    The real outcome of proposition 187 very well could have been different If the appeal were allowed to make It to the Supreme Court. When Grey Davis took office he dropped the appeal. Imagine that,a Democrat dropping an appeal of a law that could very well cost their party millions of votes In the future... TS
    Davis didn't want the state to have to pay the cost of taking it thru the courts, and he didn't want it to be found legal.

    No matter what the first judge rules on the Arizona law, the loosing side will refile in another court the next day, state, federal and then Supreme Court. And someone has to pay for the lawyers and courts every step of the way.

    "The California Federal District court eventually ruled that Proposition 187, along with its 834b provision, was unconstitutional. The reasoning behind the ruling was the law was preempted by federal law. While 834b remains in the California Penal code to this day, it is not enforceable.

    However, subsequent to 834 b, Federal immigration 8 USC 1373 was passed. This law gives local police the discretion to communicate with ICE to check someone's immigration status."
