    Immigrations Activists Mull Court Challenge to New Arizona Law

    Activists and lawyers are pondering a legal challenge to Proposition 300, a measure approved last week by Arizona voters that makes undocumented immigrants pay out-of-state tuition at public universities and community colleges.

    Miguel Zarate, a member of the Chicano student organization MECHA at Arizona State University, said he will meet with attorneys this week to determine what possibilities they have of asking the courts to hold up implementation of the law while its legality is being challenged.

    Last Tuesday Arizona voters approved Proposition 300 by a landslide with somewhat more than 70 percent voting in favor.

    The measure, set to go into effect Jan. 1, will oblige all students lacking social-security numbers to pay more expensive out-of-state tuition at Arizona's public universities and community colleges.

    Proposition 300 builds on Proposition 200, which was approved by voters in 2004 and refuses undocumented immigrants access to any public services financed by the state.

    The regulation denies aid to undocumented immigrants for the care of minors even when these children are United States citizens, and bars illegal aliens from educational programs and English classes.

    Arizona state legislator and attorney Ben Miranda acknowledged that a legal process against Proposition 300 "will be extremely difficult."

    He said that those who supported and prepared the bill "did their work very well," taking care with the language so that it cannot be challenged on constitutional grounds.

    The only thing we can do is try to keep it from going into effect, and postponing its implementation for at least four to eight months while we wait for the possible approval of an immigration reform at the federal level," Miranda told EFE.

    The dream of millions of undocumented immigrants who live and work in the United States could come true now that the Democratic Party has taken back control of the House of Representatives and the Senate.

    "The Democratic Party has shown greater interest in approving immigration reform that includes some way of normalizing the immigration status of those without immigration documents," John Garcia said.

    In spite of this, he said, the immigrant community should be very cautious because during the Arizona elections, no Democratic candidate spoke out openly in favor of immigration reform.

    "Another aspect we have to remember is the disposition of U.S. President George W. Bush to sign any accord that contemplates legalizing the undocumented, since we have to remember that his party was hit hard in these elections and won't want to put the presidency at risk for 2008," Garcia said.

    Meanwhile Carlos Garcia, leader of the student movement in Arizona, said that students won't just stand around but will continue the struggle.

    Last week about 60 youths showed up at the Phoenix office of Sen. John McCain to ask his support for the bill known to its proponents as the "Dream Act," which seeks to normalize the immigration status of thousands of undocumented students in the United States.

    McCain is one of a handful of prominent Republicans favoring a guest-worker program and other immigrant-friendly measures.

    Well, that's a relief.....if the Bushites don't shoot everything down and flush this country with one stroke.
