Man to be charged with first-degree murder in connection with rape, death of 93-year-old

    Sergio Martinez-Perez

A teenager will now face first-degree murder charges in connection with the rape and death of a 93-year-old South Omaha woman.

Autopsy results indicated that Louise Sollowin died of complications due to blunt-force trauma to her head and body, according to Douglas County Attorney Don Kleine.

Sergio Martinez-Perez, 19, who had faced first-degree sexual assault charges, will be arraigned on the murder charges in Douglas County Court at 1 p.m. Friday, Kleine said.

The county's top prosecutor said he is charging Martinez-Perez under Nebraska's felony-murder rule, which applies to deaths that occur in the commission of another crime such as sexual assault or burglary. As such, Martinez-Perez will not face a separate first-degree sexual assault or burglary charge.

Omaha police say they found Martinez-Perez naked and on top of Sollowin. He had beaten her, sexually assaulted her and broken several bones in her face – and blood covered the room, authorities allege. Sollowin's relatives were reeling Thursday at her death at the Nebraska Medical Center the day before – four days after the attack carried out by a man she did not know.

“Her body was so completely beaten up,” Joe Sollowin III, Louise's son, said Thursday. He said he had figured his mother would live forever, as she was one of the few in the family who never touched alcohol or cigarettes.

“My mother was a saint,” Joe Sollowin said. “This is beyond words. ... It's horrendous.”

Louise Sollowin spent 50 years helping her sister fire up the oven at Orsi's Italian Bakery, where her love of the family business kept her going well into her 80s. She worked at the bakery until about 10 years ago, when her weakening eyesight forced her to retire.

Sollowin baked and cleaned, chatting almost exclusively in Italian with her sister, Frances Orsi, whose husband, Claudio, ran the bakery for decades. Sollowin's husband, Joe, did the books.

“I grew up there,” Joe Sollowin said. “Family's family. You helped out no matter what.”

Sergio Martinez-Perez, 19, beat and raped Sollowin because he had been drinking much of the previous night and was “angry with women,” a prosecutor told a Douglas County Court judge Wednesday.

Martinez-Perez told police that he beat and raped the victim, the prosecutor said.

Police said they found him in the house, where Sollowin had lived for 71 years. When they arrived, Martinez-Perez was nude and on top of Sollowin in her bedroom. There was blood on the walls and ceiling. On the floor and on the bed.

Judge Thomas K. Harmon ordered Martinez-Perez, who is charged with first-degree sexual assault, first-degree assault and burglary, held without bail.

Martinez-Perez, who has no permanent address, told Harmon through an interpreter that he has been working in the area as a roofer.

Sollowin's family said a detective told him that Martinez-Perez had been living in Omaha for four months.

U.S. Immigration and Customs Enforcement has asked the jail to hold him, an official there said. That is often an indication that the federal agency is questioning an inmate's immigration status. Authorities had not released Martinez-Perez's immigration status as of late Thursday morning.

Martinez-Perez entered the woman's home at 1921 S. 10th St. through an unlocked door, the prosecutor said. He allegedly beat and raped her before falling asleep on top of her about 9 a.m.

Sollowin's daughter, who had returned to live with her mother earlier this year, heard Sollowin's calls for help and found the man when she went to investigate.

“My mom pushed him away from her,” granddaughter Teresa Hartzell said.

Hartzell said her mother could not believe someone was in the house. She thought it may be a dream.

“It was just such a brutal and senseless thing,” Hartzell said, recalling the memories inside the home.

Hartzell remembered the boisterous conversations that are often the hallmark of large Italian families like hers.

“A lot of memories,” she said of the home on 10th Street.

    She paused.

    “Not so good ones now.”

RAPED AND BEATEN 93-YEAR-OLD WOMAN DIES AFTER MAN — WHO MAY BE AN ILLEGAL ALIEN — FOUND NAKED, PASSED OUT, AND LYING ON TOP OF HER

    Jul. 26, 2013 11:49am Dave Urbanski

A 93-year-old woman was raped and beaten to death, and a 19-year-old man—who may be an illegal alien—was charged with her murder after being found naked, passed out, and lying on top of the blood-covered victim, Omaha police say.

Douglas County prosecutors charged Sergio Martinez-Perez with first-degree murder Thursday after Louise Sollowin died of her injuries Wednesday. The incident occurred Sunday in the bedroom of the south Omaha house Sollowin had lived in for 71 years, according to the Journal Star.

Prosecutors say Martinez-Perez admitted assaulting and raping Sollowin after entering her home through an unlocked door, saying he was “angry with women” stemming from a night of drinking, theJournal Star added.

    More from the Journal Star:

The murder charge Douglas County Attorney Don Kleine filed Thursday will be added to the first-degree sexual assault, first-degree assault and burglary charges against Martinez-Perez. He is scheduled to be arraigned Friday.

Kleine said the murder charge applies to this case because Nebraska law allows murder charges when a victim dies as a result of the commission of another felony, such as rape.
Martinez-Perez had been working as a roofer and has no known ties to Omaha, police said. Douglas County jail officials said federal immigration officials have placed an immigration hold on Martinez-Perez, an indication that authorities believe he may be in the country illegally.

Sollowin’s daughter, who lived with her mother, heard Sollowin’s calls for help and found the man when she went to investigate, Sollowin’s granddaughter, Teresa Hartzell, said.
“It was just such a brutal and senseless thing,” Hartzell said.

Louise Sollowin grew up in Omaha’s Little Italy community, where her family started Orsi’s Bakery. Her husband, a World War II veteran, died about 30 years ago, Hartzell said.

New Details About Accused Murderer, Perez, Uncovered

    By Jake Wasikowski
    CREATED AUG. 12, 2013

Prosecutors are seeking the death penalty for Sergio Perez, accused of killing a 93-year-old woman.

Omaha, NE -- He's accused of raping and beating an elderly woman, who died days later. KMTV Action 3 News learns more about the suspect, Sergio Perez. He’s pleading not guilty in Douglas County Court.

Shortly after his arrest, police only said Perez was an illegal immigrant. He didn't have an address, and the jail listed him as a floater.

KMTV has learned he has used a different name, Sergio Arciniega Ramirez. Prosecutors amended their information to include his alias.

"We gave that name to the police department because we want to have as much background as we can on someone we have charged with a crime for all kinds of reasons," said Douglas County Attorney Don Kleine.

On Perez’s Facebook page he posted a picture on June 27th, three weeks before the murder. It shows Perez, an illegal immigrant, working on a roof on a home near 168th & Giles Rd. KMTV did contact the roofing contractor who confirmed that they did work on the home. They say they did not, nor their sub-contractor hire Sergio Perez or his alias.

Just as the Douglas County Attorney’s Office and OPD will investigate Perez for his criminal action, federal prosecutors could also file charges for those who hired Perez.

"There's other issues that are created by that. There are immigration issues, federal issues that are dealt with by Immigrations and Customs so the U.S. Attorney's Office will be handling those kinds of issues but certainly it's frustrating," Kleine explained.

The ICE Homeland Security Investigations Dept. said they do conduct investigations and worksite enforcement to protect the nation's labor force. But they couldn't confirm or deny an investigation into this situation because they don't want to reveal any business’ name that hasn't done anything wrong.

Sergio Perez is charged in the beating death and rape of a 93-year-old woman at her South Omaha home in July. Perez admitted to authorities he had been drinking the night before and was mad at women. Louise Sollowin's daughter found Perez naked on top of her bloodied mother the morning after the attack.

Police now tell us they've learned Perez had been apparently drinking the night before at someone's house. Prosecutors are seeking the death penalty.
