LAS CRUCES - A Mexican national was sentenced to 39 months in prison Tuesday in federal court in Albuquerque for re-entering the country illegally, the U.S. Attorney's Office announced Tuesday.

Nicolas Olivas-Garcia, 45, will be deported after completing his prison sentence.

Olivas-Garcia was arrested June 12 after Immigration and Customs Enforcement agents interviewed him in Do a Ana County and determined that he was in the country illegally. He has been in federal custody since then.

Olivas-Garcia had been deported from the United States in 1998 after being convicted of transporting illegal aliens in Las Cruces.

The case was investigated by Immigration and Customs Enforcement and was prosecuted by Assistant U.S. Attorney Lynn W.Y. Wang.
