    Yes, he has one that the judge has promised to hear on the merits and not dismiss on procedural grounds. We shall see.

    By kicking him out the Army, I would think he has a good case for another court hearing, because this soldier has said all along that he would go to Afganistan if Obama's citizenship was cleared up.
