CEDAR RAPIDS | An illegal alien living in Hampton who assumed the identity of a U.S. citizen was sentenced Tuesday to more than four years in federal prison.

Abel Hernandez-Labra, 44, illegally obtained a U.,S. passport and voted in the 2012 presidential election. He pleaded guilty in November 2014 to one count of making false statements in a passport application, one count of aggravated identity theft, one count of making a false claim of U.S. citizenship to register to vote and one count of harboring an illegal alien.

In a plea agreement, Hernandez-Labra admitted he was a Mexican citizen who illegally entered the United States. He purchased a birth certificate and Social Security number of an American citizen born in Puerto Rico and assumed that identity. Falsely claiming to be a U.S. citizen, he used those documents to obtain Iowa driver's licenses which he in turn used to apply for and fraudulently obtain a U.S. passport in 2008 and to unlawfully register and vote in the 2012 federal election.

Hernandez-Labra also admitted harboring and encouraging an illegal alien to reside unlawfully in the Untied States by providing a job and home and by not reporting the illegal individual to immigration authorities.

He was sentenced to 51 months in prison and fined $5,000. There is no parole in the federal prison system. Hernandez-Labra must also serve also serve a three-year term of supervised release.

He is in the custody of the United States Marshal until he can be transported to a federal prison.

Oh, wow, they finally caught one.

Why did he bother to risk voting illegally, when they already do everything his way and for him without his vote? What more could he expect?

Oh wow, this is the first time in my life I have ever seen a clear conviction of A. someone aiding an illegal alien and B. an illegal voting in elections!

Clearly an Obama voter of 2012!

BAM! I'll have to store this information away for the next time some flaming liberal tells me there is no proof that illegals vote.

Now, why was this individual given a three-year supervised release? Why do judges do that instead of just issuing an order for deportation to be served once the sentence is complete?

Good questions, MW. Maybe someone can answer them. Is it because immigration court judges have to do the deportation order instead of regular federal court judges and ICE hasn't taken him to an immigration court yet? Hard to understand how they can convict him of being an illegal alien doing other bad acts without first determining he was an illegal alien and subject to deportation. The answer is probably that he qualifies for amnesty and they want to keep him here. That's how crazy this whole fiasco has become.

Finally but I'm not impressed by one prosecution. There are worse crimes, IMO, to concentrate enforcement on. Illegal entry, DUI by illegals and Americans, rapes, robberies, murders. Deportation would take care of most of it, and deportation is the law of the land. These other arguments only serve to detract from getting deportation done. and I am damned tired of Americans getting distracted. It is simple, git'er done!


The distractions serve to build negotiation poker chips in how many amnesties can they win in the end. America, get back to the issue The issue is illegal is illegal and aliens in America is illegal! Has America ever heard of keep it simple?????
