previously deported two times but kept returning to Batavia, a town nearby Clarkson.

    Efrain Lopez-Contreras should not have been driving the car that slammed into a pastor and his daughter who were on their way to get a tree Christmas Eve night in Clarkson.

    Not only was he drunk but Lopez-Contreras, who apparently had been living at a residence on Elm Street in Batavia, had twice been deported.

    And both times somehow managed to find his way back to Batavia.

    “You have got to be kidding me,” Orleans County Sheriff’s Deputy David Foeller said. “He got deported after I arrested him.”

    Foeller was aware of the Christmas Eve tragedy in Clarkson. But he wasn’t aware that the illegal alien now jailed in Monroe County was the same man he had arrested five years ago.

    Foeller was on patrol on Route 31A in Barre one night in July 2010 when a car traveling west passed him at more than 80 mph.

    Foeller turned and gave chase.

    …Lopez-Contreras was arrested and charged with DWI, reckless endangerment and numerous traffic charges.
    At the time, police had a warrant for his arrest and he was a known illegal alien.

    Foeller said he had a girlfriend in Batavia at the time.

    Lopez-Contreras was eventually deported, the second time he had been dispatched from the country.

    When and how he returned is a mystery and, chances are, he likely will be deported again.

    An archived report by WHEC-TV stated Lopez-Contreras received 21 charges in the 2010 incident in Orleans County.

    “According to documents obtained from the Orleans County Sheriff’s Office. Lopez-Contreras was arrested in 2010 and charged with 21 traffic violations. The arrest report states the Mexican national was driving at speeds in excess of 100 miles an hour and driving drunk.”

    I don't know how the families of these loved ones killed by illegal aliens ever get through this. How do you ever get through the plain simple truth that the government is allowing dangerous illegal aliens into our country who day after day steal the jobs, the wages, the earnings, the benefits, the educations, the health care of all Americans and who go far beyond that and steal the life of a loved one, through a murder, a rape, a homicide? All at the hands of people our government is supposed to keep out of the country, people who aren't even supposed to be in our country to begin with?

    How do you ever get through that? I admire the families so much, the strength they show every day, I would not have it, I would collapse and be a basket case. Yet, these wonderful Americans find the strength from deep within them to help US fight to stop the illegal immigration travesty destroying our nation.

    These are amazing people and my heart breaks every day for their terrible loss.

    Lopez-Contreras pleads guilty in connection with Christmas Eve crash

    Rochester, N.Y. – A man charged in connection with a deadly Christmas Eve crash in 2015 has pleaded guilty to aggravated vehicular homicide, manslaughter, assault and aggravated driving while intoxicated.

    Efrain Lopez-Contreras, 30, faces a minimum of six years and a maximum of 18 years for the aggravated vehicular homicide charge. Sentences for the remaining charges will run concurrently.

    Prosecutors said the defendant also has a federal immigration detainer and will likely be deported to Mexico after his sentence expires.

    On December 24, 2015, Lopez-Contreras hit a vehicle head-on on Redman Road in Clarkson after crossing the double-yellow line. The vehicle he struck was carrying Tony Bartolucci and his daughter, Gianna Bartolucci, 14. The two were traveling to pick up their family Christmas tree.

    Gianna Bartolucci later died from her injuries.

    “Our office extends our deepest sympathy to the victims and their family,” said Assistant District Attorney Raymond Benitez. “A simple family tradition of picking up a Christmas tree on Christmas Eve became a nightmare that should never have occurred…We thank the Bartolucci family and the Monroe County Sheriff’s Office for their full cooperation throughout the investigation and prosecution.”

    Illegal immigrant sentenced in in teen’s death; had been deported twice

    ROCHESTER — An illegal immigrant from Mexico who was deported six years ago after an arrest in Orleans County was sentenced to state prison for a DWI crash that killed Hamlin teenager on Christmas Eve, 2015.

    Efrain Lopez-Contreras, 31, was sentenced to six to 18 years in state prison and will be deported again after serving his time, a Monroe County judge ruled Tuesday.

    Lopez-Contreras pleaded guilty in December to aggravated vehicular homicide, manslaughter, assault and aggravated DWI.

    He was driving on Redman Road in Clarkson on Dec. 24, 2015 when his SUV slammed into another SUV head-on. The crash seriously injured Tony Bartolucci, an elder pastor at Clarkson Community Church, and his daughter, Giana, 14. Giana died in June 2016 as a result of her injuries, leading to more serious charges against Lopez-Contreras.

    In an article in The Daily News in January 2016, an Orleans County deputy recounted his arrest of Lopez-Contreras in 2010. Lopez-Contreras was living with his girlfriend in Batavia at the time.

    Lopez-Contreras was charged with DWI, reckless endangerment and other charges after leading the deputy on a chase. He was deported in 2011, the second time he had been deported, but somehow found his way back to the United States.
