Congressman Jason Chaffetz (R., Utah) of the House Homeland Security Committee said Monday “We gave the Taliban their starting team back” in the prisoner exchange for Bergdahl.
“We put the five guys that have led this organization, allegedly killed thousands of people and been responsible, back into home confinement which could potentially lead to them being back on the battlefield,” Chaffetz told Andrea Mitchell.
Chaffetz denounced the president’s decision not to inform Congress, saying “I just don’t like the way the president just decides to do this unilaterally, it’s not part of the law and it’s not part of the spirit in which this country operates.”
Chaffetz suggested that the White House should have at least given short notice of the operation: “Even if you can’t get to 30 days, at least try to give some sort of notification. There are ways to do that with the Intelligence Committee and others that can be more secretive.”
In response to Obama’s disagreement with the current law, Chaffetz asked, “Why would he sign something into law that he thought was unconstitutional?”

Judge Napolitano: Obama Impeachment Now “A Very, Very Valid Argument”

"Provided material support to a terrorist organization"

Libertarian pundit and and former New Jersey Superior Court Judge Andrew Napolitano has called for the impeachment of the President over the Taliban prisoner release, stating that he has aided the release of the worst terrorists in the world.



“The president may well have committed a federal crime,” Napolitano said, appearing on Fox News Tuesday.
“The president should be impeached for this,” Napolitano added. “In my view, it’s a very, very valid argument that people are going to start talking about.”
Napolitano also noted that compared to Bill Clinton’s Impeachment over “nonsense,” what Obama has done is “far, far more serious.”
“By giving material assistance to a terrorist organization. He knows — ought to have known — that that’s what these guys will do.” Napolitano added.

Napolitano has a point, which is likely why the disgraced outgoing White House Press Secretary Jay Carney refused to even acknowledge that the Taliban is a terrorist organisation during a press conference.



When asked by CNN Chief Washington Correspondent Joe Johns if the President considers himself above the law, Carney quickly fell back on Obama’s “signing statement”, issued when the law in question was first passed. ”To be clear, the 30-day notice requirement has appeared in NDAA bills and in other legislation in this and prior years, and we have repeatedly noted concerns with this requirement, Carney said.
“In signing statements he has — he, the president, has consistently made clear that the executive branch must have the flexibility to act swiftly in conducting negotiations with foreign countries regarding the circumstances of detainee transfers, if necessary. And that was certainly the case here.”
Napolitano noted in a separate appearance Monday “As if a signing statement, a piece of paper he signs at the time he signs the law into existence changes the law. It doesn’t under our system.”
“This is by far the lesser of the two laws that he violated. He and his team violated the federal statute which makes criminal providing material assistance to a terrorist organization. This includes money, this includes ceramic mugs, this includes maps, this includes professional services, and this includes releasing human assets back to a terrorist organization.” the former judge urged.



“President Obama’s Justice Department has successfully prosecuted people for providing material assistance to terrorist organizations and now he himself has done so by letting these five guys loose.” Napolitano added.
“He violated the law by allowing assets to go back to a terrorist organization. You can’t erect a telephone pole, you can’t repair a laptop, you can’t repair a tooth if you’re a dentist for these organizations without violating federal statute.”
Former federal prosecutor Andrew C. McCarthy is in agreement with Napolitano, stating today that “The return of senior terrorists to the Taliban [is] … a high crime and misdemeanor”.

This is a really big deal. Allen West is a well respected war veteran and former U.S Army Lt. Colonel and if he is calling for Obama’s impeachment people will listen.

Why would the United States acquiesce to the demands of a non-state, non-uniform terrorist organization — the Taliban? The Taliban is our enemy and it is not a nation-state with whom we should enter into negotiations. There are some 141 detainees at GITMO. The five released were senior Taliban officials, basically members of Mullah Omar’s inner circle. If we wanted to release detainees in exchange for Bergdahl, there were many others to choose from. Why these?
The rate of recidivism for GITMO released detainees has gone from 1 in 6 to 1 in 3 — and why would we think a one-year travel ban out of Qatar will be respected, or even make a difference with today’s modern communications technology? Even Obama has now stated they may just return to terrorist activity.
Obama’s breaking of the law in this case presents serious national security concerns — for all Americans. This is aiding and abetting the enemy, which goes along with the collusion of this administration with Muslim Brotherhood-affiliated organizations and supplying weapons and arms to Islamists.
Obama just released the leadership of a terrorist organization, and what did we get in return? A deserter, who by his own self-proclamation harbors anti-American sentiments — which it seems that Susan Rice, our esteemed National Security Advisor, didn’t even realize his heinous actions — or maybe as usual she just lied about it again. Bergdahl served the United States with honor and distinction? Let’s not send Susan Rice out ever again.
To hear Obama state that “no American should be left behind” — has he forgotten about Benghazi and Marine SGT Tahmooressi? How about leaving behind American veterans to die?
Ladies and gentlemen, I submit that Barack Hussein Obama’s unilateral negotiations with terrorists and the ensuing release of their key leadership without consult — mandated by law — with the U.S. Congress represents high crimes and misdemeanors, an impeachable offense.
So I call upon the leadership of the U.S. House of Representatives; Speaker John Boehner, Majority Leader Eric Cantor, Minority Leader Nancy Pelosi to draft articles of impeachment as no one is above the law in America. The failure to do so speaks volumes.

