[Watch] US Supreme Court Punts – Clears Way For Internet Sales Tax

The Supreme Court announced on Monday it will not hear a case by Amazon.com and Overstock.com which challenges a law requiring online retailers to collect sales tax for sales in all states, even those where they have no physical presence.
The refusal to hear the case green lights state governments to tax online retailers, making them in essence an arm of each state’s tax collection agency.
The Supreme Court had previously held that the Commerce Clause and the Due Process Clause of the Fourteenth Amendment prohibit an out-of-state tax scheme if the seller has no physical presence.
We can now expect states to push Congress to act quickly to impose burdensome taxation and other regulations on the internet. Earlier this year, the Senate passed the Marketplace Fairness Act, a piece of legislation which has been widely characterized as a national internet sales tax. The cumbersome law requires 10,000 jurisdictions — including 46 states, six territories, and over 500 Native American tribal nations — to collect sales tax for government.
The House may now take up the legislation, which Hussein Obama is said to support. So once again, Americans are down to our last hope for representation in our own best interest being a stand by the House of Representatives. The Senate has already sold us out and B. Hussein always will.
While the point of sale process will be impacted to a degree, the real logistical nightmare is the reconciliation process and the payment to each of the individual entities the monies collected in their names. Audit considerations will also be a time and labor intensive drain on the productivity of online retailers.
Ultimately those costs will naturally be reflected in the prices paid to online retailers by their customers.
It’s the same with every tax imposed by the government. The more numerous and healthy the ticks on the dog, the weaker and sicker the dog becomes.
