    ”A group of immigrants who are living in Georgia without legal status filed suit against Georgia’s Department of Driver Services in federal court Monday, accusing the state agency of violating their constitutional rights by denying them driver’s licenses."

    Now this is very special, “…violating their constitutional rights by denying them driver’s licenses.”

    The fact is, each state has exclusive authority to create its own “privileges” which are exclusively for citizens of their own state. And driver’s licenses just happen to be one of those “privileges”.

    It should also be noted that the 14th Amendment, by its very language, confirms each State may make distinctions between “citizens” and “persons” when regulating and enforcing its laws!


    The 14th Amendment declares that “citizens” of the United States are guaranteed the “privileges or immunities” offered by the state in which they are located. But those who are not “citizens of the united States” and referred to as “persons“ (which would include those who have entered a State or the United States illegally), are not entitled to the “privileges or immunities“ which a state has created for its “citizens“.


    The 14th Amendment only requires that “persons” may not be deprived of life, liberty, or property without the benefit of the state’s codified due process of law being applied to them equally, as it is applied to all other “persons” within the state in question.

    The lawsuit contends that because the federal government has given them work permits and Social Security numbers, they are legal residents. Georgia has decided to rejected this absurdity and will not issue driver’s licenses to illegal entrants living in their State.

    And one of the mind numbing arguments these illegals entrants from Mexico and Central America are giving is, it makes it harder for them to take jobs away from American citizens without a driver’s license.


    While millions and millions of America Citizens have been squeezed out of jobs by illegal entrants who work off the books, below the going wage and do not pay taxes on their earned wages, they have the audacity to now demand driver’s licenses so they can take more good paying jobs away from American citizens in the construction trades.

    A group of immigrants who are living in Georgia without legal status filed suit against Georgia’s Department of Driver Services in federal court Monday, accusing the state agency of violating their constitutional rights by denying them driver’s licenses.

    The lawsuit says the plaintiffs — not named in the court papers because of “safety concerns” and “possible retaliation” — have been ordered deported and are seeking to have their removals suspended or whose home countries won’t accept them back. The federal government has issued them work permits and Social Security numbers, indicating they are legally present in the U.S. Historically, such people have been able to obtain driver’s licenses in Georgia, according to the lawsuit. But the state started rejecting them this summer, saying they are “not legally in the United States.”

    Citing data from various policy groups, the lawsuit says there are tens of thousands of such people living in the U.S. The lawsuit accuses the state agency of violating their Equal Protection rights.

    The Department of Driver Services declined to comment.

    “There is no rational basis for the policy, or even any benefit to the state of Georgia as a result of the policy,” says the lawsuit, filed by Taylor, Lee and Associates, a Norcross-based immigration law firm. “Indeed, if anything, the refusal to issue driver’s licenses to this group of immigrants costs the state of Georgia millions of dollars in lost administrative fees from potential registered drivers.”

    This year, a bill that would block state driver’s licenses for immigrants who have been granted a special reprieve from deportation stalled in the state Legislature. In January, a federal judge issued an injunction, blocking Arizona from denying state driver’s licenses for immigrants who have been granted deportation deferrals through the Deferred Action for Childhood Arrivals program.

    Illegal immigrants sue Oregon over ballot measure denying licenses

    A group of illegal immigrants is suing the state of Oregon to overturn a voter-approved initiative that denied them driver’s licenses.

    The lawsuit, brought by five illegal immigrants, comes after Oregonians passed Measure 88 last year with a strong two-thirds majority. Thirty-five of Oregon’s 36 counties voted against licenses for undocumented residents, as did every congressional district in the state, most of which are represented by Democrats.

    But the lawsuit alleges Measure 88 is unconstitutional because it "arbitrarily" denies driving privileges based on membership in a "disfavored minority group." It alleges Oregon voters were motivated by "animus toward persons from Mexico and Central America."

    Gustavo Recarde, who has worked construction and odd jobs in Portland and several states since sneaking into the United States in 1988, said a driver's license would help him feel more comfortable here and open doors.

    "If an illegal [can] get a driver's license, it would be better because there's more opportunities to find a job as a driver," said Recarde, who is not part of the lawsuit. He said he believes race played a role in the vote.

    But Cynthia Kendoll, president of Oregonians for Immigration Reform, said it's not the responsibility of Oregonians to make illegal immigrants comfortable or able to drive to jobs they don't legally have.

    "They came here by choice, they weren't brought here against their will, and with those choices come hardships," she said.

    Measure 88 was a public vote and a reaction to a law passed by the Oregon Legislature in 2013 and signed by then-Gov. John Kitzhaber, a Democrat, that would have given "driver's cards" to those who cannot prove they are in the U.S. legally.

    The campaign to deny licenses won big despite being outspent 10-to-one.

