    Wording is everything in those kinds of letters, and apparently they did not word it in a good way.

    What should have been said was "all adults must submit proper identification, be able to pass a criminal screening and have a valid Social Security number, those unable to comply to all three will be given thirty day notices". This letter should have been stated like this as well as sent to all tenants in all units thus making it a non-discrimination issue.

    Call it "skirting" or whatever people like, but there are ways to put things so it is no longer arguable. In Oregon a landlord can give a thirty day "no-cause" notice and the tenant cannot argue it once given.

    There is always citizen arrest. The owner can ask for an accounting of each person there. They can state within a rental agreement that only 2 or 3 adults may live in the apartment and that they must have SS#, references, etc in order to live there. Once it is OK'd the rental agreement that is signed by the tenant and the landlord will actually state the names of the occupants and even a name of a pet if allowed. Once any of those are breached they can be evicted. Once they have more people in the apartment, or different people in the apartment they can be evicted.

    Landlords have to get very specific these days.

    I don't believe they really have a case against him since he did not state that anyone of a certain nationality cannot live there. Only someone who is not here legally. In other words, he does not want to aid and abet an illegal which could put him in prison. He needs a good lawyer. I'll bet the illegals will leave on their own accord because once they file a case, then ICE will know for sure they are illegal and can raid.

    State law plus what's in the lease determines when and if a landlord can terminate a tenancy. Word it correctly, and it doesn't matter what your reason was, they won't have a leg to stand on.

    Well here in Oregon, the landlord can do background checks, use SSNO to do those checks and if a valid ID and SSNO cannot be provided to them, they do not have to even consider the rental application.

    This also applies to someone who is taking on a rommate as well. So let's say a family who is living there, takes on an adult relative, that relative MUST provide ID and a SSNO in order for checks to be done, if they either cannot provide valid cards, or they cannot pass the screening process, the landlord can say no to them moving in with the tenants.

    As well if this family still has them move in, which would then be a breach of their rental agreement, then the entire family could get evicted.

    Not only would following the laws within each state, to help eliminate rental options for illegal aliens, it also protects those of us living in complexes, to be assured the neighbors we have are not pedophiles or violent criminals.

    This means that when a law exists that guarantee rights to illegals, then those laws had better be enforced or there's hell to pay. But any laws which they don't like, for example, immigration, DUI, welfare fraud, driving w/o licenses or insurance, etc., well, those laws don't benefit illegals, so they can choose to ignore those anytime they wish.

    it would seem to me that a lease on an apt or house can be voided when there are excessive complaints or anything that might be considered in violation of any written agreement.

    id think if you found 20 in a two bedroom apt. that it can be one of those reasons to void an agreement and make someone move

    Not sure how different laws across the U.S. are in each state as it refers to rentals, but here's sort of a condensed version of Oregons laws.

    Most landlords here rent month to month, because in Oregon a lease is binding and month to month can be terminated anytime without cause so long as a 30-day notice is given.

    90% of apartment complexes are corporately owned and will check background and such, however......many have become staffed with those who identify with the main population of illegals here, Latino illegals. This means that they will pass someone through who normally would not have been accepted by an American manager. Those privately owned complexes usually do not check a whole lot. However, on the flip side of that, they can get caught and fired.

    In Oregon, ANY good landlord will screen their tenants and keep track of the amount of people in the units. Most willl have clear rules which pertain to state and county laws, which are put in place for safety purposes. Most landlords/managers WILL give notices for violations of those rules, including unauthorized "guests" (those in the unit more than two weeks without a background screening done).

    A landlord can evict a tenant at anytime they choose here, and even if the tenant is in the right, they will likely be on the streets before they can prove the landlord was in the wrong. Getting financial satisfaction after the fact here, through the courts from the landlord, is really tough to do. Thus, many illegals here will rent from slumlords and/or buy up old mobile homes in slummy mobile home parks. This way they avoid vigilant landlords.

    Oregon actually has little protection for renters. This has probably been one reason why illegals do not come up here in the numbers they do elsewhere. Word gets around about this kind of thing.

    I think the above summary of Oregons pale renters rights has been one of the reasons we have staved off illegal aliens in the numbers other states have seen them.
