A Mexican national convicted of raping a young girl in Nassau County in 2008 was arrested on Tuesday trying to illegally enter the country.

US Customs and Border Patrol agents in Arizona said they apprehended 42-year-old Juan Olarte-Cruz around 11 p.m. on Dec. 10 south of Sells, Arizona — a small town about 20 miles north of the Mexican border.

Olarte-Cruze had been convicted of second-degree rape of a minor in Nassau in 2008. He was living in Westbury at the time, which is where the assault occurred. He was sentenced to three years in prison before being deported back to Mexico in 2010.

Officials say that Olarte-Cruze now faces federal prosecution for violating immigration law.
