    Does it really include locker rooms? It sounds like they are talking about bathrooms. It doesn't sound like they are including environments where full frontal nudity is an issue.

    Children don't belong in locker rooms for adults anyway. Think of Penn State.

    I would hate to see multi-gender high school locker rooms. These should be gender separated based on biological gender.

    Charlotte City Council approves transgender bathroom ordinance over governor's protest

    Published February 23, 2016 Associated Press

    CHARLOTTE, N.C. – North Carolina's largest city passed a law Monday allowing transgender people to choose public bathrooms that correspond to their gender identity, which the governor had called a threat to public safety and warned that the General Assembly may step in.

    The Charlotte City Council voted 7-4 to expand protections based on sexual orientation and gender identity, making it the latest frontier in a national debate on how businesses treat gay, lesbian and transgender customers. One of the revisions to the city's nondiscrimination ordinance allows people to choose restrooms corresponding to the gender with which they identify.

    North Carolina Gov. Pat McCrory — a former mayor of Charlotte, one of the 20 largest cities in the U.S. according to census figures — said in an email Sunday that changing the policy on restrooms could "create major public safety issues."

    "Also, this action of allowing a person with male anatomy, for example, to use a female restroom or locker room will most likely cause immediate State legislative intervention which I would support as governor," he wrote in the email to two Council members.

    The issue has been part of a national debate that included the high-profile defeat of a similar ordinance late last year by voters in Houston, and LGBT advocates worried bathroom-access fears would be used elsewhere to fight equal-rights measures. South Dakota legislators recently passed a bill requiring students to use bathrooms corresponding to their sex at birth, though it hasn't been signed by the governor.

    In North Carolina, the advocacy group Equality NC issued a statement criticizing McCrory for "perpetuating the same tired and debunked myths about transgender people and public safety." Executive director Chris Sgro accused the governor and legislators of trying "to bully the Charlotte City Council with threats to strip municipalities of their rights to govern."

    During the meeting, about 140 members of the public got one minute each to give the council their opinions on the measure. Because the council chambers were filled to capacity, some speakers had to stay in an adjacent room and await their time.

    Materials given to the council ahead of the meeting cited some residents' concerns that sexual predators would use the ordinance to gain entry to women's restrooms for assault or indecent exposure, but it also noted that staff researchers hadn't uncovered any evidence of an increase in such crimes in cities with non-discrimination ordinances.

    Before the meeting, several hundred people stood outside in a wind-driven rain to protest the proposal, holding signs with messages such as: "No Men In Women's Restrooms" and "Keep Kids Safe."

    Chris Williams, a 30-year-old father of three, passed out "No" stickers to the crowd, saying most Charlotte residents "stand with religious values."

    "I don't want my kids having to even question, 'Why is there this person in the restroom?'" he said. "I don't think they should even be faced with that question and that concern."

    The measure adds sexual orientation, gender identity and marital status as attributes protected from discrimination when it comes to public accommodations including restaurants, retail stores and other businesses. It would take effect in April. Public school would not be affected by the law.

    A similar measure was narrowly defeated by the Charlotte City Council in March 2015, even after the removal of a provision that would have allowed bathroom use based on gender identity. Local officials later announced that transgender people could use the bathrooms corresponding to their gender identity in city- and county-owned facilities.

    Members of Charlotte's LGBT community said in a survey the changes are needed because they have been denied service, received poor service or experienced disparaging comments, according to supplemental materials attached to Monday's Council agenda.

    Opponents of the measure — including some clergy and business owners — have sent the City Council a letter saying businesses should have the right to refuse service based on sexual orientation or gender identity.

    HB2 is the state law to stop the Charlotte ordinance.

    The Charlotte ordinance does not include locker rooms, only bathrooms in businesses.

This is apparently the case as the Ohio governor recently stated he “‘wouldn’t have signed” the recent North Carolina “bathroom bill.”

    Charlotte's ordinance allowed men to use women's restrooms and other facilities in both public facilities and all restaurants, bars, and other buildings of public accommodations.

    How does HB2 affect schools?

    North Carolina now requires students to use public school restrooms and locker rooms based on the gender on their birth certificates. It is not yet clear how that reconciles with the federal Title IX law that prohibits discrimination in all school programs. The federal government includes sexual identity and orientation under the broader category of sex discrimination, says Charlotte attorney John Wester. That sets up a potential collision involving hundreds of millions of federal education dollars that flow into the state’s school systems, colleges and universities.

