    MORRISTOWN -- A 19-year-old illegal immigrant from Honduras, allegedly angry after being kept out of a party, has been arrested and charged with aggravated arson in the Sussex Avenue fire that injured a firefighter last week.

    Fernando Inestroza, who had been living to next door to the house that caught fire, allegedly was barred from entering an upstairs apartment where a party had been going on much of the night before using a burning piece of paper to start the fire, according to an arrest affidavit. The fire began in a plastic garbage can on a second-floor wooden deck at the rear of the building, according to the affidavit.


    Inestroza was arrested on Tuesday in East Orange, where he had been staying since the fire, Morris County Prosecutor spokesman Capt. Jeff Paul said in a prepared statement issued on Wednesday.


    Meanwhile, town officials have issued a total of 35 summonses to the landlords and one tenant of the house at 50 Sussex Avenue for allegedly violating overcrowding and other ordinances. Town officials had said last week that they found as many as a dozen mattresses in the upstairs apartment where the party took place, and where the fire began.


    Zofar Svirski, one of the landlords, told the Daily Record last week that he was unaware any of his apartments were overcrowded, saying he required his tenants to sign a no-stacking agreement.


    Inestroza is an undocumented immigrant from Honduras and had a detainer placed on him by the U.S. Immigration and Customs Enforcement Services, according to Morris County jail records. That means even he was able to make bail, which had been set at $500,000, he would be handed over to ICE.


    Det. Christopher Kimker of the Morris County Prosecutor’s Office said in an arrest affidavit signed on Tuesday that the suspect confessed he had been drinking, and was upset after being denied entrance to a party in an upstairs apartment. He allegedly ignited a piece of paper found in a garbage can with a disposable butane lighter. Residents of the apartment smelled smoke 10 minutes later, according to the affidavit.

    This was just a simple party that caused this Ia to burn down a house.

    How much violence are we going to witness once the little light goes on and they discover that there will be no amnesty and there will be no dream act............

    Deportations will be the order of the day.

    Deport all illegal aliens, NO "path" to citizenship for illegal aliens, end ALL guest worker permits, no amnesty for illegal aliens and their employers, secure our borders, fine employers of illegals $100,000 and felony prison time, remove illegal incentives like licenses and welfare, enforce all immigration laws, no citizenship for children of illegal aliens, remove American citizenship from any with dual citizenship, end offshoring, end NAFTA, place high tariffs on nations using wage-slave labor like China! Enforce Title 8 Section 1325 of the U.S. Code!

    A "no-stacking agreement"?

    We have become the third world cesspool these people supposedly left behind. To have a no-stacking agreement, this landlord knew well and good what kind of tenants he was renting to and their habits.

    good for this illegal , i'm glad he tried to burn that place down ... it was wrong of the people hosting the party not to invite him , that infrgined on his CIVIL RIGHTS ....

    A 19-year-old illegal immigrant from Honduras was sentenced Friday to four years in state prison for deliberately setting a fire last May at a multi-family house in Morristown because he was angered at being thrown out of a party.

    Fernando Inestroza, who performed odd jobs to earn a living, apologized to state Superior Court Judge Stuart Minkowitz for putting lives at risk by setting the fire at the Sussex Avenue home around 4:30 a.m. May 16.

    Defense lawyer Michael Fletcher asked for a three-year term and county Assistant Prosecutor Julie Serfess asked for a five-year term on the guilty plea that Inestroza entered last year to aggravated arson.

    The judge imposed four years. Inestroza will get credit for nine months he already has served in the county jail and will be deported to his native Honduras upon release from prison, Fletcher said.

    At the time of the blaze, Inestroza was a tenant of the house next door but was tracked down to a house in East Orange within a few days of the crime. Several town firefighters had rushed into the building to evacuate tenants, and one firefighter was injured when part of the home collapsed and knocked off his helmet.

    Inestroza had become intoxicated and offensive at the party so others told him to leave. He lighted a piece of paper with a butane lighter and put it in a plastic garbage can on a second-floor wooden deck of the structure, he acknowledged.
