    Lone Protester- Not a Defendant Any Longer

    It had been 1 1/2 years since I was arrested and 11 months since my trial and I have the distinct honor of giving ALIPAC the latest update on my case.

    My lawyer filed legal paper work this week in the Fifth Judicial Circuit Court. This time around I am the plaintiff and not the defendant. The defendants are the City of Columbia, Richland County, the police officer who violated my rights and the homeowner that I embarassed by accusing him of employing illegal aliens. The complaint is negligence, civil rights violations and intentional torts.

    All 4 entities are facing 6 charges- malicious prosecution, abuse of process, assault and battery, false arrest and imprisonment, civil conspiracy and violation of my constitutional rights. If found guilty the officer and homeowner face a $2000 fine and/or 5 years in prison. My lawyer and I have requested a jury trial and have not received a court date yet. I just have to say that this is one trial I am definitely looking forward to, unlike the last 6 times. This time around I am going to sit there and watch justice be meted out to the real crook in my case, the homeowner. This guy looked me in the eye and told me that if I wanted to do the work on his new home that my bid had to be as low as his international roofers who made 4 to 5 dollars an hour. He won't be tried for that crime but the 6 charges he is facing is guaranteed to make hime lose a lot of sleep just like I did.

    The thing I regret is not being able to make the prosecutor in my trial last year a defendant also because he exceeded the limits of his power on several different occasions. I also wanted the Columbia Police Dept. as a separate defendant but the court said that they fall under the city and county and will have representatives in the court room.

    So wish me some luck ALIPAC because the shoe is on the other foot this time and an American who had the temerity to actually challenge the employment of illegal aliens by a so called American citizen is going to get a little bit of justice, finally.

    Thank God for people like you. You have all my respect and admiration. Powerful movements often start or gain major momentum with one important case, (i.e. Rosa Parks - Civil Rights movement). Thank-you for not giving up, or being too cowardly to confront the opposition, unlike our pathetic, cowardly politicians afraid to even speak the truth or facts.

    It is the homeowner's responsibility to make sure any work done on his/her property is done by a licensed contractor, otherwise if the work is not done to code there is no legal recourse for the homeowner.
    After any disaster there are scam artists that show up offering cheap labor that are unlicensed, as I know from Hurricane Andrew in Homestead FL and Hurricanes Charley and Wilma in SW FL. And from what I have read that New Orleans, after Katrina, was swarmed by illegal day laborers. I have always taken a tough stand on any company bidding on a job: if you send me workers that don't speak English, I will throw them off my property and your contract is automatically cancelled.
    Good luck, and I hope your lawyer is able to get the legal work status of the employees of those who bid against you with this homeowner.
