STEINLE FAMILY TO FILE LAWSUIT AGAINST SF, FED OFFICIALS

    by CAROLINE MAY1 Sep 201564

The family of Kathryn Steinle — the woman whose shooting death sparked a national outcry over illegal immigrant crime — is filing a lawsuit against local and federal officials over her murder, according to reports.

Steinle family is slated to file the suit Tuesday and it will name San Francisco Sheriff Ross Mirkarimi, Immigration and Customs Enforcement (ICE) and the U.S. Bureau of Land Management, according to ABC7 News.

The sheriff’s department released alleged killer Juan Francisco Lopez-Sanchez from custody less than three months before Steinle was shot, ignoring an immigration detainer ICE had lodged against him. Sanchez is a seven-time convicted felon who had been deported from the U.S. five times. San Francisco’s sanctuary city policies have been blamed for the release.

The gun that was used to shoot Steinle was a BLM gun that the agency says was stolen from an agent’s car.

Speaking to ABC7 News, Steinle’s mother, Liz Sullivan said the release of violent illegal immigrants must stop.

“It’s something that needs to end. We don’t need them here, not violent felons,” she said. “They’re violent felons and they’re illegal, enough said. It’s too late for us, that ship has sailed but we want it for future, possible victims. We’ve got to put an end to it.”

Despite the Steinle family’s calls for change, Mirkarimi has stood firm in his decision to ignore ICE detainers and, according to ABC7 News continues to refuse ICE detainer requests.

“Federal courts have actually held that detaining someone for ICE is unconstitutional, it’s unlawful,” sheriff’s office attorney Mark Nicco told ABC7.

Steinle was shot and killed while walking with her father at San Francisco’s Pier 14 on July 1.

“Sometimes we’re together and then sometimes we’re falling apart at the seams,” Sullivan told ABC7.

Steinle’s murder has inspired legislation aimed at cracking down on sanctuary cities and deported illegal immigrants who re-enter the U.S.

Last month the House passed one such bill that would block jurisdictions with sanctuary policies from receiving certain law enforcement grants. It has also become a topic of debate in the 2016 presidential election, with top candidates weighing in on the policies that may or may not have contributed.

OH, how I would like to serve on that jury! I would open negotiation for the Steinle's in the jury room at 25 mill. from the Sheriff, one hundred twenty five billion from San Francisco, a cool one trillion dollars from the BLM. A million means chump change, a billion is common conversation, and the amount must be punitive for taxpayers to awaken to voting for Americans at the ballot. I'd like to make it payable without appeal and immediately in full!

Kate Steinle’s parents file legal claims against San Francisco, federal officials, in pier shooting death

Kate Steinle's parents announced Tuesday they had filed legal claims against San Francisco and federal officials in connection to their daughter’s death, which sparked fierce national debate about immigration policies.

"We're here not only for Kate, we're here for every citizen of this country who comes to San Francisco," said Jim Steinle, Kate's father. "If you think this can't happen to you, think again.

Speaking to acrowd of reporters, Jim and his wife, Liz Sullivan, were joined by their son, Brad Steinle. The family said it had filed claims against San Francisco Sheriff Ross Mirkarimi, the U.S. Immigration and Customs Enforcement and the U.S. Bureau of Land Management, whose stolen gun was used in the shooting, the San Jose Mercury News reported.

Kate Steinle was shot to death while going on a stroll with her dad at Pier 14 on July 1. She died in her father's arms.

"She said 'help me, help me.' That's my bedtime story every night," her dad said.

Family attorney Frank Pitrie said "What happened on Pier 14 was not only forseeable, it was preventable."

Katie's mother told reporters "This is for accountabiliity for public officials that we have voter for, who are not doing their job."

Her alleged killer, Juan Francisco Lopez-Sanchez, a 45-year-old Mexican national, had been deported five times for multiple felonies. He had been held in a San Francisco jail in April and released when the charges were dropped because of the city's "sanctuary laws."

Sheriff Mirkarimi should have notified ICE when Lopez-Sanchez was released from jail, the Steinle family says.

His attorney said the shooting was accidental -- he found the .40-caliber gun on the pier by his feet and it accidentally went off. The firearm had been stolen from a Bureau of Land Management ranger during a car break-in in June.