    "People were not swayed by their arguments that they deserve to have a driver's card so they could more easily get to their jobs," Kendoll said. "They're not supposed to be working here."

    Kendoll said Oregonians were motivated by national security and drug-smuggling by Mexican cartels, not race. Those without papers have not gone through immigration checks, she said, and licenses make it easier to transport narcotics up and down the West Coast.

    Norman Williams, associate dean for academic affairs at the Willamette University College of Law in Salem, said the plaintiffs’ best argument is under the U.S. Constitution's Equal Protection Clause – and to claim Oregon has no rational basis for depriving undocumented Latin Americans of the ability to drive on Oregon's roads.

    "The U.S. Supreme Court has been clear that neither legislators nor voters may target a minority group because of their race or ethnicity," he said.
    The plaintiffs -- five illegal immigrants identified only by their initials -- don't have to prove every Oregon voter was racially motivated, he said.
    "They do have to establish there were enough voters who voted 'no' who were prompted to do so because of racial concerns, that could have tipped the balance," he said.

    Still, Williams said they face an uphill battle.

    "Federal judges are very hesitant to strike down state statutes on constitutional grounds," he said.

    I heard that a judge tossed the illegal aliens court challenge in Oregon which is good news.

    But this here...

    The federal government has issued them work permits and Social Security numbers, indicating they are legally present in the U.S.
    That is Obama's unlawful orders that two federal courts have ordered halted!

    Illegal Aliens Sue to Drive, Claim Discrimination of “Disfavored Minority Group”

    Borrowing a play from the Obama administration’s extensive race-card repertoire, illegal immigrants claim in a federal lawsuit that a ballot measure denying them driver’s licenses is discriminatory because it’s based on membership in a “disfavored minority group.”

    About a year ago Oregonians overwhelmingly voted against Measure 88, which would have provided special driver cards to illegal aliens. Voters throughout the state, which is largely represented by Democrats in Congress, fiercely rejected the initiative 983,576 to 506,751, according to election results from the Oregon Secretary of State. All of Oregon’s 36 counties voted against Measure 88 by significant margins, the figures show. Measure 88 was put on the ballot after Oregon legislators passed a controversial law in 2013 directing the Department of Transportation to give illegal immigrants who have resided in the state for more than a year a special driver card.

    Disregarding the clear intent of Oregon’s U.S. citizens, a group of five Mexicans, identified only by their initials in court documents, are suing the state for—get this—violating their civil rights by denying them driving privileges. Governor Kate Brown is also named as a defendant in the complaint and so is the director of Oregon’s Department of Transportation and the director of the agency’s driver and motor vehicle division. Two immigrant right groups called Familias En Acción and Los Niños Cuentan (Families in Action and Children Count) have joined the Mexican illegal aliens as plaintiffs in the case.

    They accuse Oregon officials of violating the U.S. Constitution by “arbitrarily” denying them and other illegal immigrants driving privileges simply because they belong to a disliked minority group. Measure 88 was “motivated in substantial part by animus toward persons from Mexico and Central America,” the lawsuit alleges, further stating that the ballot initiative “was an improper attempt by the State of Oregon to regulate immigration.” The two Latino rights nonprofits claim that, if driver cards were available to the illegal aliens they serve, they’d be able to help more individuals and families. The complaint fails to offer how the groups’ rights are violated by not giving illegal immigrants licenses.

    About 84,000 illegal immigrants have already been stripped of driving privileges, according to the lawsuit which asserts that they were singled out as an “unpopular minority for disparate treatment in violation” of the U.S. Constitution. Tens of thousands more who live on Oregon can’t prove legal status in the U.S., the complaint reveals, and they will suffer societal, economic and health-related disadvantages if they’re not allowed to drive. The ban will prevent illegal aliens from “exercising their liberty interest in operating a motor vehicle for a lawful purpose,” the complaint states.

    This is hardly the first time we’ve seen illegal immigrants use the American court system in an effort to strong arm public agencies to give them rights. A few years ago Judicial Watch reported on a Nebraska case involving an illegal alien who sued the state for “unconstitutionally” denying her a driver’s license. Represented by the notoriously leftist Mexican American Legal Defense and Educational Fund (MALDEF), the 24-year-old woman claimed that she had the right, under the U.S. Constitution, to drive because she was protected by one of President Obama’s amnesty programs. In other cases over the last few years, illegal immigrants have sued various government agencies—at the federal, state, county and city level—for violations of “constitutional rights” and discrimination. In 2013 illegal aliens even demanded that American taxpayers finance their organ transplants!

    U.S. District Judge Laurie Smith Camp said she dismissed the case because Saldana’s lawyers didn’t provide sufficient evidence showing that the DMV has not consistently followed its policies when issuing licenses to individuals granted deferred action, as Saldana alleged.


    The judge dismissed the case with prejudice, meaning it can’t be brought back to the court.”
