    SB 2255 Border Fence Fund Act Filed !!!

    If you can make a call, you can get this legislation introduced in your State.

    The following States have a Republican majority in the House, Senate and Governor.

    If you live in
    Alabama, Alaska, Arizona, Florida, Georgia, Idaho, Kansas, Maine, Michigan, North Dakota, Ohio, Pennsylvania, South Carolina, South Dakota, Tennessee, Texas, Utah, Wisconsin, Wyoming, this legislation will pass and it can be introduced in less than 24 hrs after your legislator learns of it.

    These States have filing deadlines for this session coming up real soon.

    Step 1 Download SB 2255 from this website (right click, save target as)

    Step 2 Email the bill to the key State legislators in your State that are concerned about illegal immigration. If you don’t know who they are, you can look them up on this webstie: http://statelegislatorsforlegalimmigration.com/
    Then email the bill to your State Legislator. Make sure your subject line will catch their interest.

    Step 3 Call both legislators

    If you have access to a State lawmaker, this will be a breeze. It brings in revenue for your State but it doesn't raise taxes. Its a no-brainer for legislators.

    Be sure to tell them it has already been done in OK a year and a half ago.

    To ensure the money goes to the Border Fence, make sure there is no language that gives the legislature the authority to appropriate it. Make sure there is no repealer (expiration date) or act that the legislature must do to keep it going. These are things legislators do to confiscate money for other projects.

    Consider starting with a fee that is equal to your State sales tax. Make sure your bill is titled to reflect the money is for building the border fence. MS SB 2255 will be titled Border Fence Fund Act.

    SENATE BILL NO. 2255
    AN ACT TO REQUIRE ENTITIES THAT TRANSMIT WIRE TRANSFERS TO 1 COLLECT A FEE ON WIRE TRANSFERS TRANSMITTED TO LOCATIONS OUTSIDE 2 THE UNITED STATES; TO REQUIRE THE FEES SO COLLECTED TO BE 3 TRANSMITTED TO THE DEPARTMENT OF REVENUE NOT LATER THAT THE 4 FIFTEENTH DAY OF THE MONTH FOLLOWING THE CLOSE OF EACH CALENDAR 5 QUARTER; TO CREATE A SPECIAL FUND IN THE STATE TREASURY TO BE 6 KNOWN AS THE BORDER FENCE FUND AND TO REQUIRE REVENUE COLLECTED AS 7 A RESULT TO THE WIRE TRANSFER FEE TO BE DEPOSITED TO THE CREDIT OF 8 THE FUND; TO PROVIDE THAT MONEY IN THE FUND SHALL BE USED FOR THE 9 PURPOSE OF ASSISTING IN THE CONSTRUCTION OF A FENCE ALONG THE 10 BORDER BETWEEN THE UNITED STATES AND MEXICO; TO PROVIDE THAT A 11 TAXPAYER SHALL BE ALLOWED AN INCOME TAX CREDIT IN AN AMOUNT EQUAL 12 TO THE WIRE TRANSFER FEES PAID BY THE TAXPAYER; AND FOR RELATED 13 PURPOSES. 14
    BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 15

    SECTION 1. (1) Any entity that transmits wire transfers of 16 money shall collect a fee of Five Dollars ($5.00) for each wire 17 transfer of money transaction that is transmitted to a location 18 outside the United States plus one percent (1%) of the amount of 19 the transaction that exceeds Five Hundred Dollars ($500.00). 20

    (2) The fee prescribed by this section shall be remitted 21 quarterly to the Department of Revenue on such forms as the 22 department may prescribe. All forms and remittances shall be 23 filed with the Department of Revenue not later than the fifteenth 24 day of the month following the close of each calendar quarter. 25

    (3) All revenue collected from the imposition of the fee 26 shall be deposited to the credit of the Border Fence Fund created 27 in Section 2 of this act. 28

    (4) All administrative provisions of the Mississippi Sales 29 Tax Law, including those which fix damages, penalties and interest 30 for nonpayment of taxes and for noncompliance with the provisions 31 of such chapter, and all other duties and requirements imposed 32

    upon taxpayers, shall apply to all persons liable for fees under 33 the provisions of this section, and the Commissioner of Revenue 34 shall exercise all the power and authority and perform all the 35 duties with respect to taxpayers under this chapter as are 36 provided in the Mississippi Sales Tax Law except where there is a 37 conflict, then the provisions of this section shall control. 38

    SECTION 2. There is created in the State Treasury a special 39 fund to be known as the Border Fence Fund into which shall be 40 deposited the revenue specified in Section 1 of this act and such 41 other money as the Legislature may provide by appropriation. 42 Money in the fund shall be used for the purpose of assisting in 43 the construction of a fence along the border between the United 44 States and Mexico. Money in the fund shall be expended upon 45 appropriation by the Legislature. Unexpended amounts remaining in 46 the fund at the end of a fiscal year shall not lapse into the 47 General Fund and investment earnings on amounts in the fund shall 48 be deposited to the credit of the fund. 49

    SECTION 3. (1) A taxpayer shall be allowed a credit against 50 the income taxes imposed by this chapter an amount equal to the 51 fees paid by the taxpayer pursuant to Section 1 of this act. 52

    (2) The credit allowed by this section shall not exceed the 53 taxpayer's income tax liability and any unused tax credit shall 54 not be allowed to be carried forward to apply to the taxpayer's 55 succeeding year's tax liability. 56

    SECTION 4. Section 2 of this act shall be codified in 57 Chapter 7, Title 27, Mississippi Code of 1972. 58

    SECTION 5. This act shall take effect and be in force from 59 and after July 1, 2011. 60
