email this morning... It is starting to look like they may have turned Raul Herrera lose on his own cognition which if so is not appropriate for vehicular homicide and manslaughter cases.

Can you please help us locate Raul Herrera, the man that was drinking and driving when he killed comedian Brian Edward Kiley 38 of Tennessee?

We are trying to determine Raul Herrera's immigration status as it relates to his impact on community safety and flight risk, but we cannot find him in the last 30 days listing of people processed into the Durham County detention center via this resource.

Mr. Gheen, Durham Police Department is the investigating agency on this case, therefore I can't offer many details. I do know however, that Raul Herrera was never booked into the Durham County Jail. There is currently an active warrant for his arrest for one charge of Felony Death by Vehicle. For additional information about the case you will have to contact Durham PD. Durham Police Department:

We are writing to inquire about the location and immigration status of Raul Herrera 31 of "High Point, NC". News reports indicate that you charged him with DWI after the crash in which a comedian named Brian Edward Kiley was killed. The crash occurred this past Sunday on Highway 40 in your jurisdiction.

We have learned from the Durham County Detention Center information officer that Raul Herrera was never booked into the jail and now has an active warrant for arrest for Felony Death by Vehicle.

Since Mr. Kiley was declared deceased at the scene of the crash can you please tell us why Raul Herrera was released and never booked into the Durham County Detention Center, was Raul Herrera's immigration status checked, and is Mr. Herrera a US Citizen, legal immigrant, or "undocumented immigrant"?

Our concern is that if Raul Herrera is an illegal immigrant he would be considered by most jurisdictions to be a flight risk as many illegal immigrants charged with homicide and other felonies escape justice by leaving the country.

So please inform us as to why Raul Herrera was not placed into detention, if his status was checked, and what his citizenship or immigration status is so that such information can be weighed as a public policy concern since Durham, NC has become widely debated for established Sanctuary City policies for illegal immigrants.

Ok, So they put Raul Herrera in the Wake County jail instead of Durham County and he has been set a low bail and allowed to bail out without an ICE hold....