If a Republican President had done half the things Barack Obama has done impeachment proceeding would have already started! Obama should be impeached but no one in Washington appears willing or able to stop his lawless actions.

Now before all the detractors go apoplectic here, let me tell you about Article 2 signing statements, their intent, purpose, history, and usage, and the implications for the president’s impeachment.
President Obama used an Article 2 signing statement to deem unconstitutional a measure HE had signed into law contained in the National Defense Authorization Act (NDAA). The law stated that he must advise Congress within 30 days about any plans to transfer detainees from GITMO. Obama basically stated that this was “unconstitutional” and that his unilateral action fell within his purview. Once again Obama used selective discretion as to what law he feels he must adhere to — in this case it has severe ramifications for our national security.

Col Allen West starts off the interview by saying that he and others in the know have known since 2009 or 2010 that Bowe Bergdahl was a deserter. He was not a POW and they knew the circumstances including non-disclosure agreements that members of his platoon had been forced to sign.
West says this whole episode was not about a swap, it was about a release of five senior Taliban members.
In regards to the non-disclosure statements, West says “you can simply order a soldier to sign something, but now that this has been, you know, but now that this has been rectified and Bowe Bergdahl is back in the hands of the American authorities or people, these soldiers are coming out and they’re telling the truth about what happened.”
He thinks the timing of early Saturday morning was deliberate to minimize scandal while still helping to divert some attention away from the VA scandal.



The host repeats a description of the five as the terrorism “dream team” and west concurs, offering more insight into just who these people are.

Col West says it’s time. The articles of impeachment need to be drawn up.

Tuesday on NewsMax TV, former U.S. Marine Corps Lt. Col. Oliver North said U.S. Army Sgt. Bowe Bergdahl was not a prisoner of war because he was actually being held “hostage” by the Haqqanis, a terrorist group separate from the Taliban and associated heavily with al Qaeda.

North said he knew there was at least a $1 million dollar ransom being demanded for Bergdahl some time ago so he estimated the price paid to release the hostage must be close to $5-6 million now.
“Someone paid a ransom,” North said. “Whether the Qataries paid it, or some big oil sheik, or somebody used our petrodollars, but there was a ransom paid in cash for each one of them, my guess somewhere in the round numbers of $5 or 6 million to get Bergdahl freed. I know that the offer that was on the table before was close to a million.”

He may agree with him politically, but George Washington University Law School professor Jonathan Turley expressed how troubling it is that our President is willing to act unilaterally and how Obama is forming what he calls “an imperial Presidency.”
Turley claims that we are at a constitutional tipping point because the President is not willing to comply with the rule of law, which is a threat to our individual liberty. The law professor says he’s seen this kind of power-grab before, and makes the dreaded comparison.

You know, I’ve said it before, Barack Obama is really the president Richard Nixon always wanted to be. You know, he’s been allowed to act unilaterally in a way that we’ve fought for decades.

Just for a refresher course, President Richard Milhous Nixon (by all eyewitness accounts a white president), resigned in disgrace over a two-bit break-in of a DNC office referred to as the Watergate scandal.
Obama’s resume makes this “scandal” look laughable, indeed:

• The transnational gun-running operation “Fast and Furious,” which resulted in the wounding or killings of at least one American and hundreds of Mexican citizens;
• The ongoing cover-up of the terrorist attack at Benghazi, which resulted in four American deaths without even a rescue attempt;
• The IRS’ admitted targeting of American citizens for their religious and political views;
• The Justice Department’s singling out of news reporters at the AP and Fox News for surveillance;
• The NSA’s illegal ongoing surveillance of Americans in violation of Fourth Amendment protections;
• And finally, the president’s illegal transfer of 5 highly dangerous terrorists held at Guantanamo Bay for a suspected American military deserter.

Of course, these are just the major scandals. We’re not even talking the daily illegalities like refusing to enforce immigration law, abusing the EPA while ignoring Americans’ representation through Congress, it goes on and on…
