    DOJ files suit against company for allegedly not hiring Americans

    The Department of Justice announced Thursday it has filed a lawsuit against a Colorado corporation for allegedly discriminating against U.S. workers.

    The complaint alleges that in 2016, Crop Production discriminated against at least three United States citizens by refusing to employ them as seasonal technicians in El Campo, Texas, because Crop Production preferred to hire temporary foreign workers under the H-2A visa program.

    “In the spirit of President Trump’s Executive Order on Buy American and Hire American, the Department of Justice will not tolerate employers who discriminate against U.S. workers because of a desire to hire temporary foreign visa holders,” Attorney General Jeff Sessions said in a statement. “… Where there is a job available, U.S. workers should have a chance at it before we bring in workers from abroad.”

    This is the first complaint filed stemming from the “Protecting U.S. Workers Initiative,” which was launched on March 1.

    A Civil Rights Division official told Fox News that since the initiative’s launch, the division has opened 29 investigations of “potential discrimination against U.S. workers based on a hiring preference for foreign visa workers.”

    DOJ officials also told Fox News the department has reached at least one settlement with a company discriminating against U.S. workers in favor of foreign visa workers, and distributed over $100,000.

    Discrimination against American Workers is exactly what it is, too. It's a grotesque violation of our civil rights, protected by the US Constitution and the 14th Amendment.

    Sessions’ DOJ to Sue Colorado Corporation for Hiring Foreigners over Americans

    U.S. Attorney General Jeff Sessions’ Department of Justice (DOJ) said it will file suit against a Colorado corporation accused of hiring foreign workers over Americans. It will be the first-ever lawsuit based on President Trump’s ‘Buy American, Hire American’ executive order.

    In a statement by Sessions, the DOJ announced it file a lawsuit against Crop Production Services, Inc. The company is based in Loveland, Colorado. The DOJ will claim the company discriminated against American workers in violation of the Immigration and Nationality Act.

    “In the spirit of President Trump’s Executive Order on Buy American and Hire American, the Department of Justice will not tolerate employers who discriminate against U.S. workers because of a desire to hire temporary foreign visa holders,” Sessions said in a statement. “The Justice Department will enforce the Immigration and Nationality Act in order to protect U.S. workers as they are the very backbone of our communities and our economy. Where there is a job available, U.S. workers should have a chance at it before we bring in workers from abroad.”

    In 2016, according to the DOJ, Crop Production discriminated against at least three American workers in El Campo, Texas, by refusing to give them jobs in seasonal positions. The company instead, awarded those jobs to imported foreign workers who came to the U.S. on the H-2A visa program.

    The DOJ also says Crop Production hit American workers with tougher job requirements than they did foreign workers on H-2A visas in order to discourage Americans from taking jobs at the company’s Texas facility. According to the DOJ, American workers were forced to complete background checks and drug tests, while the imported foreign workers were allowed to begin working before completing either of the job requirements.

    The DOJ complaint alleges that Crop Production refused to hire an American worker who had limited English-speaking abilities and instead hired foreign H-2A workers who did not speak any English. Crop Production gave all of its U.S. jobs in 2016 to foreign H-2A workers, rather than Americans.

    Sessions’ suit against Crop Production is looking to get back pay for the American workers, as well as hitting the corporation with civil penalties and other regulations to prevent discrimination of Americans. The three American workers allegedly discriminated against have also filed a private lawsuit.

    The Immigration and Nationality Act explicitly prohibits employers from discriminating against American workers solely for their citizenship status while favoring foreign workers who enter the U.S. on guest worker visas.

    Attorney General Jeff Sessions’s Department of Justice (DOJ) settled a case with a Colorado corporation that imported foreign workers instead of hiring Americans, winning the affected U.S. workers the money they had lost without those jobs.

    In a settlement with Crop Production Services, Inc. out of Loveland, Colorado, American workers who were passed on by the corporation in favor of employing foreign workers will receive a settlement of $18,738.75 each, according to the DOJ.

    The corporation must also pay civil penalties of $10,5000 to the U.S. while undergoing DOJ training on the anti-discrimination measures of the Immigration and Nationality Act. Crop Production, as a term of the settlement, will additionally have to comply with DOJ monitoring and reporting requirements.

    “There will be zero tolerance for companies that violate the Immigration and Nationality Act by hiring foreign visa holders over U.S. workers,” Acting Assistant Attorney General John Gore of the Civil Rights Division said in a statement. “The Division’s Protecting U.S. Workers Initiative is committed to fighting discriminatory hiring practices that prevent qualified U.S. workers from obtaining jobs, and we commend Texas RioGrande Legal Aid for bringing this matter to our attention.”

    Every year, thousands of foreign nationals are allowed to enter the U.S. to take agricultural jobs under the H-2A visa program. For more than a decade, the H-2A visa program has allowed for Americans to have their blue-collar wages driven down or remain stagnant.