Steinle's death prompted presidential candidates like Donald Trump and Hillary Clinton to weigh in on immigration reform. Her parents have been outspoken about the need for change, calling on legislative action at a senate judiciary hearing in July.

Kate Steinle Lawsuit Has Political Reverberations in Washington Over Illegal Immigrat

    Video at source link.

    By ALI WEINBERG

As the family of a woman allegedly slain by an undocumented immigrant filed a claim today in advance of a lawsuit over her death, a fierce debate in Washington over the practice of so-called "sanctuary cities" is expected to consume Congress after members return from their summer recess.

Congress has been working on legislation known as "Kate's Law," after Kate Steinle, the victim of the attack in San Francisco that made national headlines earlier this summer. It would end federal funding for so-called sanctuary cities that defy federal immigration actions.

San Francisco, where Steinle was killed, is one of those cities, which is why the Steinle family filed a claim against the city's sheriff, Ross Mirkarimi, as well as the U.S. Bureau of Land Management and U.S. Immigration and Customs Enforcement.

"The system failed our sister," Brad Steinle, Kate's brother, said at a family news conference today, fighting back tears. "And at this point nobody has taken responsibility, accountability. And nothing has changed."

Two months since Kate's murder in early July at San Francisco's Pier 14, the bill that bears her name is still stalled in the Senate Judiciary Committee. A staff member for Senate Judiciary Committee ranking member Sen. Pat Leahy said the Senate would take it up when lawmakers return from recess, but Beth Levine, a spokeswoman for Republican Chairman Chuck Grassley said that the committee is also exploring other options because "the Democrats have not indicated a willingness to help pass legislation." She did not elaborate.

The House is considering companion legislation, introduced by Rep. Matt Salmon of Arizona.

"Kate's Law" would bar sanctuary cities from accessing more federal grants than are already available to them and increase penalties for individuals who re-enter the United States after deportation. It's not clear how much bipartisan support the bill would receive -- a similar bill passed the House in late July, with the votes divided largely along party lines.

The case is also figuring heavily on the presidential campaign trail. Donald Trump released a video on Instagram featuring images of undocumented immigrants accused of murder, including Francisco Lopez Sanchez, the convicted felon who allegedly killed Kate Steinle, juxtaposed with Jeb Bush calling illegal immigration "an act of love."

The parents of Kate Steinle have found themselves at the center of the sanctuary cities debate.

Jim Steinle testified before the Senate Judiciary Committee in July, urging lawmaker to pass legislation like Kate's Law that would keep undocumented immigrants like Sanchez, a convicted felon who had been released from prison, from remaining in the country.

"Our family realized the complexity of immigration laws. However, we feel strongly that some legislation should be discussed, enacted or changed to take these undocumented immigrant felons off our streets for good," Jim Steinle said.

I'm surprised out courts aren't being flooded by lawsuits against the federal government from those who have suffered because of illegal immigration.

I think that there is a potential for the mother of all class action suits.

STEINLE FAMILY: ‘SILENCE IS DEAFENING’ ‘NOBODY IS BEING HELD ACCOUNTABLE’

    by IAN HANCHETT
    1 Sep 2015

Kate Steinle’s father Jim, said that “the silence is deafening,” and her brother Brad added “nobody is being held accountable for Kate’s murder” on Tuesday’s “O’Reilly Factor” on the Fox News Channel.

Jim said he was frustrated over the “lack of movement” on sanctuary cities and illegal immigrant felons in the US.

Jim Steinle was then asked if any politicians, specifically California Senators Sen. Dianne Feinstein (D-CA) and Sen. Barbara Boxer (D-CA) contacted them. He responded, “the silence is deafening. We have not heard from anyone.” Brad Steinle added that the family did meet with Feinstein while they were in Washington, DC, but that there’s been “no movement” since the family left DC. Both added, when they were asked, that California Governor Jerry Brown (D) hadn’t spoken to them. Later on, Brad said that Feinstein was in favor of “putting something together that would push cities to cooperate with federal agencies.” Jim also said the family hadn’t heard from President Obama and that the family doesn’t feel like it has gotten justice.

Brad stated of the family’s lawsuit, “The point of the lawsuit is to bring to light that nobody is being held accountable for Kate’s murder.”