    Where is public opinion in North Carolina on LGBT rights?


    In 2012, a constitutional ban on same-sex marriage passed with more than 60 percent of the vote. A June 2015 poll from the Democrat-leading Public Policy Polling of Raleigh showed that 44 percent of state residents supported same-sex marriage, with 46 percent opposed. Last April, an Elon University poll found that 63 percent of the state’s registered voters disagreed with the state’s magistrate law. The same poll showed that 51 percent of Republicans supported a business’ right to deny service to customers based on religious objections.

    What are some of the political factors driving this?


    Conservative religious groups within North Carolina are taking some credit for getting HB2 passed into law, and pro-LGBT rights advocates note there is financial support from national groups with similar interests. Many also believe gay and transgender issues are being used by politicians to motivate voters in a presidential election year. In North Carolina, both Republicans and Democrats are using HB2 as a rallying point for supporters.
    Southern Evangelical Seminary president Richard Land says the situation may also indicate a growing anger in the country on both the left and right. “I don’t like the form the revolution is taking,” he said. “Donald Trump is coarse and crude and frankly, dangerous, but I understand what is behind it. ...The establishment in Washington shows signs of existing more for its own benefit than for the people they were elected to serve.”

    How did Democrats vote on HB2?


    The vote in the N.C. House was 84-25 after three hours of debate, with all Republicans voting for it and 11 Democrats breaking ranks with their party to support the bill. In the Senate, the vote was 32-0 after the Democrats walked out in protest, saying they had not been allowed to participate in the process. Gov. Pat McCrory, a Republican, then signed it into law.

    Is the NBA All-Star game the only sports event reacting negatively to the bill?


    No. Both the NCAA, which has men’s basketball tournament games planned in North Carolina in 2017 and 2018, and the CIAA, which has hosted its annual basketball tournament in Charlotte since 2006, say they’re “monitoring the situation.” And cable network ESPN, which has been considering Charlotte as a contender for its summer X Games, said it embracesdiversity and inclusion and will evaluate all of our options” as it seeks the next site for the extreme-sports event.

    Could this hurt economic development in North Carolina?


    It’s too soon to tell. Major employers in North Carolina – American Airlines, Lowe’s, Apple, Facebook, Google, Microsoft, to name a few – all have said they’re disappointed with the measure, though they haven’t threatened to pull out from the state. Some business leaders say the new law could feed a perception that North Carolina isn’t inclusive, which could jeopardize employee recruitment and economic development.

    If boycotts happen, do they work?


    South Carolina was the subject of many boycotts for flying the Confederate flag at the state capitol. The NAACP announced a national boycott of the state in 2000. Tourism officials estimated the state lost $7 million in the first month as groups from the NCAA to the American Bar Association joined the protest. The loss of sporting events alone cost Columbia, Charleston and Greenville-Spartanburg millions of dollars every year, reports say. The flag was removed last year not because of boycotts, but after the shocking mass killings at a Charleston church that appear to have been racially motivated.

    Haven’t cities other than Charlotte expanded nondiscrimination ordinances?


    Charlotte’s ordinance was the first of its kind in North Carolina. Three South Carolina cities have similar ordinances: Columbia, Charleston and Myrtle Beach. They’re written differently, but “conceptually are identical” to what Charlotte did, city attorney Bob Hagemann has said. Those South Carolina cities and more than 200 other cities around the nation where similar ordinances exist have not reported problems with transgender bathroom use.

    Public restrooms cannot be policed for correct gender identity. As long as somebody dresses like the opposite sex, we can assume they are going to be able to use the restroom for that chosen sex. You can't police something like that unless there is some other anti-social behavior involved.

    But using a shower or a locker room is rather easily policed and should be enforced. As long as transgender surgery is legal, there are going to be castrated men running around with genitals carved up to look something like a vagina from the front. There is that and other hormone drenched affects that at least lower the shock of having a man in a woman's shower. Let's hope this is rare enough not be a major issue. The rest is rather easily policed.

    If you are a man only dressing up like a woman, you are not entitled to use a woman's shower or locker room.
