    Teen Charged After Traffic Stop Goes Awry

    CHARLOTTE, N.C. -- Authorities say an illegal immigrant trying to escape a traffic stop in east Charlotte attempted to run over an Alcohol Beverage Control officer late Tuesday.

    The officer tried to pull over a 16-year-old driving an SUV on the 3900 block of The Plaza around 11 p.m. Tuesday. Authorities say when the officer approached the car, the driver, Jorge Luis Marin, tried to run over him. The ABC officer fired a shot at the vehicle.

    The officer then jumped back into his car and followed the SUV until it ran off the side of Eastwood Drive and slammed into a tree. Although Marin suffered minor injuries when his face was cut by flying glass, he still got out of the vehicle and ran, witnesses said.

    Louise Taylor saw the whole thing.

    "I seen someone get out running; police jumped out. We locked up the doors cause we were scared and who knows what's going on," she said.

    Marin was quickly caught. He was taken to Carolinas Medical Center to be treated for his injuries before he was taken to jail.

    Investigators said the ABC officer had spotted Marin driving a stolen car and called for backup before trying to pull him over. Although officers with the Mecklenburg County ABC Law Enforcement Division are dedicated to the enforcement of the state's alcohol laws, they can take action on other criminal offenses.

    Marin now faces several charges, including assault with a deadly weapon on a government official, possession of a stolen vehicle and possession of a firearm by a minor.

    The Charlotte-Mecklenburg Police Department, which also got involved in the chase before the crash, is investigating the incident. The officer involved is currently on administrative leave.

    A 16-year-old who was arrested after a police chase late Tuesday and early Wednesday faces a number of criminal charges and likely deportation, Mecklenburg County Sheriff Jim Pendergraph said. A county Alcoholic Beverage Control officer who tried to pull over the teenage driver fired his gun during the incident.

    Jorge Luis Marin was in a Mecklenburg County jail Wednesday night, charged with assault with a deadly weapon, possession of a stolen vehicle, and several firearms and traffic charges. Bond was set at $40,500. Pendergraph said Marin told them he has been in the United States illegally for three years.

    Pendergraph said Marin faces an immigration hearing in Atlanta. "I expect that he will be deported," he said.

    The incident began around 11:15 p.m. Tuesday, when ABC Law Enforcement Officer T.L. Ashby spotted what he determined to be a stolen vehicle in the 3900 block of The Plaza. Police say Ashby pulled over the driver, but the man pulled away and tried to hit the officer. Police say Ashby fired his gun once at the vehicle.

    Police say the driver was captured after his vehicle struck a tree on Maywood Drive and he tried to run away. Initial reports late Tuesday were that the fleeing driver might have been struck by a bullet fired by Ashby, but police say Marin needed hospital treatment for injuries caused by flying glass.

    Police aren't sure whether a police bullet or the tree shattered the windshield.

    As is routine in cases of police firearms use, Ashby was placed on administrative leave while an investigation takes place.

    The 16-year-old who was arrested early Wednesday after a police chase in which a law enforcement officer fired his gun at the fleeing driver's vehicle faces deportation, Mecklenburg County Sheriff Jim Pendergraph says.

    Jorge Luis Marin, of Charlotte, was taken into custody early Wednesday morning after being captured on Maywood Drive, off The Plaza. He is charged with assault with a deadly weapon, possession of a stolen vehicle, possession of a firearm by a minor, carrying a concealed weapon, resisting arrest, and numerous traffic offenses. He is in a Mecklenburg County jail on $40,500 bond.

    "He will get a hearing here in Charlotte on the state charges, and then he'll be taken to Atlanta for an immigration court hearing," Pendergraph said Wednesday evening. "He almost certainly will be deported."

    Pendergraph said Marin told deputies Wednesday that he has been in the country illegally for three years.

    Pendergraph also said Marin has "a lengthy juvenile record" of criminal charges.

    The sheriff said deputies learned about Marin's illegal immigrant status through a computer database system that the sheriff's office has been using since May 1.

    "It is connected with the ICE (Immigration and Customs Enforcement) database," Pendergraph said.

    The sheriff said more than 550 people charged with crimes in Mecklenburg County have been sent to Atlanta for probable deportation since the system went into operation almost five months ago.

    The Marin case began about 11 p.m. Tuesday, when an ABC Law Enforcement Officer, T.L. Ashby, spotted a vehicle in the 3900 block of The Plaza that he thought was be operated erratically.

    Ashby pulled over the driver and said that when he tried to approach the vehicle, the driver started speeding off and moved in the direction of the ABC officer. Ashby said he fired his gun once at the fleeing SUV.

    That shot apparently shattered the windshield, but the driver continued speeding off -- with police in pursuit.

    During the chase, police say, the driver ran into a tree. Soon afterward, the fleeing man stopped the vehicle and jumped out, running away. Police caught him moments later.

    Ashby has been placed on administrative leave during an investigation into the case, which is typical when an officer uses his firearm.
