    "As a former small business owner, I understand the unnecessary burden our failing income tax system has on Americans. The Fair Tax Act eliminates the tax code, replaces the income tax with a sales tax, and abolishes the abusive Internal Revenue Service. If enacted, this will invigorate the American taxpayer and help more Americans achieve the American Dream," Rep. Jeff Duncan, R-S.C., said."


    First of all, and with regard to the selling point that the Fair Tax “… abolishes the abusive Internal Revenue Service …”, in its place Duncan’s proposal creates two new tax collecting agencies, an “Excise Tax Bureau” and the “Sales Tax Bureau", in addition to keeping the Bureau of Alcohol, Tobacco and Firearms alive which will also be collecting taxes.


    Also, the alleged “Fair Tax”, if adopted, does not abolish federal taxes calculated from various types of “incomes” as suggested. Congress will still maintain the power to lay and collect “excise taxes” calculated from profits and gains, such as the Corporate Excise tax of 1909. So, right from the beginning, Rep. Duncan is suggesting something that is not true. The same IRS abuses now suffered under income taxation will continue under the fraudulent and deceptive Fair Tax, carried out under its “Excise Tax Bureau”.


    And if you think businesses and individuals subject to the Fair Tax are free from filling out annual tax returns, the shocking truth is, they will have to start filling out and filing Fair Tax returns, under the penalty of perjury, every month ___ that’s twelve frickin times a year! Additionally, even ordinary working people, who sell the property each has in their own labor, and work odd jobs, such as baby sitting, handyman jobs etc., to meet today’s high cost of living, not only will they have to file Fair Tax returns twelve times a year, but will have to register with the federal government to exercise their inalienable right to sell their labor.


    If the above is not enough to make one recoil from the notoriously evil and deceptive Fair Tax proposal, the Fair Tax would also create another entitlement called the “family consumption allowance”, which is a monthly government check sent to every household in America which allows the purchase of a rationed supply of tax-free necessities of life, and puts our entire population on the public dole!


    If Rep. Duncan has one ounce of honesty in him, he would reject the alleged Fait Tax and promote the Fair Share Balance Budget Amendment which actually would abolish all federal taxes calculated from lawfully earned profits, gains, wages, etc. and end the miseries suffered under the evil tax on incomes.

    It is absolutely sickening how many so-called “conservatives” are promoting the alleged Fair Tax which keeps Congress’ power to lay and collect taxes calculated from profits, gains and other “incomes” alive while imposing an additional tax which increases the number of tax returns required to be filed to 12 frickin times a year!

    When one takes the time to study the provisions of the “Fair Tax” they soon realize ordinary working people, like the married couple down the block, Mary and Joe, will not only have to file Fair Tax returns twelve times a year, but register with government to exercise their inalienable right to sell the property each has in their own labor.

    Let us look at Mary and Joe who have two children and find it necessary to earn extra money to pay their bills. Mary baby sits for neighbors in the community and cleans homes on weekends to raise extra money while Joe, who works for a plumbing company as a full-time job, also provides plumbing services on his own time to people living in his community.

    Under the alleged FairTax Mary and Joe’s inalienable right to sell the property they have in their labor becomes a taxable event and must register with government [“SEC. 502. REGISTRATION”], to sell the property they have in their labor, collect a 23 percent federal tax for Congress [“SEC. 101. IMPOSITION OF SALES TAX] when selling their labor, and file Fair Tax returns under the penalty of perjury twelve times a year [“SEC. 501. MONTHLY REPORTS AND PAYMENTS].

    Additionally, Mary and Joe will also be compelled to keep any records Congress may dream up [“SEC. 508. RECORDS] and live under the constant threat of audits [“SEC. 507. SUMMONS, EXAMINATIONS, AUDITS, ETC.], if they dare to sell the property they have in their labor. Now keep in mind how direct taxation is currently being used to threaten, intimidate, and harass political opponents.

    Why on earth would any Freedom Caucus member support the Nanny Tax, AKA the Fair Tax?

    "Rep. Buddy Carter, R-Ga., reintroduced a bill Monday that would replace the current federal tax structure with a national consumption tax and lead to the elimination of the Internal Revenue Service.


    Carter first introduced the Fair Tax Act in January 2021, but it failed to make it out of the Ways and Means Committee. His action comes on the heels of the House voting 221-201 on Monday night to rescind funding for the hiring of 87,000 additional IRS agents stipulated under the Inflation Reduction Act, which became law last year."

