    N.J. - Judge: Illegal alien will stand trial for rape

    TRENTON — A judge refused to toss out the indictment and set a trial date Thursday for the illegal alien charged with raping a mother of three he snatched off a Princeton bike path in 2005.

    Mercer Superior Court Judge Mark Fleming said he found no problems with the sex-assault and kidnapping indictments of Humberto Gonzalez, who was a juvenile when he allegedly attacked the 53-year-old woman taking a walk along Guyot Avenue the night of May 22, 2005.

    Fleming said the trial of Gonzalez, now 27 and a resident of the Mercer jail, will start with jury selection on April 22. With a few work days off in between, the trial is expected to take until at least May 9.

    Assistant Mercer Prosecutor Robin Scheiner said Gonzalez was arrested in 2011, six years after the crime as the result of a DNA match from a crime in the year 2010.

    The prosecutor and Assistant Public Defender Malaeika Montgomery both expect to present DNA experts who will challenge the other’s findings.

    Both sides agreed that Gonzalez’s status as an undocumented immigrant, and his arrests in four other states, will not come out at the trial. Nor will either side bring out the traumatizing near rape the woman lived through 40 years ago in California.

    The suspect appeared in court Thursday in an orange prison jumpsuit and required two Spanish interpreters to take turns repeating every word to him during the three-hour hearing.

    The rape put Princeton on edge for years afterward, especially among those who walked the trails though woods near quiet Guyot.

    Gonzalez is accused of snatching the woman decades his senior as she walked along alone at 11:30 that night. He allegedly dragged her through a patch of woods into a playground, where he took off her glasses and raped her three separate times on the sliding board.

    The judge ruled she was held long enough for Gonzalez to be charged with kidnapping also.
