Thread: Illegal Immigrants Sue, Seeking Lower Tuition In Missouri

Three illegal immigrants, shielded from deportation by President Obama’s Deferred Action for Childhood Arrivals program, are suing three Missouri colleges, charging the schools’ tuition is too high.

The Missouri branch of the American Civil Liberties Union filed three separate suits on behalf of the unnamed illegal immigrant students against the University of Missouri, St. Louis Community College and the Metropolitan Community College in Kansas City this week calling for the students to receive in-state tuition rates.

“It is shameful to treat DACA students like outcasts, when they have lived, worked and gone to schools in this country since they were children,” Tony Rothert, legal director of the ACLU of Missouri, said in a statement.

At issue is the preamble to an education appropriations bill Missouri Gov. Jay Nixon signed this year.

The preamble to the legislation states:

[T]hat no funds shall be expended at public institutions of higher education that offer a tuition rate to any student with an unlawful immigration status in the United States that is less than the tuition rate charged to international students, and further provided that no scholarship funds shall be expended on behalf of students with an unlawful immigration status in the United States.

The ACLU argues that the students are being charged higher tuition rates due to the preamble, however, the group claims, the preamble is not enforceable, non-binding, and should not apply to their illegal immigrant clients.

“It is a well-established rule of statutory interpretation that preambles to statutes do not create substantive law,” the lawsuits state. “When statutes are ambiguous, preambles can be used to interpret statutory enactments but, on their own, preambles are not binding statutory authority. ”

Regardless of the interpretation, the ACLU says public colleges and universities should be welcoming to those willing to work hard.

“Our Missouri public institutions of higher learning exist to open the doors of opportunity to hard-working students striving to get ahead. Now, there are extreme financial burdens being put on the backs of students already struggling to achieve their goals of higher education,” Jeffrey A. Mittman, the group’s executive director, added. “To punish students who had no say in how they arrived in this country is not only mean-spirited, it is against the law.”

No, our institutions of higher leaning exist in this country funded by US taxpayers funding them whether through direct funding, federal funding, donations or tuition paid for with taxpayer guaranteed student loans and financial aid, to educate American Citizens and Legal Residents. When illegal aliens take a seat, that means an American Kid didn't get one. THAT is what is against the law. It doesn't matter whether an illegal alien came here on their own or were hauled in by their parents, carted in by a smuggler, or flew in on a Magic Carpet, they're not entitled to be in our colleges or universities because they aren't entitled to be in our country.

These illegal aliens need to be deported as our current federal laws say they should. Is there not a way American citizens can sue to have the federal laws enforced?

And how can we sue to have the federal laws that states what the ACLU is doing in this case is a felony enforced? It is a felony for anyone to encourage illegal immigrants to enter or remain in the US unlawfully and that law should clearly apply to these ACLU operatives.

EVERY SEAT THEY TAKE MEANS AN AMERICAN KID DIDN'T GET TO GO TO COLLEGE!

Every American needs to be outraged about this, not one Real American would EVER support such a scheme as illegal aliens attending our colleges and universities, let alone doing so at the same rates let alone on scholarships and financial aid which is either funded directly by government or exempted from income taxes through these rotten 501 C 3 tax fraud "charities".

It is despicable. Any college official involved in anyway with assisting illegal aliens to scam Americans out of their educations needs to be locked up in a detention center with the illegal aliens they were aiding and abetting. Load 'em all up, on one bus, together, and haul them off to jail. Same with the churches. Same with the 501 C 3 tax fraud "charities". They are conspiring to violate our law, they are aiding and abetting criminals, they are cheating and robbing Americans, they are running up our debt, scamming our welfare system, stealing jobs and opportunities from American Workers, and in their spare time, killing and harming Americans, and they are doing this every single day of the year, somewhere to someone.

It has to stop and the people responsible severely punished.