    What Rep. Buddy Carter, R-Ga., and Rep. Kat Cammack, R-Fla., avoid telling their constituents is, the FairTax, which they are trying to shove down the throats of the American people . .


    • creates an entirely new tax,
    • creates two new tax collecting agencies, an “Excise Tax Bureau” and the “Sales Tax Bureau", in addition to keeping the Bureau of Alcohol, Tobacco and Firearms alive which will also be collecting taxes.
    • keeps Congress’ power to lay and collect excise taxes calculated from incomes alive,
    • requires taxpayers to file Fair Tax returns twelve times a year,
    • requires ordinary working people to register with government in order to sell the property each has in their own labor,
    • requires ordinary people to become tax collectors for government.
    • requires taxpayers to keep whatever records Congress may dream up,
    • and creates a new entitlement, the Family Consumption Allowance [a monthly government check sent to every family in the U.S.] that would become another wedge issue used during election time to buy votes.


    Why on earth would any “conservative” politician support this rope-a-dope proposal which enlarges and strengthens the federal government’s iron grip around the American people’s necks?


    If Rep. Buddy Carter, R-Ga., and Rep. Kat Cammack, R-Fla., are really determined to offer meaningful federal tax reform, they would introduce the FAIR SHARE BALANCED BUDGET AMENDMENT which begins as follows:


    “SECTION 1. The Sixteenth Amendment is hereby repealed, and Congress is henceforth forbidden to lay any tax or burden calculated from sales, profits, gains, interest, salaries, wages, tips, inheritances or any other lawfully realized money.


    NOTE: these words would return us to our founding father’s original tax plan as they intended it to operate! They would also end the experiment with allowing Congress to lay and collect taxes calculated from lawfully earned “incomes” which now oppresses America‘s economic engine and robs the bread which working people have earned when selling the property each has in their own labor, not to mention they would end federal taxation being used as a political weapon to harass and attack political opponents!

    That is not true! There are a number of other taxes which will still be collected if the FairTax is adopted. See the The Fair Tax Act which creates two new tax collecting agencies, an “Excise Tax Bureau” and the “Sales Tax Bureau", in addition to keeping the Bureau of Alcohol, Tobacco and Firearms alive which will also be collecting taxes.


    In addition, See Flint v. Stone Tracy Co., 220 U.S. 107 (1911) which confirms under Congress' power to lay and collect "excise" taxes, it can and has imposed an excise tax which calculates the amount of tax to be paid from "income", i.e., profits and/or gains. The court stated:

    The Corporation Tax, as imposed by Congress in the Tariff Act of 1909, is not a direct tax, but an excise; it does not fall within the apportionment clause of the Constitution, but is within, and complies with, the provision for uniformity throughout the United States; it is an excise on the privilege of doing business in a corporate capacity,
    There is nothing in the FairTax Act repealing Congress' power to lay and collect countless "excise" taxes calculated from incomes. But the Act, if adopted, does create the new “Excise Tax Bureau,” which is necessary to collect all the new excise taxes Congress dreams up in addition to the new 23 % FairTax.

    Matt Gaetz gives thumbs up to a deceptive Balanced Budget Amendment.

    I see Matt Gaetz is supporting a fraudulent and deceptive Balanced Budget Amendment that would make it constitutional for Congress to not balance the annual budget.

    If Matt Gaetz is sincere about encouraging Congress to balance the annual federal budget, he would be supporting the Fair Share Balanced Budget amendment which would actually require Congress to balance the annual budget.

    I just came across the following article which deals with the alleged “FairTax”.

    "As noted in the above clip, I’m very worried about giving untrustworthy politicians a new source of tax revenue without unambiguously and permanently getting rid of the income tax (so that we don’t repeat the European mistake of giving politicians a way of expanding government).


    I also worry that a Fair Tax is vulnerable to demagoguery since lawmakers will get hit with election-year ads stating they want a big 30 percent tax on everything people buy (while overlooking that our paychecks will be much bigger once income taxes and payroll taxes are abolished).


    Indeed, many sympathizers openly admit that the Fair Tax has vulnerabilities."


