Illegal Alien Who Went Home Demands to Be Let Back In

On Tuesday, Rafael Gaytan is expected to turn himself in to the Border Patrol at the border between Tijuana and San Diego, in hopes of being reunited with his family in central Florida.
Gaytan was an illegal immigrant who returned to Mexico three months ago to take care of his ailing sister. According to Young American Dreamers, an immigrant-rights advocacy group, Gaytan's only option is to turn himself in to Border Patrol if he wishes to rejoin his family in the U.S., in hopes that the Obama administration would release him and grant him "parole." The head of Young American Dreamers said that Gaytan could have exited and re-entered the U.S. legally if President Obama's 2014 executive amnesties had not been blocked in court. Gaytan entered the U.S. illegally ten years ago, where his sons were born. Thus, he would qualify for the Deferred Action for Parents of Americans (DAPA) amnesty.
Gaytan's wife says that her husband is a "good man" and a "business owner who provides jobs." And, under the current administration these assertions seem to be sufficient grounds to circumvent the immigration laws.
It is often asked why people continue to come to the U.S illegally. The answer is simple: because they can. Rafael Gaytan's stunt is a prime example of the brokenness of our immigration system. It has become a system which literally waves in illegals across the border.

No Illegal Alien Left Behind

Last year, the Obama administration reached a settlement that allows certain former illegal immigrants to return to the U.S. An agency in Mexico announced a campaign over the weekend to ensure that as many people as possible take advantage of it.
In 2013 the American Civil Liberties Union (ACLU) and the government of California filed a class action lawsuit on behalf of nine Mexican nationals and three immigrant advocacy groups. The complaint in Lopez-Venegas v Johnson alleged ''that as a matter of regular practice, Border Patrol agents and ICE officers pressure undocumented immigrants to sign what amount to their own expulsion documents,'' formally known as "administrative voluntary departure.'' This is commonly referred to as ''voluntary return" and is an alternative to appearing before a judge and being formally deported.
Last year the Obama administration settled the lawsuit, allowing illegal immigrants who had signed voluntary departures "under coercion" to return to the U.S. This settlement applies to those who left the U.S. between the June 8, 2009, and August 28, 2014.
On Sunday, Mexico's National Human Rights Commission (known by the Spanish initials CNDH) announced that it will distribute informational material about the settlement to encourage as many former illegal immigrants as possible to return to the United States. It is unclear why the CNDH decided to publicize this now.
The CNDH was originally an office within the Interior Ministry and has since become independent, though its head is appointed by the Mexican Senate. In 2006, the commission announced a plan to distribute maps to help people sneak across the border into the U.S.; the plan was dropped amid the ensuing controversy.
The commission said it began circulating information about the opportunity for former illegal immigrants to return to the U.S. in the state of Oaxaca, and has expanded to Sonora, Tamaulipas, Chiapas, Tabasco, Baja California, San Luis Potosi, Chihuahua, and Veracruz.
The CNDH indicated that the informational material will be distributed in strategic locations, especially those with a lot of traffic towards the U.S. In Veracruz, the commission is collaborating with the state government's Migrant Service Office to distribute the information to all the municipalities, in hopes of reaching as many people as possible.

The second group of Mexicans to be let back into the U.S. after having agreed to voluntary return to Mexico "under coercion" are expected to arrive on at the border on Tuesday (pending additional cases to be approved by U.S. government). Esmeralda Flores of the American Civil Liberties Union told Univison the three Mexican nationals will first hold a press conference in Tijuana tomorrow.
At the end of August a group of six illegal Mexican immigrants who had been removed were also allowed to return as a result of a 2014 lawsuit settlement by the Obama administration. The settlement allows illegal immigrants who had signed voluntary departures "under coercion" between June 8, 2009, and August 28, 2014 to return to the U.S.

It's disgusting. They should go to Central Florida and round up all the illegals in his family and deport them all.

Father, Trying to Reunite With Family, Makes Final Effort to Cross Border

Rafael Gaytan has lived in the U.S. illegally for nearly 20 years. Recently, he had to return to Mexico for a family emergency. Now, he is hoping to cross the border into the U.S. again, speaking with U.S. Border Patrol officials at the San Ysidro Port of Entry. NBC 7’s Chris Chan reports. (Published Tuesday, Oct. 6, 2015)
A man who left his family in Florida, where he'd been living illegally, to return to Mexico for a family emergency tried and failed to re-enter the U.S. Tuesday after asking officials to consider him for humanitarian parole.
Rafael Gaytan, a Mexican national, lived in Florida with his family for more than 10 years without legal permission. Three months ago, Gaytan had to leave the country to take care of his ailing parents and dying sister.
At the time, Gaytan would have been eligible for a permit as the parent of two American citizens under President Obama’s Executive Order, Deferred Action for Parents of Americans (DAPA), according to several non-profit humanitarian organizations helping him. The order would have given him temporary immigration status, but a federal judge issued an injunction this year preventing Gaytan and many others from obtaining that temporary legal status.
Gaytan has been unable to return to his family in Florida, but on Tuesday he decided to give it one last shot, with the help of the Border Angels of San Diego and Young American Dreamers organizations.
With the help of his friend Bishop Dermot Rodgers and Daniel Barajas, executive director for the Young American Dreamers, Gaytan began the process of crossing into the U.S. at the San Ysidro Port of Entry.
“He’s clearly quite terrified right now,” said Rodgers, who guided Gaytan through part of the process. “He’s exhausted, he’s emotionally drained, his children are on the phone crying even as we speak. They just want to see him.”
Gaytan ask border officials for humanitarian patrol, which allows some people to cross the border for emergency reasons. However, after more than two hours of interviews, officials turned Gaytan away and said he made a mistake in leaving the U.S. to begin with.
Border Angels of San Diego’s Sara Gurling said his children are “shattered.”
Gurling said it is unclear whether he will attempt to cross the border again, or what his next move will be. He plans to discuss it with his family.
