OLATHE, Kan. (AP) — The Johnson County sheriff says federal immigration authorities have placed a detainer on the man charged in the death of sheriff's deputy killed when a pickup slammed into his patrol car during a traffic stop.

Adrian Espinosa-Flores, of Kansas City, Kansas, is being held in Johnson County on $2 million bond after being charged Monday with involuntary manslaughter/DUI in the death Sunday of Master Deputy Brandon Collins. Collins was making a traffic stop at the time.

Sheriff Frank Denning said Tuesday that U.S. Immigration and Customs Enforcement placed a detainer on Espinosa-Flores.

Denning says the detainer is a request to local law enforcement agencies to hold a person for possible deportation once they've gone through the court system. Denning says the detainer also means Espinosa-Flores won't be released on bond.

A twice-arrested illegal immigrant killed a Kansas sheriff’s deputy on Sunday, a source with knowledge of the case told The Daily Caller.

Adrian Espinosa-Flores, 38, was charged Monday with involuntary manslaughter and he allegedly was driving drunk and crashed his pickup truck into the patrol car stopped on the side of the road. The crash killed Johnson County (Kansas) Sheriff’s Department Master Deputy Brandon Collins, 45.

The Kansas City Star reported Tuesday that Immigration and Customs Enforcement had placed an immigration detainer on Espinosa-Flores. Immigration detainers request that an individual be transferred to ICE custody, detainers are written for immigration violations but not necessarily for being in the country illegally.

A source at the Johnson County Sheriff’s Department with knowledge of the investigation told TheDC that the detainer was because Espinosa-Flores is in the United States illegally. The Johnson County District Attorney’s Office told The Daily Caller they couldn’t comment on the detainer as the investigation is on going.

Espinosa-Flores was previously arrested for DUI in California in 2001 and a traffic violation in Kansas in 2013. ICE has said they were not notified of either of those arrests.

41 Action News reported that the Kansas police department that arrested him in 2013 didn’t notify ICE because, “it could be considered profiling because a lot of people of all races are arrested without a proper ID.”

A 39-year-old man in the country illegally pleaded guilty Thursday to causing a traffic crash that killed a Johnson County sheriff’s deputy last year.

Adrian Espinosa-Flores, 39, pleaded guilty to a charge of reckless second-degree murder in the death of Master Deputy Brandon Collins.

Collins was killed on Sept. 11, 2016, while conducting a traffic stop on U.S. 69 just north of 151st Street in Overland Park.

Collins’ patrol vehicle was parked when a pickup truck driven by Espinosa-Flores ran into the back of Collins’ vehicle, pushing it into the SUV that the deputy had pulled over.

On Thursday, he also pleaded guilty to three counts of aggravated battery for injuries suffered by the occupants of the SUV.

Espinosa-Flores was arrested nearby shortly after the crash and a preliminary test showed his blood-alcohol content was twice the legal limit, according to court documents.

After his arrest, Espinosa-Flores told investigators that he was on his way home to Kansas City, Kan., from a friend’s home in Belton when the crash occurred.

He told officers police that he had consumed four beers that night.

Espinosa-Flores is in the United States illegally, and will be taken into the custody of immigration officials once he completes his prison sentence.

He has been in the Johnson County Jail since the crash and his sentencing date is scheduled for Jan. 12.

National Sheriff's Association needs to stand united against illegal immigration and demand an Executive Order from our President to authorize state and local law enforcement to engage in and execute US immigration law with any threat of retaliation or lawsuits from the federal government. Who knows when Congress might pass the Davis-Oliver Act?!! This is a life and death matter and demands an Executive Order from the President clearing the way for immediate engagement by state and local law enforcement to enforce US immigration law. He can deputize them all. Draw up a form and send some notaries around to group swear them in as federal deputies. Time is of the essence.
