    Q: If an illegal immigrant is convicted of a crime and sent to county jail or state prison, what happens after they serve their sentence?

    Whether in Kern County jail or the California Department of Corrections and Rehabilitations, people who are in this country illegally are taken back to their country of origin after they are released from custody.

    In addition, people who are in the process of gaining citizenship may be deported if they are convicted of certain crimes.

    Right now, the state prison system has about 15,700 people behind bars who are not U.S. citizens, said prison spokesman Brian Parriott.

    These numbers are not broken down by country of origin, Parriott said.

    The Kern County Probation Department refers about 120 felony cases to the U.S. Department of Immigration and Customs Enforcement. That agency takes responsibility for these people after they are released from Kern County jails, said Kathy Lemon, the director of adult services for the Kern County Probation Department.

    The immigration officers will routinely go to the jails to interview people who may potentially be illegal immigrants and conduct background checks, said immigration spokeswoman Lori Haley.

    These people are released from jail or prison to the custody of ICE officers and either flown or bused back to their country, Haley said.

    If the deportation is contested, a hearing may be held to determine the proper placement of the person, Haley said.

    In the interim, the people in question are kept in the immigration department's custody, Haley said.

    This is another thing that needs to be eliminated. If they are proven to be here illegaly, there should be no deportation hearing. Skip the middle man and go right to deportation. No appeals, no contestations, etc.

    What is your source for this information? Are you not aware that for years illegal aliens that have been released from our jails are simply put back on the streets of America without being deported?

    Yes, an immigration judge issues a directive for the illegal alien to leave the country but there are hundreds of thousands of known felon illegal aliens in our nation now, many of which walked right out of US jails back onto our streets without deportation.

    Please let me know who gave you this erroneous information that illegal aliens were returned to their home countries when released from jail.