    One thing for sure is, the FairTax as advertised, is far, far different from what is found in the text of the FairTax Act which:



    • creates an entirely new tax,
    • creates two new tax collecting agencies, an “Excise Tax Bureau” and the “Sales Tax Bureau", in addition to keeping the Bureau of Alcohol, Tobacco and Firearms alive which will also be collecting taxes.
    • keeps Congress’ power to lay and collect excise taxes calculated from incomes alive,

    • requires ordinary working people to register with government in order to sell the property each has in their own labor,
    • requires ordinary people to become tax collectors for government

    End the tax loopholes the swamp passes that they use.

    Somebody better come up with a plan that works.

    I agree with you completely, and so far, the best plan in my opinion is the Fair Share Balanced Budget Amendment, which would actually accomplish what the FairTax advertises but doesn't do.


    The Fair Share Balanced Budget Amendment

Congress ought not raise money by borrowing, but when the money arising from imposts duties and excise taxes are insufficient to meet the public exigencies, and Congress has raised money by borrowing during the course of a fiscal year, Congress shall then lay a direct tax at the beginning of the next fiscal year for an amount sufficient to extinguish the preceding fiscal year’s deficit, and apply the revenue so raised to extinguishing said deficit.”

    NOTE: Congress is to raise its primary revenue from imposts and duties, [taxes at our water’s edge], and may also lay miscellaneous internal excise taxes on specifically chosen articles of consumption. But if Congress borrows and spends more than is brought in from imposts, duties and miscellaneous excise taxes during the course of a fiscal year, then, and only then, is the direct apportioned tax to be laid in order to balance the budget on an annual basis.

    “SECTION 3. When Congress is required to lay a direct tax in accordance with Section 1 of this Article, the Secretary of the United States Treasury shall, in a timely manner, calculate each State’s apportioned share of the total sum being raised by dividing its total population size by the total population of the united states and multiplying that figure by the total being raised by Congress, and then provide the various State Congressional Delegations with a Bill notifying their State’s Executive and Legislature of its share of the total tax being collected and a final date by which said tax shall be paid into the United States Treasury.”

    In reference to the above Section see: FIRST DIRECT TAX LAID BY CONGRESS, 1798

    NOTE: our founder’s fair share formula to extinguish an annual deficit would be:

    States’ population
    ---------------------------- X SUM TO BE RAISED = STATE’S FAIR SHARE
    Total U.S. Population

    The above formula, as intended by our founding fathers, is to ensure that each state’s share towards extinguishing an annual deficit is proportionately equal to its representation in Congress, i.e., representation with a proportional financial obligation! And if the tax is laid directly upon the people by Congress, then everybody taxpayer across the United States pays the exact same amount!

    Note also that each State’s number or Representatives, under our Constitution is determined by the rule of apportionment:

    State`s Pop.
    ------------------- X House size (435) = State`s No. of Representatives
    U.S. Pop.

    “SECTION 4. Each State shall be free to assume and pay its quota of the direct tax into the United States Treasury by a final date set by Congress, but if any State shall refuse or neglect to pay its quota, then Congress shall send forth its officers to assess and levy such State’s proportion against the real property within the State with interest thereon at the rate of ((?)) per cent per annum, and against the individual owners of the taxable property. Provision shall be made for a 15% discount for those States paying their share by ((?))of the fiscal year in which the tax is laid, and a 10% discount for States paying by the final date set by Congress, such discount being to defray the States’ cost of collection.”

    NOTE: This section respects the Tenth Amendment and allows each state to raise its share of a direct tax in its own chosen way in a time period set by Congress, but also allows the federal government to enter a state and collect the tax if a state is delinquent in meeting its obligation.

    "SECTION 5. This Amendment to the Constitution, when ratified by the required number of States, shall take effect no later than (?) years after the required number of States have ratified it.

    Not only that we need to cut off all foreign aid. These countries can pay their own bills. We are not the ATM machine for these corrupt countries. This is nothing but extortion.

    We need bring our troops home and stop defending the world's borders. We need to defend our own with our troops. These countries can enlist their own men and women to defend their borders.

    Cut off all funding for immigration, ALL of it! Apply to come legally, pay your way, only 500,000 per year under ONE program and terminate all other programs.

    Enforce Public Charge. These foreigners cannot pay their way they are deported!

    No more pork bills. Stand alone bills, pass them on on time, vote in person, or you forefeit your pay and are fired!

    Trillions of dollars wasted that come out of our paychecks.
