FL - Bill would allow children of illegal immigrants to pay lower tuition

A bill filed Tuesday in the Legislature would prohibit public colleges and universities in Florida from denying lower tuition to state residents based solely on their parents' "citizenship" status.

Florida schools charge lower, in-state tuition to legal residents of the state and their children. Others, including U.S. citizens who live in Florida but are the dependents of parents who are illegal immigrants, must pay out-of-state tuition, which is about three times higher.

A federal judge recently ruled that it is unconstitutional to deny in-state tuition to U.S. citizens who live in Florida.

It is unclear whether state legislative action is needed, however. The judge already has ordered colleges and universities to stop the practice beginning with the spring 2013 semester.
