    Lawsuit filed in fatal Labor Day van crash

    The family of a teenage girl who died in a Labor Day van crash while going home from a job at Cog Hill Golf and Country Club is suing the organizer of the BMW Championship tournament and two companies, holding them responsible for her death.

    Elizabeth Soriano, 17, died in her mother's arms after the Ford van carrying them and 12 other, mostly immigrant workers home to Chicago's Little Village neighborhood had a mechanical failure and crashed on Interstate 55. Fernando Hernandez, 27, also died in the crash, which Illinois State Police said was caused by a faulty wheel and/or brakes.

    Four of the 14 workers, including the driver, Karina Salgado, face deportation for being in the country illegally, but immigration rights activists criticized the tournament organizers for not doing enough to acknowledge the deaths of Soriano and Hernandez, who were legal residents.


    The spokesman for the Western Golf Association, which organized the tournament as part of the inaugural $10 million FedEx Cup, said two days after the tragedy that the workers had "nothing to do with" the WGA. He said they worked for Waste Management, picking up trash at the golf course.

    But Waste Management said the workers were employed by a Joliet company, Barton Staffing Services, whose officials declined to say how they had hired the crew.

    On Thursday, Soriano's parents and sister sued all three organizations and the owner of the van, Rosa Michel, in Cook County Circuit Court, seeking unspecified damages in excess of $50,000.

    "You cannot hire a contractor and say (you) don't care how much you pay your staff or what conditions you allow them to work under and then say you have no responsibility when they die as a result of being transported to work in an unsafe vehicle," the family's attorney, Patrick Salvi, said.

    "These workers were wearing caps and shirts with Waste Management logos on while they were working," Salvi said. "... The workers were the agents of the WGA, even if they were not direct employees. Under Illinois law, the ultimate employer is responsible for ensuring that the worker is transported safely to the work site."

    Soriano was a junior at Farragut High School in Chicago, where she was on the swim team, was a dancer and worked part time as a retail cashier, he said. She was born in Chicago and was a U.S. citizen.

    Representatives of the defendants in the lawsuit could not be reached Friday for comment.

    Probably. Aurora, Joliet, Chicago are filled with illegal aliens and their anchor babies. I always read between the lines when it comes to articles about illegal aliens. Notice that they either give the first name or no names at all of the parents.

    It will be interesting to see the outcome of this "case". My guess is that Waste Management will settle quietly and the family will live happily ever after IN OUR COUNTRY.
